"The author's position as Parliamentary Counsel to the Treasury is a sufficient guaranty of the worth of any work from his hands on the subject of legislative methods since upon him rests the responsibility for the drafting and form at every stage of all the Government bills introduced into the British Parliament. From a man who has so ably filled this important office much was to be expected and those who will have the good fortune to read Sir Courtenay Ilbert's book will be in no wise disappointed. . In short it would be difficult to imagine a book of more use to the practical legislator. The style is so clear and pleasant and the subject matter of such vital importance that notwithstanding the necessarily technical nature of portions it is of great interest even to the unlearned reader." New. $27.95 This is a useful introduction to Roman law with a level of detail that falls midway between an outline and a textbook. Carefully organized it is also an excellent reference guide. "To begin with it is quite comprehensive for there is not a single principle of Roman law sufficiently important to be included in first-year study which the author has omitted. Legal principles and definitions are very concisely stated and a lecturer on the subject will be glad to find an important rule given in such brief almost epigrammatic form that it can be readily committed to memory. . Another good feature is the practice of frequently citing the original Latin phrases and sentences. Lastly the translator has provided a good index which is a valuable addition to the original work. We are sure that many teachers of Roman law will welcome this book as a manual to be placed in the hands of their students.": Columbia Law Review 7 1907 377-378. unknown books

"The Law Military has undergone many changes in this country since the year 1860. Some of these changes have been of a radical character introducing many new features into the administration of military jurisprudence. The relation of the military to the civil power has also during the same time received much attention. These considerations would of themselves abundantly explain the raison d'etre of a new work on military law. It supplies a want that has long been felt. But besides this military law has grown in importance more persons being affected by it and powers having been vested in military courts which they have never held before. That this is felt to be the case is shown by the increased facilities for acquiring it which the government affords him. At the U.S. Military Academy a professorship and an assistant professorship have been established for this purpose. . Ives' treatise is intended as a text-book in a course on military law as well as for use throughout the army; and in my opinion he has met with marked success in adapting it to his purposes.": From the Preface by Guido N. Lieber Professor of Law at West Point and the son of Francis Lieber. Ives 1849-1881 was an artillery officer and Assistant Professor of Law at West Point. unknown books

Sheppard's Action Upon the Case for Slander and William March's Actions for Slaunder 1647 were the first two books to address the topic. As indicated by its preface Sheppard's is especially interesting. " this Age the iniquity of the Tongue that little Member set on fire by Hell is not the least; And among the evils of the Tongue is there any more pernicious and deadly and yet more common and epidemical then Backbiting and Slander . It is true that in former times wee finde Actions of the Case for Slanderous words very rarely brought; which speaks this much that such words were then very rarely spoken. But in these daies they are become almost as natural to men as their language and discourse; and therefore the disease so deeply rooted and over-spreading calls for the application of the Remedy which our Law doth abundantly furnish us withall. And hence it is I have been encouraged to ingage in this work; which is nothing else but a naked and Methodical Collection of the remedies prescribed by the Law against this Malady. unknown books

The Court of Star Chamber was established by the Crown in 1487 to try offences dealing with the safety of the state before a council. Its scope expanded over time to include a wider array of criminal matters and a limited number of civil matters such as suits between corporations and prize cases. In its final years the court was infamous for cruelty arbitrary nature and illegal extensions of power. It was abolished in 1641. Crompton's L'Authoritie et Iurisdiction des Courts de la Maiestie de la Roygne 1594 is one of the best sources we have today about the court system of his day. Star-Chamber Cases was derived from this treatise. As W.S. Holdsworth points out "it is the book of a common lawyer to whom details as to the procedure and the jurisdiction of the court are more interesting than large questions as to its position in the state or its legal title to exercise jurisdiction." Atkinson says his goal was to "sum up the legal lifework of the best known and most prominent members of the Bar of West Virginia" without "flattery adulation and comparison of one with another or of any one against the rest" v. He fulfilled this aim admirably. The professional and personal lives of his subjects are described with great skill. Atkinson had the advantage of working at a time when many of the West Virginia Bar's founding members were still alive. Personal acquaintance with many of these lawyers and of anecdotes about other lawyers through those he knew enlivens the vivid sketches of the lawyers who practiced in West Virginia since its founding in 1863. unknown books

