In 8, pp. 42 + (2b). Lieve alone violaceo al marg. int. delle cc. Br. ed. dec. Saggio storico relativo all'evoluzione del sistema carcerario nei secoli. L'A. sottolinea in apertura come sin dai tempi antichi la punizione oscillasse tra 'l'estrema dolcezza' e 'l'estrema crudelta'': questi 'due principii furono la liberta' politica, da cui sorse la dignita', e la prerogativa del cittadino; la schiavitu' politica, e la domestica, da cui venne il disprezzo d'ogni dritto d'umanita''. Nella storia delle civilta' antiche, quindi, o la prigionia era del tutto bandita o era portata all'estremo grado di esasperazione. Durante il Medioevo, le punizioni si fanno crudelissime: 'dileguato ogni carattere di legalita', l'imprigionamento accompagnato da tutte le sue crudelta' fu in pratica per tutta Europa, e divenne l'istrumento delle passioni brutali'. Fu a partire dalla seconda meta' del Settecento che cominciarono a diffondersi nuove teorie sulla prigionia. Nicolai sottolinea in particolare le teorie riformatrici di John Howard e di Bentham, e le riforme dei vari sistemi carcerari europei. L'A. si sofferma poi sulla situazione nel Granducato di Toscana elencando i principali penitenziari esistenti.
