Il contraddittorio nel processo tributario
br. Questo lavoro affronta lo studio del principio del contraddittorio processuale quale indefettibile componente di un giusto processo tributario. Questo principio, poco approfondito nell'ambito processuale, ha da alcuni anni recuperato attenzione più che altro nella sua applicazione al procedimento amministrativo-tributario, anche grazie alla giurisprudenza della Corte di Giustizia dell'Unione Europea. La ricerca condotta delinea le non irrilevanti differenze strutturali tra il contraddittorio vero e proprio della fase processuale e quello c.d. endoprocedimentale, evidenziando la funzione e le criticità che caratterizzano o dovrebbero caratterizzare quest'ultimo. Muovendo dall'analisi della due process of law clause - dalle sue origini negli ordinamenti inglese e statunitense - per giungere a una comparazione con la sua trasposizione nell'art. 111 della Costituzione, si è cercato di comprendere se il contraddittorio previsto dall'art. 111, comma 2, della Costituzione sia applicabile a tutti i processi, incluso quello tributario, e se, in caso affermativo, il processo tributario sia conforme a tale disposizione. In particolare, si è analizzato se i limiti probatori, in primis il divieto di prova testimoniale, siano compatibili con le garanzie di un giusto processo tributario e con l'attuazione di un contraddittorio pieno ed effettivo e, in caso negativo, quali potrebbero essere le soluzioni e gli interventi legislativi necessari.

Il divieto di contestazione a catena
br. Con la presente pubblicazione, il cui tema rappresenta uno dei più interessanti e complessi del processo penale, s'intende ripercorrere la nascita e l'esegesi dell'art 297, comma 3 c.p.p., andando a illustrare, attraverso l'analisi degli orientamenti giurisprudenziali, la portata applicativa della disposizione in parola. Il c.d. "divieto di contestazione a catena", regola la cui concreta estensione è stata prevalentemente modellata a seguito di numerosi interventi giurisprudenziali, rappresenta, infatti, una delle frontiere più mobili del diritto processuale penale, in quanto terreno di incontro e sintesi dei valori capisaldi della normativa di settore e delle principali tutele di libertà riconosciute all'imputato.
