Depuis les événements de juillet 1830 la duchesse du Berry et le parti légitimiste avait toujours été hostiles au nouveau gouvernement et à son Monarque le roi Louis-Philippe. La duchesse du Berry tenta donc par tous les moyens de placer sur le trône son fils Henry V de Bourbon l'aventure du San-Carlo de Marseille constitue une des tentatives de lka duchesse pour fomenter un complot rallier ses amis de provence. Le San-Carlo en difficulté fut contraint d'entrer dans la rade de la ciotat où ses passagers furent arrêtés du valet de chambre au capitaine. Parmi les passagers se trouvaient le père et le fils de Kergolais qui avaient jurés de ne pas prêter serment au nouveau gouvernement le père fut député et pair sous la Restauration. A noter que le procès des Kergolais qui se déroula à Monbrison et non à Aix vit la seule intervention en tant qu'avocat de Alexis de Toqueville qui fit un plaidoyer pour défendre son jeune ami de Kergolais. D'autres personnages furent également impliqués dans cette affaire ainsi du général Saint-Priest ou de Philippe-Auguste de Bourmont. Quant à la duchesse bien que surveillée par la police et qui fut incapable d'organiser son insurrection elle voyagea jusqu'à Nantes où elle tenta de réveiller les guerres de Vendée et elle fut peu après arrêtée et emprisonnée. Bien que le procès eut lieu à Monbrison toutes les pièces concernant la découverte de l'affaire se firent à Aix puis à Lyon. On demande ainsi après avoir découvert des preuves du débarquement de la duchesse que celle-ci soit poursuivie. Les pièces discutent également de la légalité de l'arrestation.
