Il volume mette inoltre in evidenza uno dei temi più discussi nell'agone politico e più dibattuti nelle aule di tribunale: il matrimonio tra persone dello stesso sesso. Con un'analisi che spazia dalle prime sentenze degli anni 70 fino all'abolizione del Defense of Marriage Act, viene messo in luce il conflitto tra diritto alla privacy e principio di uguaglianza nella battaglia per la dignità e la piena cittadinanza.

brossura La via statunitense al riconoscimento dei diritti delle persone omosessuali è stata particolarmente accidentata e, soprattutto, si è sviluppata grazie ad alcune importanti pronunce della Corte Suprema. Così, dal 2003 è stata depenalizzata l'attività sessuale tra persone dello stesso sesso e dal 2015 queste ultime possono accedere all'istituto matrimoniale. In questo volume, dopo una breve introduzione del diritto alla privacy, si ricostruisce, analizzandola, la principale giurisprudenza in materia di sodomia negli Stati Uniti d'America. Successivamente, si prosegue con l'approfondimento della questione del matrimonio tra persone dello stesso sesso, dalle prime sentenze degli anni '70 fino agli arresti giurisprudenziali più recenti. Completa il volume, infine, un'appendice che si propone di offrire una ricostruzione del modo in cui l'omosessualità era vista prima dell'avvento del concetto di sodomia e delle leggi atte a reprimerla.

brossura La prima edizione di questo libro è apparsa nel 2001 nella Collana di Monografie Giuridiche, curata dalla Facoltà di Diritto Canonico della Pontificia Università della Santa Croce. Questa seconda edizione riveduta e ampliata vede la luce a più di 15 anni di distanza dalla prima perché l'autore in questo lasso di tempo ha lavorato molto su quella che lui allora definiva l'urgente necessità di riscoprire il fondamento antropologico del matrimonio. Frutto di questo lavoro è la prima parte del libro, dal titolo L'unione di amore coniugale, in cui Viladrich fornisce al lettore le chiavi per una comprensione positiva del consenso matrimoniale, necessaria per poter poi comprendere adeguatamente il "negativo" del consenso, ovvero i capi di nullità. Nella seconda parte del volume viene riproposto in maniera aggiornata il commento dell'autore ai canoni sul consenso e ai capi di nullità, già apparso nella prima edizione del 2001.

Marriage described a case in which an attempt had been made to divide the eighth nerve within the skull for the relief of tinnitus. The patient a girl aged 23 contracted left otitis media in 1898. Several operations followed and four years afterwards she began to suffer from tinnitus and vertigo which symptoms increased in intensity to such a degree that life was rendered well-nigh intolerable. It was therefore decided to attempt to divide the eighth nerve as in the operation for the exploration of the posterior surface of the petrous bone. The procedure was very difficult on account of the constant discharge of cerebro-spinal fluid and haemorrhage but the auditory nerve was exposed and finally divided with a blunt hook. Noises were present on the following day. There was no facial paralysis. The wound never showed reaction and continued to discharge. The patient gradually sank and died on the twenty-first day. At the necropsy it was found that a fine strand of the auditory nerve had escaped division. There was no meningitis and the internal ear presented a normal appearance. Dr. Farquhar Buzzard said that his examination of the nerve showed that the vestibular and two-thirds of the coeliac nerves were degenerated as a result of the resection of the nerve. Very little was known as to the morbid anatomy of tinnitus which was a rare symptom in gross lesions of the brain except where the nerve roots at the base were affected.
