Names mentioned include: James Daly Kelly of County Galway Esquire; Catherine Gore daughter of Sir Ralph Gore Baronet deceased; Henry Brook of County Fermanagh Esquire Guardian of Catherine Gore; Right Honourable Thomas Marlay Esquire Chiefe Justice of his Majesties Court of Chiefe Pleas in Ireland; Thomas Benningham Esquire eldest son and heir apparent of Francis Lord Baron of Athunny; Sir St. George Gore St. George of City of Dublin Baronet; Honourable Anthony Malone of The City of Dublin His majesties Prime Sergeant at Law; Richard Blake of County of Galway Esquire; Johne Bran of Westport County Mayo Esquire. "Thomas Marlay c.16801756 was an Irish politician and judge who ended his career as Lord Chief Justice of Ireland. He is remembered chiefly for the rebuilding of Celbridge Abbey and as the grandfather of the statesman Henry Grattan." "Sir Ralph Gore 4th Baronet c. 1675 23 February 1733 was a Speaker of the Irish House of Commons. He is now chiefly remembered for building Belle Isle Castle. "Sir St George Gore-St George 5th Baronet 25 June 1722 25 September 1746 was an Anglo-Irish politician and baronet. Born St George Gore he was oldest son of Sir Ralph Gore 4th Baronet and his wife Elizabeth Ashe daughter of St George Ashe Bishop of Clogher. In 1733 he succeeded his father as baronet. He assumed the additional surname of St George to inherit the estates of his maternal grandfather whose only son had died without issue in 1721. Gore-St George represented Donegal County in the Irish House of Commons from 1741 until his death in 1746." "James Daly circa 1716 1769 was an Irish Member of Parliament. In 1741 he was elected to the Irish House of Commons for Athenry and then in 1768 for the borough of Galway. He was son of Denis Daly of Carrownakelly and grandson of Denis Daly a judge of the Common Pleas. By his will made in July 1774 he left all his estates in the counties of Westmeath Roscommon Longford Cavan and Dublin to his nephew Richard Malone. In 1740 he was appointed Serjeant-at-law but was dismissed from office in 1754 for opposing the claim of the crown to dispose of unappropriated revenue. ‎1717. 0. 18th Century Obligation Bond. 12.5" x 8.0". Folded bi-folio. English and Latin text on one side only. With two vertical folds and one horizontal fold resulting in one small hole. The first part is in Latin and begins: 'Noverint universi per presentes.' The second part is in English with signatures and seal at the bottom of the page. Names identified include Mary Parrat of Broadwater Sussex obligee; Richard Parrat obligor. The Latin section ends with the date 1717. Other signatories include: Richard Wed; Tho. Emery; and Thomas Backshall N.B. : The 'obligation'. In the obligation the names of the parties are given the obligor states that he is bound to the obligee the penal sum is given and the date. This part of a bond was in Latin until 1733 except during the Commonwealth period in the mid-seventeenth century when it was in English The 'condition'. This part of a bond gives the details of what the obligor is promising to do. At the end a clause states that if he does what he promises the bond will become null and void. If he does not then it will remain in force and he becomes liable to pay the penal sum. This part of a bond was normally in English even in the medieval period. . 1717. 0‎

‎4th August 1717. 0. Performance Bond: Folded paper document: Mariam Mary Parrat of Broadwater Sussex and Robert Parrat West Hanning Suffolk Farmer. 4th August 1717 . Hand written in Latin and English. Remains of red wax seal a few edge tears and one small hole. "A performance bond is a surety bond issued by an insurance company or a bank to guarantee satisfactory completion of a project by a contractor. A job requiring a payment & performance bond will usually require a bid bond to bid for the job. When the job is awarded to the winning bid a payment and performance bond will then be required as a security to the job completion. For example a contractor may cause a performance bond to be issued in favor of a client for whom the contractor is constructing a building. If the contractor fails to construct the building according to the specifications laid out by the contract most often due to the bankruptcy of the contractor the client is guaranteed compensation for any monetary loss up to the amount of the performance bond. Performance bonds are commonly used in the construction and development of real property where an owner or investor may require the developer to assure that contractors or project managers procure such bonds in order to guarantee that the value of the work will not be lost in the case of an unfortunate event such as insolvency of the contractor. In other cases a performance bond may be requested to be issued in other large contracts besides civil construction projects. The term is also used to denote a collateral deposit of "good faith money" intended to secure a futures contract commonly known as margin. Performance bonds are generally issued as part of a 'Performance and Payment Bond' where a Payment Bond guarantees that the contractor will pay the labour and material costs they are obliged to. Under the Miller Act of 1932 all Construction Contracts issued by the Federal Government must be backed by Performance and Payment Bonds. States have enacted what is referred to as �Little Miller Act� statutes requiring Performance and Payment bonds on State Funded projects as well.
