Photographer's stamp verso. 13 x 18cm.On the afternoon of July 20 1948 FBI agents began rounding up twelve men in New York City Chicago and Detroit whom the U.S. government believed posed a grave threat to the nation--the leadership of the Communist Party-USA. After a series of delays eleven of the twelve "top Reds" went on trial in Manhattan's Foley Square in January 1949.The proceedings captivated the nation but the trial quickly dissolved into farce. The eleven defendants were charged under the 1940 Smith Act with conspiring to teach the necessity of overthrowing the U.S. government based on their roles as party leaders and their distribution of books and pamphlets. In essence they were on trial for their libraries and political beliefs not for overt acts threatening national security. Despite the clear conflict with the First Amendment the men were convicted and their appeals denied by the U.S. Supreme Court in a decision that gave the green light to federal persecution of Communist Party leaders--a decision the court effectively reversed six years later. But by then the damage was done. So rancorous was the trial the presiding judge sentenced the defense attorneys to prison terms too chilling future defendants' access to qualified counsel. HUAC’s chief investigator didn’t trust Whittaker Chambers their star witness in the case against Alger Hiss feeling that even now he’d withheld some crucial evidence for reasons known only to himself. “He sits and lights his pipe he is cold and calculating and he knows exactly what he will do three weeks hence†Stripling complained. Since their case rested entirely on Chambers’ word it unnerved him. For now he and other committee members swallowed their reservations as the Case became an unparalleled public spectacle.It had been eight days since Hiss and Chambers met face-to-face in executive session. In preparation for the public showdown the Committee called a number of witnesses trying to corroborate details of the two’s relationship. Among them was Priscilla Hiss who dimly remembered George Crosley – Chambers’ alleged alias – as “a small person very smiling person—a little too smiley perhaps.†Others Chambers named in his initial testimony including John Abt and Lee Pressman denied knowing Chambers at all nor did peripheral witnesses clarify details about Hiss selling Chambers a 1929 Ford or his leasing Chambers an apartment. It seemed like the case whatever its merits would come down to public drama.Already theatrical Hiss and Chambers’ dispute exploded into soap opera on August 25th. Thousands of sweating spectators and jostling journalists packed the Capitol; television crews broadcast the hearings live to millions across the country the first glimpse many Americans received of Congress in action. Those who knew the two men only from newspaper accounts and newsreel footage could now judge for themselves. J. Foster 1881-1961 fought his way out of the slums of turn-of-the-century Philadelphia to become a professional revolutionary as well as a notorious and feared labor agitator. Drawing on private family papers FBI files and recently opened Russian archives this first full-scale biography traces Foster’s early life as a world traveler railroad worker seaman hobo union activist and radical journalist and also probes the origins and implications of his ill-fated career as a top-echelon Communist official and three-time presidential candidate. Photographer's stamp verso. 18 x 13 x cm.NYT February 1 1961:Eugene Dennis national chairman of the Communist party in the United States died yesterday of cancer in Mount Sinai Hospital. He was 56 years old. His home was at 626 West 151st Street. Mr. Dennis was general secretary of the Communist party in this country from its peak period in 1945 when it numbered about 80000 members to its decline in 1957 when the membership was about 20000. It is now believed to be fewer than 10000. In 1957 Mr. Dennis became the party's secretary of national affairs and a member of its executive committee. He was named national chairman in December 1959. The party had been split by factionalism after the Soviet Union's show of force in Hungary in 1956. He supported Russian action to quell the Hungarian uprising but advocated greater party independence from Moscow dictation. He led middle-of-the-roaders opposing William Z. Foster then national chairman who demanded continued allegiance to Russia. When in 1957 the party received a letter from Jacques Duclos top French Communist chiding it for "dangerous" tendencies and urging solidarity with Soviet foreign policy Mr. Dennis said: “Our decisions will be our own.