London: George Eyre and Andrew Spottiswoode 1840. Printed bifolium pp. 465-467 misnumbered 468 armorial letterhead fine. An important Act for the future subdivision of New South Wales into separate colonies namely Victoria in 1851 and Queensland in 1859. The Act describes the possible need for separation given the 'great extent' of New South Wales as the entire eastern portion of the Australian continent. Governing this vast area from Sydney posed serious problems of communication and effective administration and discontent with the existing system was becoming increasingly obvious by the time this Act was passed in 1840. This Act allows Queen Victoria to appoint Legislative Councils for the new colonies who may draft new laws subject to approval before parliament in Britain. This provision was to be especially important in the case of Victoria where separation from New South Wales was soon followed by the gold-rushes. Edinburgh: printed by Sir D. Hunter Blair & J. Bruce 1803. Disbound from stab-sewn binding some browning marginal paper repair to first leaf but overall sound condition. Folio pp. 1-14 disbound. One of the most important amendments to the laws of Transportation formalising the requirement for convict vessels to carry a Surgeon and thus directly responsible for a huge improvement in mortality rates. The Act is also interesting for noting some of the abuses rampant aboard convict transports and other passenger vessels travelling from Britain. The First Fleet had been provisioned by the Admiralty itself and the Surgeons on board led by John White had an excellent record. From the Second Fleet onwards the task was contracted to private companies infamously derelict on the Second Fleet itself and with wildly varying results over the ensuing decade. On several occasions officers colluded to deny the convicts their correct rations so the surplus could be sold upon arrival at Port Jackson for a handsome profit. A plan to return convicts to naval vessels was scuppered by the ongoing conflict with France. This Act regulated the terms of carrying all passengers free or convict detailing acceptable provisioning and the role of the Surgeon and allowing for a bond of £50 per head to be paid by the owners of any vessel. Although abuses continued aboard the convict transports conditions did improve overall and the casualty rate for convicts sent to New South Wales fell from one in ten between 1795 and 1801 to one in forty-six for the period 1802-1812. One curious result was that British conservatives started to criticise the transports as being too comfortable and therefore a poor deterrent to crime. printed by Sir D. Hunter Blair & J. Foundation Act of the Australian Agricultural Company a fabulously lucrative investment scheme that followed a formal meeting at the chambers of John Macarthur in Lincoln's Inn during April 1824. In principle the Company derived from a simple conundrum; the Australian colonies abounded in unutilised land and convict labour but lacked a corporate structure to attract investment capital. Accordingly in return for raising one million pounds in capital the company was awarded a land grant by the New South Wales government of one million acres. The Company was formed and incorporated by this Act of Parliament and a Royal Charter issued on the first day of November 1824. This Act comprises a pivotal document in the early economic history of Australia. Once established the Australian Agricultural Company opened up vast areas of wilderness for grazing and agriculture and provided the impetus for much of the inland exploration of New South Wales for the following two decades. Following the recommendation of Commissioner Bigge the Company was based on a Mediterranean production model of wool grapes olives flax and similar crops suited to the southern climate.
