Il diritto, come lo conosciamo nelle società occidentali, è un sistema concettuale di cui il giurista è l'interprete: una funzione che egli svolge concentrandosi sulle forme verbalizzate (leggi, decreti, sentenze, direttive) riconducibili a un potere statuale e politico, capace di garantire il rispetto della norma giuridica. Presso altre culture troviamo invece forme di diritto tradizionale-consuetudinario e fenomeni normativi latenti, posti al di fuori delle istanze statuali, non verbalizzati e non verbalizzabili. Di qui l'interesse per il giurista di adottare uno sguardo antropologico, il solo che può metterlo in condizione di misurarsi con modelli non occidentali, finora esclusi alla sua attenzione. Rodolfo Sacco, antesignano della comparazione giuridica e da sempre studioso attento alle forme "mute" del diritto, propone in questo volume un connubio, stretto e solido, tra le due discipline, reso oggi indispensabile dalle problematiche sollevate dal multiculturalismo, dalla globalizzazione e dalle spinte alla unificazione internazionale del diritto.
