London: Printed by H. Meere for A. Bettesworth et al 1716. Two volumes. 6330;4320pp. 12mo. Contemporary paneled calf and paneled sheep not uniform. Early ink initials in corner of each title margin spine extremities worn with slight cracking to a couple joints one label wanting; internally slightly tanned but crisp and very good. First and only edition it would appear of this compilation for popular reading as evidenced by the emphasis placed on the accounts of final words and executions and modes for same rather than on legal subtleties. TREASON ACT 1649.
An Act Declaring what Offences Shall be adjudged Treason. Die Martis 17 Julii 1649
London: Edward Husband and John Field 1649. TREASON ACT 1649. An Act Declaring what Offences Shall be adjudged Treason. Die Martis 17 Julii 1649. Ordered by the Parliament That this Act be forthwith printed and published. Hen: Scobell Cleric. Parliamenti. London: Printed by Edward Husband and John Field Printers to the Parliament of England 1649. Small folio 10 x 6 6/8 inches 8-pages printed on 7: 2 353-357 1. Woodcut arms of the Commonwealth of England on the cover/title 10-line woodcut initial. Self-wrappers removed from a sammelband. The Treasons Act of 1649 was passed on the 17th July 1649 by the so-called Rump Parliament during the Commonwealth of England. It superseded the Act declaring what offences shall be adjudged Treason passed about two months earlier on the 14th of May 1649. The Rump Parliament was part of the Long Parliament in Britain that continued to sit after the forced exclusion of Presbyterian members in 1648. It voted for the trial that resulted in the execution of Charles I. With the execution of Charles I at the end of January in 1649 new Treason Acts were necessary to replace those that had previously addressed offences against the King with those that addressed threats that faced the Commonwealth. As with all acts and ordinances passed by Parliament during the Civil War and the Interregnum which did not have Royal Assent this Act was made null and void following the Restoration of the monarchy in 1660. This particular Act makes it a treasonable offence to: - say in writing or verbally that "the Commonwealth government is tyrannical usurped or unlawful or that the commons in parliament assembled are not the supreme authority of this nation" - "plot contrive or endeavour to stir up or raise force against the present government or for the subversion or alteration of the same" - attempt or incite the subversion of the government or insurrection against the government - counterfeit the Commonwealth version of the great seal of England or to counterfeit or clip coins or import counterfeit coins whether they were Commonwealth coins or foreign coins current within England. For anyone who was not a member of the New Model Army it was treasonable to: - plot or incite a mutiny - "withdraw any soldiers or officers from their obedience to their superior officers or from the present government" - "procure invite aid or assist any foreigners or strangers to invade England or Ireland" or to "adhere to" the enemies of the Commonwealth parliament or government. The penalty for treason under the Act was death and forfeiture of lands and goods "as in case of high treason hath been used by the laws and statutes of this land." ESTC R492187. Catalogued by Kate Hunter. London: Edward Husband and John Field, 1649. unknown

Treason. Despard Edward Marcus defendant.
The Trial of Colonel Despard and his Associates for High Treason and a Conspiracy &c. &c. . . . to which is added an Account of their Execution. Published from the London Morning Chronicle.
New-York: Printed by George F. Hopkins at Washington's-Head 1803. First edition. Traces of the old calf spine. Somewhat soiled stained and a bit foxed; a very good copy. Removed pamphlet 8.25 x 5 inches 56 pages. The Anglo-Irish soldier-turned-revolutionary Despard had been the colonial administrator of the British Honduras from 1786 until 1790 when he returned to Britain with his African-Caribbean wife Catherine; once home "In pursuit of compensation he grew increasingly irascible while the combination of enforced idleness and grievance against authority led him to both the London Corresponding Society and the overtly revolutionary United Irishmen. . . . He quickly became an intimate of the leading United Irishman and French secret agent William Duckett and in 1797 was reported to be co-ordinator of a proposed rising in London planned to coincide with one in Ireland and a French landing there. In 1798 Despard was pivotal in negotiations between the United Irishmen and a broader conspiratorial group the United Britons to foment simultaneous English and Irish risings to assist a French invasion. When O'Connor and O'Coighley the principal leaders of the conspiracy were apprehended in February while hiring a boat to take them to France habeas corpus was suspended and further arrests followed. Despard's was predictably among them" OUDNB. Despard was eventually released but taken up again on suspicion of plotting a coup in conjunction with the opening of Parliament and executed. This extensive account of Despard's trial does not appear to be taken from Gurney's separately-published London edition; whether there was a separate London edition in addition to the Morning Chronicle account is not entirely clear. American Imprints 4076; Cohen 14127. Printed by George F. Hopkins, at Washington's-Head, unknown
