‎Mängelstempel auf Fußschnitt, leicht bestoßen, sonst gut. -- Die Volksrepublik China hat sich in den letzten Jahren trotz einer dem eigentlich entgegenstehenden Ideologie zunehmend zu einer reglementierten Marktwirtschaft entwickelt, die wegen des riesigen Marktes und der niedrigen Lohnkosten für ausländische Investoren interessante Möglichkeiten eröffnet. Der Verfasser untersucht die Beteiligung an einer Gesellschaft als die "Endstufe des China-Engagements", die sorgfältiger Überlegungen bedarf. Dabei stehen steuerliche Überlegungen im Vordergrund. -- Im ersten Kapitel untersucht Küsell die Grundlagen des chinesischen Rechts, die für Verständnis sowie Beurteilung der sich anschließenden steuerlichen Erörterungen unabdingbar sind. Hierbei handelt es sich insbesondere um Rechtsformen des chinesischen Gesellschaftsrechts, Probleme der Rechtsunsicherheit und finanzielle Beschränkungen. Daraufhin wird die Ertragsbesteuerung chinesischer Gesellschaften mit ausländischem Kapitalanteil einer genauen Betrachtung unterzogen. Dabei werden steuerliche Konsequenzen bei der ausländischen Gesellschaft, einer deutschen Muttergesellschaft sowie einem inländischen Anteilseigner der Muttergesellschaft erörtert. Der Verfasser behandelt sowohl die auf dem Territorium Chinas vor der Rückgabe Hong Kongs geltende Ertragsbesteuerung als auch die derzeit gültige Profits Tax Hong Kongs. Anschließend werden beispielhaft steuerliche Planungsmöglichkeiten vorgestellt und kritisch gewürdigt. -- Die verbalen Darstellungen der vorangegangenen Kapitel werden schließlich mit Hilfe einer umfangreichen computergestützten Veranlagungssimulation quantitativ unterlegt. Mittels der Veranlagungssimulation gewinnt Küsell Aussagen über steuerliche Vor- und Nachteile des Standorts China im Vergleich zum Standort Deutschland. -- Mit der vorliegenden Arbeit wendet sich der Autor sowohl an wissenschaftlich Interessierte als auch an den Praktiker.
