New. $26.95 One of his most important American studies of labor economics published in the twentieth century this book outlines an evolutionary and behavioral theory of value based on data drawn from court decisions. Analyzing the meaning of reasonable value as defined by the courts he finds that the answer is based on a notion of reasonable conduct. Expanding this point to encompass the habits and customs of social life he shows that court decisions are based on customs that are powerful forces shaping the economic system. In an early review Wesley Mitchell declared that Commons 1862-1945 carried this "analysis further along his chosen line than any of his predecessors. Into our knowledge of capitalism he has incorporated a great body of new materials which no one else has used adequately.": American Economic Review XIV 1924 253. unknown books

Pound Roscoe
New Paths of the Law
2012. ISBN-13: 9781616192648. ISBN-10: 161619264X. Pound Roscoe. New Paths of the Law. First Lectures in the Roscoe Pound Lectureship Series. Originally published: Lincoln: University of Nebraska Press 1950. 69 pp. Reprinted 2012 by The Lawbook Exchange Ltd. ISBN-13: 9781616192648. ISBN-10: 161619264X. Paperback. New. $21.95 Notable for their conservatism which became more pronounced in subsequent publications these lectures reflect on developments in the international legal order during the late 1940s. Pound detected three legal "paths": those of liberty humanitarianism and authoritarianism. The first which he endorses seeks to realize a maximum of free individual self assertion. Legal humanitarianism which he criticizes heavily is the expansion of injury law to include social redress and consumer protection. His antipathy toward the authoritarian path goes beyond a condemnation of authoritarian regimes like the Soviet Union to a rejection of any form of social legislation such as socialized medicine or state-run pensions. These lectures were delivered at the University of Nebraska where Pound had been dean of the College of Law from 1902-1907 and marked the establishment of the Roscoe Pound Lectureship Series. "This book . . . by its very thinness may succeed in luring attention away from competing attractions since here one may with the expenditure of only a little time obtain the reaction of one of the giants of jurisprudence to our confused complex and turbulent modern legal scene." --Frank Hanft North Carolina Review 93 1950-1951 29 Roscoe Pound 1870-1964 was a pre-eminent legal educator scholar and prolific author. A professor at Harvard Law School for most of his career and its dean from 1916-1936 he taught throughout the world in his later years. His five volume Jurisprudence 1959 is considered one of the most important contributions to the world's legal literature of the twentieth century. unknown books

New. $16.95 "The life of the law has not been logic; it has been experience." Oliver Wendell Holmes Jr. "Max Radin is the rare and finished product of our American legal system. He is skilled in the semantics of the law. But unlike some legal scholars and some judges too he does not use semantics to make law a facile thing to fit the idiosyncrasies of the author or to satisfy the moods of the moment. The law which he fashions is flavored with an earthy quality of function and practicality. He is quick to sense the enduring values of the democratic system and to see the law as the vehicle for their perpetuation." -William O. Douglas 36 California Law Review 163 1947-1948. "Mr. Radin is too good a logician to accept the popular antithesis between logic and experience as contraries white and black or as contradictories white and not white. Rather logic and experience are viewed as divergent directions in analysis. The shape of anything that lies within the field of law may be described therefore in terms of distances from 'our ordinate of logic and our abscissa of experience.' Upon this framework Mr. Radin proceeds to analyze the various compounds of logic and experience that constitute law evidence arbitration punishment and justice. --Felix S. Cohen 54 Harvard Law Review 711 1940-1941. MAX RADIN 1880-1950 received his LL.B. from New York University in 1902 and his Ph.D. from Columbia University in 1909. He was a law professor at the University of California Berkeley and UC-Hastings School of Law and a member of the Institute for Advanced Study at Princeton. "Mr. Wheaton's early familiarity with the jurisprudence and foreign relations of the United States his long experience in diplomacy his intimate acquaintance with European languages and foreign diplomatic writers entitles his writings upon International Law to more than ordinary consideration. His works enjoy the highest reputation for the soundness of their views and the learning and research displayed in illustrating the various topics discussed." --J.G. And yet there are those who love it!" -Daniel Webster Oral Argument March 10 1818 Dartmouth College v. Woodward Dartmouth College v. Woodward 1816-1819 established significant precedents concerning state authority and the nature of private enterprise. Dartmouth College was incorporated under a royal charter in 1769 as a private corporation. In 1816 the New Hampshire Legislature attempted to transform the college into a state institution. Daniel Webster representing the college trustees convinced the U.S. Supreme Court that the royal charter was a contract that could not be invalidated by subsequent state legislation. The court concurred. Its decision initiated a significant constitutional limitation on state authority. It also helped to define corporations as relatively unregulated private economic entities that contributed to the public sphere through enlightened self-interest. Shirley offers a vivid account of the case enriched by extensive quotation of primary archival sources. Reprint of the first edition. "The complete history of the Dartmouth college case is very curious and deserves more than a passing notice. Until within three years it is not too much to say that it was quite unknown and its condition is but little better now. In 1879 John M. Shirley published a volume entitled the 'Dartmouth College Causes' which is a monument of careful study and thorough research. Most persons would conclude that it was a work of merely legal interest appealing to a limited class of professional readers. Even those into whose hands it chanced to come have probably been deterred from examining it as it deserves by the first chapter which is very obscure and by the confusion of the narrative which follows. Yet this monograph which has so unfortunately suffered from a defective arrangement of material is of very great value not only to our legal and constitutional history but to the pol. unknown books