Arguably one of the most imposing volumes in the history of English law Fitzherbert abridged 13485 cases under 263 titles in alphabetical order. It was the first serious attempt to set the law down in systematic shape and served as a model to such writers as Brooke and Rolle. According to Boersma Fitzherbert accomplished "nothing less than to abridge all notes of significant cases at common law." Graham and Heckel refer to this work as the "book that 'made' the common law.": Law Library Journal 51 1957: 100-101. unknown books

Commentaries on the Constitution of the United States: with a Preliminary Review of the Constitutional History of the Colonies and States Before the Adoption of the Constitution. Fourth Edition with Notes and Additions by Thomas M. Cooley. Originally published: Boston: Little Brown and Company 1873. 2 Vols. xxxii 752; 737 pp. Reprinted 2008 2011 by The Lawbook Exchange Ltd. ISBN-13: 9781584778783; ISBN-10: 1584778784. Hardcover. New. $135. Reprint of the important fourth edition edited by Thomas M. Cooley. Commentaries on the Constitution was the most extensive and widely discussed study of the Constitution written during the antebellum period. It was originally published in 1833 and went through two more editions in 1851 and 1858. Divided into three books it offers a strongly nationalist interpretation of the Federal constitution. Book I contains a history of the colonies and a discussion of their charters. Book II discusses the Continental Congress and analyzes the flaws that crippled the Articles of Confederation. Book III begins with a history of the Constitution and its ratification. This is followed by a brilliant line-by-line exposition of each of its articles and amendments. Published in 1873 Cooley's edition updated Story's text to include discussion of the 13th 14th and 15th Amendments as well as other changes introduced during the Civil War and Reconstruction. Apart from James Kent no man has had greater influence on the development of American law than Joseph Story 1779-1845. He was Dane Professor of Law at Harvard where a played a key role in the growth of the school and the establishment of its national eminence and an associate justice of the United States Supreme Court where he was the author of several landmark decisions such as Martin v. Hunter's Lessee. His many books have been cited extensively and he remains an authority today. Thomas M. Cooley 1824-1898 was perhaps the most significant American jurist of the later nineteenth century. A deeply influential justice later chief justice of the Michigan Supreme Court he also played a leading role in the establishment of the University of Michigan Law School and was a charter member and first chairman of the Interstate Comme. unknown books

"This treatise.is the last word on this all important subject; the publishers have well selected Mr. Raymond C. Baldes of the Boston Bar to revise and enlarge it. For years it has been regarded as an authority upon the subject matter; here was one writer whose statements unsupported by judicial decisions made the law. The original text has been preserved as far as possible. . If there are defects in the execution of this work the writer of this review has failed to find them. . It may be that in years to come there will be found a later work upon the subject. If so it will embody all that there is in the present volumes as revised and published; the basic principle will be the same and only as there are new inventions or later decisions will it be found that the law has changed. This is a work which we cannot too highly compliment . Dr. Blaisdell has appraised the Commission as a going concern during its career of some eighteen years. He has ably constructed a balance sheet of accomplishments and deficiencies and has assigned the reasons for its varying fortunes. The main theme pursued is the difference between the original purpose and actual achievement. . For those who are interested in the background and record of an experiment in the administrative control of the trust problem this volume will prove of great value." : Benjamin S. Kirsh Columbia Law Review 33 1933 193-194. unknown books

Sources of the History of the American Law of Lawyering. From the series Foundations of the American Law of Lawyering. Clark New Jersey: The Lawbook Exchange Ltd. 2007. 668 pp. ISBN-13: 9781584778615; ISBN-10: 158477861X. Paperback. New. $49.95 The professional behavior of lawyers was a topic that attracted a good deal of attention during the nineteenth century. It was examined directly in bar rules essays and books and indirectly in biographies histories testimonials and funeral orations. Despite the quality and range of this literature some of it produced by such eminent jurists as Joseph Story and David Dudley Field it is mostly forgotten today. This is due in part to the assumption that these writings are out of date. It is also difficult to locate many of the finest examples. Compiled from a broad array of scarce materials Sources on the History of the American Law of Lawyering invites a reappraisal of the history of lawyering during the nineteenth century and addresses topics on legal ethics and professional behavior that are as relevant today as they were in the nineteenth century. MICHAEL H. HOEFLICH is the John H. & John M. Kane Professor of Law at the University of Kansas School of Law. He is the author of numerous books including Roman and Civil Law and the Development of Anglo-American Jurisprudence 1997 Sources of the History of the American Law of Lawyering 2007 and The Law in Postcards & Ephemera 1890-1962 2012. unknown books
