Uncommon: a significant eighteenth-century Act of Parliament amending and continuing the practice of transportation. It was in 1784 that the English government proclaimed the legal reinstitution of transportation with "An Act for the effectual Transportation of Felons and Other Offenders" Ferguson 3 and its companion Act for Scotland Ferguson 4bb. These two 1784 Acts laid out all of the basic conditions of transportation but interestingly had time limits imposed which meant that they could not last indefinitely and that continuations were required periodically. An Act for the further Preventing Robbery Burglary and other Felonies and for the more effectual Transportation of Felons.

The First Transportation Act of 1718 which allowed courts to sentence convicts to seven years in America in order 'to deter criminals and to supply the colonies with labour' Shaw Convicts and the Colonies p. 25. This Act which first formally involved the British Government in the practice of transportation was discontinued with the War of Independence in 1776 but lay at the heart of the renewal of the practice in the mid-1780s when the colony in New South Wales was being planned. As a result this Act should be considered central to the pre-history of Botany Bay. The Act begins lamenting the present state of affairs where thieves sent to the West Indies regularly return to crime with a high incidence of capital punishment for such reprobates. This dire situation is contrasted with a significant labour shortage: 'in many of His Majesty's colonies and plantations in America there is a great want of servants who by their labour and industry might be the means of improving and making the said colonies and plantations more useful to this nation.' Although now formalised as government policy this Act would still rely on private merchants who could moreover profit from the sale of the convicts once they had arrived in the New World. As a result the Act promotes transportation to America for a term of seven years as an alternative to the usual punishments for larceny - flogging branding of the hands or confinement in workhouses and other penitentiaries. Significantly it notes that those found guilty of crimes previously punished by death specifically the purchase and resale of stolen goods could now be eligible for transportation and labour for a period of fourteen years. Of additional interest are clauses stipulating the terms and conditions of return to the United Kingdom upon completion of the transportation sentence including costs to be incurred by the ex-convict. Not surprisingly those convicted of piracy are denied the exemptions and mercies extended to regular felons through this transportation act. John Baskett by order of Parliament unknown

Uncommon: an 1802 Act which significantly altered the practice of transportation due to the legal loophole pointed out by the great legal theorist Jeremy Bentham the same year who noticed that a Royal Navy vessel carrying convicts left the captain in the legal position of being a kidnapper. Jeremy Bentham made his argument in his Letters to Lord Pelham 1802 in a long discussion of the peculiar legal standing of the convict ship the Glatton which had been the first "king's ship" to serve as a convict transport rather than having been hired from a private individual as hitherto. Bentham commented that this was a legal minefield and that the ship's captain of the Glatton had - legally at least - been guilty of kidnap. The ship's captain before the institution of the present Act wrote Bentham had no better warrant than if he had coerced revellers from a "birth-day ball-room". It was directly as the result of Bentham's argument that the present Act allowed the King to "nominate and appoint Persons to have a Property in the Service of such Offenders.". The voyage of the Glatton to New South Wales was under Captain James Colnett a veteran of Cook's second voyage and author of an important account of his own Pacific voyage in the late 1780s. The Glatton had another claim to fame being commanded by Captain William Bligh in the 1801 battle of Copenhagen. George Eyre & Andrew Strahan unknown

From Wikipedia: The situation of World War I prisoners of war in Germany is an aspect of the conflict little covered by historical research. However the number of soldiers imprisoned reached a little over seven million for all the belligerents of whom around 2400000 were held by Germany. Starting in 1915 the German authorities put in place a system of camps nearly three hundred in all and did not hesitate to resort to denutrition punishments and psychological mobbing; incarceration was also combined with methodical exploitation of the prisoners. However the captivity organized by the German military authorities also contributed to creating exchanges among peoples and led a number of prisoners to reflect on their involvement in the war and relation with their homeland. Soldiers were not the only ones made prisoner during the war; civilian populations were also impacted. Historian Annette Becker has extensively studied this aspect of the war. After the invasion the German Army started by taking hostages first of all the towns' leading citizens. Several invaded countries were affected by civilian deportations: France Belgium Romania Russia etc. 100000 were deported from France and Belgium. From 1914 both male and female civilians aged 14 and over from the occupied zones were forced to work quite often on projects related to the war effort such as the rebuilding of infrastructure destroyed by fighting roads rail tracks etc. In short order the civilians began to be deported to forced labor camps. There they formed the Zivilarbeiter-Bataillone civilian workers' battalions and wore a distinctive mark: a red armband. Becker indicates that their living conditions resembled those of the prisoners - that is they were harsh. The hostages were sent to camps in Prussia or Lithuania and some of them remained prisoners until 1918. Like the military prisoners civilians were subject to exchanges and a bureau for the repatriation of civilian detainees was created at Bern in 1916.
