First edition. The constituent elements making up this work are signed separately and were evidently printed as units during the course of the trial. There are a number of contemporary manuscript revisions and corrections in the text along with a manuscript docket partly cut away when bound at the head of Bushe's speech re: Kirwan. The 1793 act determined the legality or illegality of certain types of assemblies and in the instances of the defendants here charged appears have been directed against them as non-residents petitioning Dublin Catholic election assemblies. Tried before Joseph Story in his capacity as the Judge of the U.S. Circuit Court for the District of Massachusetts this trial involved murders committed on the merchant schooner Plattsburgh bound from Baltimore to Smyrna. Led by Williams the accused murdered the captain and took the ship to Norway. All the defendants except White were found guilty of murder and piracy and hanged. Smith of Demerara minister of the gospel who was tried under martial law and condemned to death on a charge of aiding and assisting in a rebellion of the negro slaves; from a full and correct copy transmitted to England by Mr. Smith's counsel and including the documentary evidence omitted in the Parliamentary copy; with an appendix; containing the letters and statements of Mr. and Mrs. Smith Mrs. Elliot Mr. Arrindell &c.; and also the Society's petition to the House of Commons. The whole published under the authority of the directors of the said Society.‎

John Smith 1790-1824 was born the son of a soldier near Kettering in Northamptonshire was educated at the local Sunday school and was later apprenticed to a biscuit-maker in London. 'Under the influence of the Rev. John Stevens he became earnest in matters of religion and zealous for study. He was accepted by the London Missionary Society and in December 1816 was ordained as successor to John Wray at Le Resouvenir near Demerara or Georgetown in British Guiana. He arrived at Demerara on 23 Feb. 1817 and in his first interview with the governor Major-general John Murray the latter threatened that if he taught any negro-slave to read he should be banished. Notwithstanding the undisguised hostility of the white population he laboured among the negroes with considerable success. In August 1823 his health broke down and he was recommended by his doctor to leave the colony. On 18 Aug. however a rising of the negroes took place and three days later Smith was arrested for refusing to take up arms against the negroes. He was tried by court-martial on the charge of having promoted discontent among them. On the worthless evidence of terrorised slaves he was found guilty and sentenced to be hanged. His execution was postponed until the pleasure of the home government should be known. But he was confined in the meantime in an unhealthy dungeon and died there on 24 Feb. 1824. When the news of Smith's imprisonment reached England popular interest was aroused. The publication of the documents connected with the case by the London Missionary Society intensified the excitement and upwards of two hundred petitions on his behalf were presented to parliament in eleven days. On 1 June 1825 his trial was debated in the House of Commons. Lord Brougham brought forward a motion condemning the action of the Demerara government and asserted that �in Smith's trial there had been more violation of justice in form as well as in substance than in any other inquiry in modern times that could be called a judicial proceeding.� After an adjournment however the motion which was opposed by government was negatived by 193 to 146'. ‎Camp near Kenston North Carolina 1863. Unbound. Very good. This three-page summary of the proceedings of a Confederate Army Court Martial is dated "28th July 1863." The document is in nice shape. Transcript provided. Images in this listing not included. The proceedings document the trial of Isham Stone a Private in the 50th North Carolina Infantry who had been "absent without certification" for nine months after being discharged from an army hospital at Petersburg Virginia. Stone pleaded guilty and was sentence to what today would be considered cruel and unusual punishment: "And the Court do therefore sentence the said prvt Isham Stone Co 'B' 50th Regt N.C.T. to be bucked and gaged four hours each day for twenty days with a stick ¾ of an inch in diameter two hours in the morning and two in the evening and be compelled to walk the Guard line around the camp before the sentinels at the point of a bayonet with a 'Barrel Shirt' on for five days two hours in the morning and two in the evening of each day and be closely confined during the execution of the sentence.". Bucking and Gagging was a tortuous punishment. A soldier was forced to sit on the ground and bring his knees up to touch his chest. His arms would be wrapped around his legs and tied together with his ankles. Then a rough rod would be inserted under his knees and over his arms. The pain was excruciating. Finally the soldier was gagged usually with a stick or bar forced between his jaws like a horse's bit and tied tightly behind his neck. This was done both to cause more pain and to partially muffle his screaming. Upon release any movement of the legs was almost as painful as being bound so to stagger around a camp's perimeter in a "barrell shirt" at bayonet point must have been equally agonizing. This punishment was usually reserved for deserters who were not sentenced to execution and it made a vivid impression of other members of the unit. A less painful version was used for less serious offenses during the Mexican War; see p 394 Dolph's Sound Off! Soldiers Songs. Barrel shirts are exactly what they sound like. A prisoner would have a large heavy barrel lowered over his head and onto his shoulders. Manuscript records kept by Confederate court martial boards are decidedly uncommon and ones imposing bucking and gagging and barrel shirts are rare. At the time of listing other than this example none are for sale in the trade or have appeared at auction per the Rare Book Hub and Worthpoint. OCLC shows none held by institutions. unknown‎