New. $14.95 The published version of a Columbia University doctoral thesis this pioneering monograph reviews all of the laws enacted by the United States and each individual state to 1917 relating specifically to African-Americans. Based on painstaking research this is a valuable reference for students of civil rights and African-American legal history. "The Development of State Legislation Concerning the Free Negro is an odd but very important and extremely useful book. Written nearly a century ago it is an example of the best of the Ph.D. dissertations of the first generation of doctoral students in the social sciences. It lacks any great theoretical framework or much analysis but it is chock full of information facts tables and excerpts from laws. It is also useful because many of the laws set out in this volume are not easily found otherwise. New. $21.95 First published in England in 1852 Forsyth's History of Trial by Jury is the first full-scale historical account of the rise and growth of the jury system in England. Highly regarded this book went through 37 editions. The first American edition the source of this reprint adds a number of notes and corrections to American references in previous editions. "An excellent summary of the opinions of leading legal writers as well as conventional historians regarding the original of trial by jury was set forth by an Englishman William Forsyth in his excellent book entitled History of Trial by Jury. . . . Various writers according to Forsyth attribute the origin of the English jury to a recognition of the principle that no man ought to be condemned except by the voice of his fellow citizens. Forsyth committed himself to the belief that trial by jury did not owe its existence to any positive law that it was not created by any Act of Parliament but grew out of usages and customs of society that eventually passed away. Forsyth concluded his observations by saying that 'the jury does not owe its existence to any preconceived theory of jurisprudence but that it gradually grew out of forms previously in use and was composed of elements long familiar to the people in general.'" --Robert H. White 29 Tennessee Law Review 14 1961-1962. William Forsyth 1812-1899 was an English lawyer and author of many works on law and literature including The History of Lawyers 1849. unknown books

New. $22.95 Goodnow's major work this book analyzes the distinction between "politics" and "administration." According to Goodnow politics is concerned with policy and other expressions of state will. Administration is concerned with the faithful execution of enacted legislation. He observes that administration has a tendency to overstep this boundary and concedes that politics must therefore monitor administration to keep it in line with the people's will. Reprint of first edition. While a member of the Columbia faculty Frank J. Goodnow 1859-1939 was the first individual in the United States to hold a professorship in administrative law. He became the first president of the American Political Science Association which offers an annual award in his name. He was president of Johns Hopkins University from 1915-1929. "From both the legal and historical standpoint the book contains many things that are richly suggestive. There is very little in our legal or political literature so penetrating as for example the exposition of the effects of confinement of the principle of separation of powers to the central government. . It is not written for the legal profession directly but to those lawyers who seek more than a working tool in their profession a true appraisement of the administrative law it will appeal. The writing of such a work moreover is a signal public service." -6 Columbia Law Review 1906 133. unknown books

