First and only edition of detailed account of the Lotus case an international legal case involving France and Turkey in front of the Permanent Court of International Justice compiled by Spanish judge Altavira y Crevea and translated by Turkish Distinguished Professor of International Law Menemenlizâde Edhem 1878-1965. The case is known for establishing the so-called "Lotus principle" in international law says that sovereign states may act in any way they wish so long as they do not contravene an explicit prohibition. The Bozkurt-Lotus case decided by the Permanent Court of International Justice PCIJ in 1927 became a landmark in international law especially regarding issues of jurisdiction and the extent of a state's rights to assert criminal jurisdiction over foreign nationals. The case arose from the collision between the S.S. Lotus a French vessel and the S.S. Bozkurt a Turkish ship near the Greek island of Mytilene on 2 August 1926. After the collision eight Turkish nationals aboard the Bozkurt drowned. In response Turkey arrested and charged the captain of the Lotus Captain Demons for causing the deaths and damages to the Turkish vessel. The Turkish courts condemned him asserting their right to try him for the incident even though the collision occurred in international waters and involved a French ship. France contested the jurisdiction of Turkish courts over the captain arguing that Turkey could not claim the right to prosecute a foreign national for actions committed on a foreign vessel in international waters. France brought the case before the PCIJ to challenge Turkey's legal authority. The court ruled in favour of Turkey emphasizing that under international law there was no general prohibition against a state asserting jurisdiction over crimes involving foreign nationals even when the incident occurred outside its territorial waters. The PCIJ's decision established the principle that absent an explicit prohibition in international law states are free to exercise jurisdiction in cases where they have a legitimate interest even if the matter involves foreign nationals and occurred in international waters. This judgment reinforced the notion of state sovereignty in determining jurisdiction and highlighted the extent to which international law permits states to assert legal authority over incidents involving foreign nationals under certain conditions. However it also raised important questions about extraterritorial jurisdiction and the balance between state sovereignty and international cooperation in legal matters. "The Lotus principle or Lotus approach usually considered a foundation of international law says that sovereign states may act in any way they wish so long as they do not contravene an explicit prohibition. The application of this principle - an outgrowth of the Lotus case - to future incidents raising the issue of jurisdiction over people on the high seas was changed by article 11 of the Convention on the High Seas. The convention held in Geneva in 1958 laid emphasis on the fact that only the flag state or the state of which the alleged offender was a national had jurisdiction over sailors regarding incidents occurring on the high seas." Sammelband of 3 volumes 8vos each 108pp. From the library of Alfred Pearce better known as Zadkiel with a few marginal annotations in his hand as well as a leaf of his notes on King Otho tipped in at his natal chart. Plates illustrations advertisements. Hand colored folding plates "Hieroglyphic for the eventful year" at front of each year as issued. 1/2 black leather marbled paper boards spine lettered in gilt. Boards worn along edges some staining to fore edge of page block clean and sound internally and very good. <br /> <br /> Remarkable association copy of this sammelband of three years of Raphael's Prophetic Messenger which was edited by a "Mr. Medhurst" i.e. Raphael No. III. The first Raphael English astrologer Robert Cross Smith 1795-1832 began publication of the almanac in 1826 and it was kept up through editorship after his death by John Palmer Raphael II then Medhurst "Mr. Wakely" IV "Mr. Sparkes" V and Robert Thomas Cross VI.  <br /> <br /> <br /> Gardner in his Catalogue raisonné of works on the occult sciences provides a very long description for this important and long-running almanac and specifically comments on the elaborate and striking frontispieces and the resulting cost of the publication:<br /> <br /> "the folding coloured hieroglyphical plates are masterpieces of mystical work and must have proved a great attraction the price however of 2s 9d was a stiff one for an almanac in those days."<br /> <br /> One of the rival publications of Raphael's Prophetic Messenger was Zadkiel's Almanac which originally appeared in 1831 as The Herald of Astrology.  Zadkiel or Richard James Morrison 1795-1874 was a contemporary of Smith's although Morrison outlived him by 40 years. As is evident in this volume Morrison was influenced by Smith having begun studying astrology in 1929 after serving in the Royal Navy and 3 years after the first Prophetic Messenger was issued. Both Morrison and Smith's writings and in particular their almanacs played an important role in the revival of astrology in 19th century England after it had waned in popularity at the end of the previous century.  <br /> <br /> Gardner 984. Mezzotint 573 x 380 mm. plate size; a clear fine impression beautifully mounted in an attractive pedestal frame of Hawaiian Koa. <p><p>Splendid mezzotint portrait of Joseph Banks after the famous original by Benjamin West.</p> <p>In December 1771 only four months after his triumphant return to England from Cook's Endeavour voyage Joseph Banks sat for a full-length portrait by the American history painter Benjamin West P.R.A. 1738-1820. Painted when he was twenty-nine years of age it was the first "authentic" portrait of Banks and remains one of the best of all subsequent likenesses of him. Appropriately West depicted him draped in a native cloak and surrounded by all manner of Polynesian artefacts which Banks had collected during the voyage including clubs a paddle and a feather-handled basket.</p> <p>Often overlooked among all the riches is an enormous folio botanical book open on the floor beside him a very rare pictorial representation of the project which was dearest to Banks's heart.</p> <p>The whereabouts of the original West oil was for a long time a mystery but it was rediscovered several decades ago and now hangs in the Usher Gallery in Lincolnshire.</p> <p>John Raphael Smith a young engraver created this mezzotint from West's original painting; Banks himself regarded it as one of only three satisfactory likenesses of him to be printed.</p> <p>This is a particularly fine and rich impression of the Molteno/Colnaghi issue of the image published in 1788 with the caption revised to read "Sir Joseph Banks Bt." Banks was knighted in 1781. Previously issued by Hooper and Smith in 1773 both versions of this portrait are extremely rare with this much the rarer of the two: in fact we have not been able to find any record of this issue offered for sale in many decades. It dates from the earliest years of the publishers' careers and it is possible that they located copies of the first issue and updated them with a new caption and imprint.</p> <p>This rare version of the print unknown to Nan Kivell and Spence was recorded by Beddie only from the copy in the Dixson Library.</p> </p> . Illustrators are A. de Putter Hub. Quellinus and J. Vennekool. They based their illustrations on designs by the sculptor Artus Quellinus but plate 69 and 70 are after 'R.V.H.'. This is a good and complete copy besides the modern covers with the French text part. In the Dutch part the signature mark D was corrected by pasting over with a C. After 15 pages of Dutch text follow 22 pages in French with a seperate title page in French. This French part has a seperate signature marking: A-E2 F1. Chalchuapa El Salvador 1876. Still very good. 3pp. on a bifolium. Folio. Crinkling and minor wear at edges. Faint dampstain to upper right corner. The president of Guatemala Justo Rufino Barrios invaded El Salvador in 1876 following the presidential election there. Barrios suspected that both the elected and former presidents had been harboring Guatemalan opponents to his regime and hope to install someone more favorable. The present "political plan" for El Salvador reads more as an indictment of the two leaders Santiago Gonzalez and Andres del Valle than an as organizing document for a new government. The first signer here is Rafael Zaldivar the choice of Barrios for next president of El Salvador and the work was printed in the field at Chalchuapa on April 10 1876 approximately one week before the decisive battles that forced the capitulation of the Salvadoran government.