â€.In 1956 he said the party had lost its influence and became politically isolated by policies too far to the left. He wrote an article for The Daily Worker asking whether Premier Khrushchev of the Soviet Union and his colleagues could not have done something to restrain Stalin's terror. He thus took a considerably more moderate position than Mr. Foster a stanch Stalinist.Mr. Dennis invoked the Fifth Amendment in an appearance in February 1957 before the Senate Internal Security subcommittee in Washington and refused to testify.Mr. Dennis had been a member of the party since 1926. In 1949 he was convicted under the Smith Act as one of the eleven "first-string" Communists tried in Federal Court here for conspiracy to teach and advocate the overthrow of the Government by force and violence. Judge Harold R. Medina who presided at the nine-month trial sentenced him to five years in prison. Higher courts upheld the sentence and the Communist leader served three years and nine months in Atlanta Penitentiary from July 22 1951 to March 1 1955 receiving time off for good behavior 1947 unknown‎

He served two terms as the Communist Councilman from Harlem. However he was unceremoniously – perhaps illegally – ousted in 1949 as the Red Scare intensified. During the 1950s McCarthy period he served five years in jail as a victim of the fascist Smith Act. Gerald Horne’s Black Liberation / Red Scare: Ben Davis and the Communist Party is the definitive biography of Davis and his autobiography is titled The Communist Councilman from Harlem.On the afternoon of July 20 1948 FBI agents began rounding up twelve men in New York City Chicago and Detroit whom the U.S. government believed posed a grave threat to the nation--the leadership of the Communist Party-USA. Photographer's stamp verso. 13 x 18cm.Elizabeth Bentley 1908-1963 was an American communist and Soviet spy. She worked closely with Jacob Goros to manage the Communist Party USA CPUSA network of KGB sources and spies. In 1945 she defected and confessed her involvement with the KGB to the FBI. In her FBI deposition she also named forty-one Soviet spies and sources living and working in the United States.On the afternoon of July 20 1948 FBI agents began rounding up twelve men in New York City Chicago and Detroit whom the U.S. government believed posed a grave threat to the nation--the leadership of the Communist Party-USA. After a series of delays eleven of the twelve "top Reds" went on trial in Manhattan's Foley Square in January 1949.The proceedings captivated the nation but the trial quickly dissolved into farce. The eleven defendants were charged under the 1940 Smith Act with conspiring to teach the necessity of overthrowing the U.S. government based on their roles as party leaders and their distribution of books and pamphlets. In essence they were on trial for their libraries and political beliefs not for overt acts threatening national security. Despite the clear conflict with the First Amendment the men were convicted and their appeals denied by the U.S. Supreme Court in a decision that gave the green light to federal persecution of Communist Party leaders--a decision the court effectively reversed six years later. But by then the damage was done. So rancorous was the trial the presiding judge sentenced the defense attorneys to prison terms too chilling future defendants' access to qualified counsel. Photographer's stamp verso. 18 x 13 x cm.NYT December 29 1939:Miss Senta De Wanger a leading witness in the German spy case of 1938 disclosed yesterday that the Gestapo Germany's secret police had been inordinately curious about her affairs and had subjected her to a questioning that amounted to an ordeal during a recent visit in Germany.Instrumental in helping to convict three men and a woman after Guenther Gustav Rumrich had pleaded guilty to espionage Miss De Wanger would not say what the questioning was about but implied that the subject was the spy case in which eighteen persons several of them high in the councils of the Third Reich were indicted by a Federal grand jury.After spending five weeks with relatives she said the secret police questioned her “for many harrowing hours" and refused to give her an exit permit until Edmund J. Dorsy an American consul intervened. Then while passing through Singen to the Swiss frontier she continued she was searched and made to undress by a police matron.Miss De Wanger was interviewed at Roosevelt Field L. I. She returned here Saturday on the Conte di Savoia. Formerly a resident in the Roosevelt Field Hotel and a liquor dealer in Hempstead L. I. Miss De Wanger was acquainted with aviators knew key figures in the spy ring and in court identified Otto Hermann Voss a Seversky factory mechanic as a conspirator. He was one of those convicted. Her first marriage was to Curtis Bean Dall a New York stockbroker – they married in 1926 and divorced in 1934 sharing two children together. Anna moved into the White House with her children after this first divorce. Anna’s second marriage was to Clarence John Boettiger a journalist who she met while aiding her father’s second run for the presidency. They shared one son but divorced in 1948 – Clarence committed suicide in 1950 by jumping out of his hotel room window.
