br. La condanna non è più unanime. Dopo l'11 settembre i nuovi apologeti della tortura hanno trovato nella "guerra al terrore" il motivo per giustificare una pratica mai dismessa che, negli ultimi anni, sembra dilagare ovunque, nelle democrazie non meno che nei regimi dittatoriali. Ma il "no" opposto dall'indignazione non basta più a difendere la dignità umana offesa. In pagine intense, scritte con il suo stile chiaro e incisivo, Di Cesare offre un quadro critico complessivo della tortura. Ne indica il nesso stretto con il potere, ne mostra la presenza anche nella democrazia. Come lottare contro la tortura, se a delinquere è lo Stato? Filosofi, scrittori, drammaturghi, registi, poeti vengono interpellati per delineare un'inedita "fenomenologia della tortura" che mira a cogliere la peculiarità di una violenza estrema, sistematica e metodica, dove il carnefice calcola e misura il dolore per scongiurare che la vittima muoia e per esercitare ancora il suo potere sovrano. La tortura è, per la vittima, la propria morte esperita in vita. Da Guantánamo ad Abu Ghraib, dal G8 di Genova agli anni di piombo, da Giulio Regeni a tutti quei casi che hanno recentemente allarmato l'opinione pubblica, la tortura viene esercitata in modo sempre più sofisticato per poter essere negata; incombe ovunque un inerme si trovi nelle mani del più forte: nelle carceri, nei reparti psichiatrici, nei campi per gli stranieri, negli ospizi, nei centri per disabili, negli istituti per minori. E l'assenza di un reato la favorisce.

Iniziali xilografiche. Firme di possesso biffate al titolo. Mezza pergamena con titolo manoscritto al dorso. Il lavoro del rilegatore ha tagliato qualche nota manoscritta al margine. Bell'esemplare, in ottime condizioni, di questo importante trattato giuridico. “Opera fondamentale di Egidio Bossi, giurista milanese (1488 - 1546), punto di riferimento obbligato per ogni approccio alla dottrina giuridica milanese, sono i Tractatus varii editi a Venezia nel 1562. Sono più di cento titoli che, illustrando con l'ausilio di pareri illustri e di indubbie decisioni giudiziali le maggiori cause di controversia in tema di diritto penale, compendiano la migliore dottrina criminale del tempo.... Cinque dei suoi tractatus si riferiscono direttamente alla tortura: De iudiciis et considerationibus ante torturam; De tortura; De confessis per torturam ac effectu torturae; De tortura testium; De tortura accusatoris. Nel De tortura accusatoris affronta un tema abitualmente sorvolato dagli altri giuristi, circa la consuetudine di sottoporre a tortura l'accusatore; egli al contrario, per ragioni di completezza ("ut nihil pro viribus meis omittatur"), gli dedica un titolo apposito. Nel De iudiciis et considerationibus ante torturam tratta della applicazione della tortura a consiglieri, priori, podestà e funzionari politici in genere, considerati immuni dalla dottrina comune” (DBI, vol 13). L'opera è in un volume ed è completa. In buone condizioni. Copertina in piena pergamena coeva con titolo in oro al dorso in buone condizioni generali con lievi usure ai margini e dorso. Legatura in buone condizioni. All'interno le pagine si presentano in buone condizioni con fioriture. First edition of 1781 of this scarce volume about military trials written by Francesco Fraveth. Insdie: military managers, War Council, Military trial (notions, acts, practices), how to find proofs and reasons of murder, Testimonies, way to discover criminal, Torture, military lawyer, Punishment, condamnation. Interesting final part with description of tortures, punishments and death condamnations: decrees (trials, punishments, tortures) different kind of death ecc... The work is in one volume and it is complete. In good conditions. Full parchment coeval cover with golden title in the spine in good general conditions slightly worn in the edges and spine. Binding in good conditions. Inside pages are in good conditions with foxings.

Con 25 tavole incise in xilografia, tratte da quelle realizzate da Antonio Tempesta in rame nell'ediz. del 1591 raffiguranti torture e martirii; le incisioni dovrebbero essere opera di Leonardo Norsini e di sua moglie Isabella Parasole. Bella imagine xilografica al frontespizio raffigurante Madonna con Bambino. Prima traduzione latina dell'opera apparsa nel 1591 "Trattato degli istrumenti di martirio e delle varie maniere di martoriare usati da' Gentili contro i Cristiani", ma con ulteriori aggiunte.
