Washington D.C. November 25 1902. 1902. Very good. - Over 85 words penned on 10-1/2 inch high by 8 inch wide creamy white paper. In his letter addressed to the Albany NY bookseller Joseph McDonough Schubert expresses his "pleasure in mailing to you five copies of my prize winning essay gratis and will be thankful to you if you will please include the title and author in your subsequent catalogues." Signed "B.F. Schubert". The letter is folded for mailing with a tiny chip at top left. Very good. <p>The attorney B.F. Schubert was a graduate of Georgetown University. He authored the prize essay "Merits and Demerits of Trial by Jury and How the Last Can Best be Remedied" which was published by Georgetown University's School of Law in 1898.</p> Washington, D.C., November 25, 1902.

Prescrizione dei reati e durata dei processi dopo la legge Spazzacorrotti (L. 3/2019)
br. La L. 3-1-2019, n. 3 (cd. Legge spazzacorrotti) ha introdotto importanti misure per il contrasto alla corruzione, in tema di prescrizione dei reati ed in materia di trasparenza dei partiti e movimenti politici. La legge, che si compone di un articolo unico suddiviso in 30 commi, è stata pubblicata sulla Gazzetta ufficiale del 16-1-2019 ed è entrata in vigore il 31 gennaio 2019, ad eccezione delle norme in tema di prescrizione che entreranno in vigore il 1 gennaio 2020. Il differimento dell'entrata in vigore proprio delle norme in materia di prescrizione testimonia come su tale punto vi siano stati forti contrasti tra le forze politiche e si è preferito rimandare l'introduzione di una riforma epocale (sospensione della prescrizione dopo la sentenza di primo grado) sperando che possano essere nel frattempo introdotti correttivi al sistema penale che rendano più celeri i processi. Il presente lavoro, che vede la luce quando è ormai prossima l'entrata in vigore delle nuove norme sulla prescrizione, cercherà di approfondire il contenuto della novella inserendo le modifiche nell'alveo della disciplina generale della prescrizione che era già stata profondamente modificata prima dalla L. 5-12-2005, n. 251 (cd. Legge ex Cirielli) e poi dalla L. 23-6-2017, n. 103 (cd. riforma Orlando). È appena il caso di sottolineare come i continui interventi legislativi in materia di prescrizione testimoniano la particolare rilevanza, anche pratica, dell'istituto e le difficoltà di contemperare l'interesse dello Stato alla punizione dei reati con i diritti dell'imputato ad un processo dalla durata ragionevole. Il lavoro, suddiviso in cinque parti, affronta nella Prima la disciplina generale della prescrizione; nella Seconda riporta gli orientamenti giurisprudenziali consolidati in tema di prescrizione; la parte Terza presenta il raffronto tra le norme del codice penale ante e post riforma con in grassetto le novità disciplinari. La Quarta parte riporta poi il parere del Consiglio Superiore della Magistratura sul disegno di legge spazzacorrotti, nonché le proposte dell'Associazione Nazionale Magistrati e dell'Unione Camere penali in materia di processo penale. Completa il lavoro una parte Quinta con le tabelle dei termini di prescrizione per fornire a tutti gli operatori del diritto un valido ausilio nella pratica quotidiana.