Criminal Abortion: Its Nature Its Evidence and Its Law
2012. ISBN-13: 9781616192679; ISBN-10: 1616192674. 1868 Study of "Criminal Abortion" Storer Horatio R. and Franklin Fiske Heard. Criminal Abortion: Its Nature Its Evidence and Its Law. Originally published: Boston: Little Brown 1868. viii 215 pp. Reprinted 2012 by The Lawbook Exchange Ltd. ISBN-13: 9781616192679. ISBN-10: 1616192674. Paperback. New. $14.95 Containing both medical and legal perspectives Criminal Abortion is an important document from the early decades of the anti-abortion crusade. Dr. Storer led the medical campaign against abortion during the second half of the nineteenth century. His efforts were supported by Heard a notable jurist and legal scholar. The motivations for both men were primarily racist xenophobic and sexist. They were horrified by declining birthrates among Americans of Anglo-Saxon ancestry and the influx of immigrants many of them non-white Catholic and Jewish. In their minds abortion in the non-immigrant community which they attributed to modern fashion and feminism was leading to "race suicide" and a country overtaken by "inferior races." "The legal portion of the work will probably be of the greatest practical use. This seems to be a very full and thorough collection of all the statutes and cases of value relating to the subject." --3 American Law Review 149 1868 HORATIO R. STORER 1830-1922 received his M.D. from Harvard Medical School in 1853. He specialized in gynecology in his Boston medical practice. Well-known as an anti-abortion advocate he published widely in medical journals and wrote several popular pamphlets against abortion including Why Not A Book for Every Woman 1866 and Is it I A Book for Every Man 1867. From 1865-1867 he was professor of obstetrics and medical jurisprudence at Berkshire Medical Institution and received his LL.B. from Harvard Law School in 1868. FRANKLIN FISKE HEARD 1825-1889 was a Boston lawyer and coauthor with John William Wallace of the fourth edition of The Reporters 1882. He was the author of The Principles of Criminal Pleading 1879 Shakespeare as a Lawyer 1883 and other titles. unknown books

"This well-written and thoroughly researched book is essential reading for anyone interested or involved in property law or in English legal history. The main text and the footnotes both contain fascinating information. Mark Wonnacott's book throws illuminating shafts of light on the political economic social and religious history of this country as well as its legal history." --LORD NEUBERGER OF ABBOTSBURY M.R. Who has not been a landlord or a tenant It is one of the most common legal relationships between people and has been since the medieval period. But there is very little academic interest in the law of landlord and tenant. Nobody before has attempted to write its history. This book shows how the rules on each point of importance have developed. Sometimes it demonstrates how a wrong turn has been taken or an important principle forgotten. But its practical use is to provide the material for understanding the old cases and to put those cases in their proper context; for it is hard for any lawyer advising on a doubtful point to say where exactly we are now without a thorough understanding of what the law once was and how and when it might have changed. Mark Wonnacott is a barrister at Maitland Chambers in Lincoln's Inn London specialising in property litigation. If it is attached to the ground he litigates about it and the dustier corners of land law are his particular favourite. He was counsel for the successful appellant in Berrisford v. Mexfield Housing Co-operative Ltd. 2011 UKSC 52 which revived the rule that a tenancy for an uncertain term is a defeasible lease for life. When not in court or writing law-books he is collecting or repairing them or trying to learn Italian without much success or appreciating wine with somewhat more success. "The book covers the full range of substantive Roman law as well as the extension of Roman law throughout the modern world and in particular the influence of Roman law in the United States and England. Unlike most American legal scholars Burdick was sufficiently familiar with the primary sources of Roman law from Cicero to Justinian to write from them rather than secondary literature and translations. At the same time he was exceptionally well-versed in English and American case law and able to use these sources to show developments and parallels. It was a scholarly tour-de-force." -- Michael H. Organized by subject with introductory notes to most sections the book covers such topics as adoption bribery contracts crime and punishment divorce drinking government crimes against the State homicide husband and wife military law master and servant perjury prostitution oaths and wills. "The last section `Woman' is illustrative of the utility of this anthology. Its selection of texts from the two testaments forms a corrective to the notion that the alleged inferiority of the place of woman in life is to be debited to the Old Testament alone. The citations to her status are taken entirely from the New Testament. . . . The merits of the book in fact are outstandingly the admirable anthology of text which it provides in easily accessible form and the useful Introduction . . ." --Bertram B.
