Michigan senator Jacob Merritt Howard 1805-1871 who had worked closely with Lincoln in drafting and passing the Thirteenth Amendment was a strong supporter of his measures including "emergency actions during the secession crisis and advocated 'severe exemplary and speedy punishment of the rebels. He was especially vocal on all matters pertaining to the confiscation of rebel property and the emancipation of slaves. He was also one of the most forceful advocates of the 1863 Conscription Act" ANBO. His ire extended to trying for treason the Confederate leaders. In December he wanted to know why Davis had not been put on trial and now despite it being well-known that Davis did not have complicity in Lincoln's murder he declared in this resolution that Davis be "charged with the crimes of having incited the assassination of Abraham Lincoln President of the United States and with the murder of soldiers of the Unites States held a prisoners of war during the rebellion and other cruel and barbarous practices in violation of the rules and usages of civilized war." Clement C. Clay was also to be tried. It appears that Merritt's resolution never made it to the floor for a second reading as was required by law. Scarce. We could find only one in auction or dealer sales records in 1964. Jacob Merritt Howard July 10 1805 – April 2 1871 was a U.S. Representative and U.S. Senator from the state of Michigan during and after the American Civil War. He was born in Shaftsbury Vermont and attended the district schools and the academies of Bennington and Brattleboro. He graduated from Williams College in Massachusetts in 1830 and then studied law. He moved to Detroit Michigan in 1832 and was admitted to the bar in 1833 and commenced practice in Detroit. He was city attorney of Detroit in 1834 and a member of the Michigan State House of Representatives in 1838. He was elected as a Whig to the United States House of Representatives for the Twenty-seventh Congress serving March 4 1841–March 3 1843. He was not a candidate for renomination in 1842. He helped draw up the platform of the first Republican Party convention held in Jackson Michigan in 1854. He was Michigan Attorney General from 1855-1861. Howard was elected as a Republican to the United States Senate in 1861 to fill the vacancy caused by the death of Kinsley S. Bingham. He was reelected in 1865 and in total served from January 1862 to March 1871. He was chairman of the Committee on Pacific Railroads in the Thirty-eighth through Forty-first Congresses. As a Senator Howard is credited with working closely with Abraham Lincoln in drafting and passing the Thirteenth Amendment to the United States Constitution which abolished slavery. During Reconstruction Howard participated in debate over the first clause of the Fourteenth Amendment to the United States Constitution arguing for including the phrase and subject to the jurisdiction thereof specifically because he wanted to make clear that the simple accident of birth in the United States was not sufficient to justify citizenship. Howard said: The 14th amendment will not of course include persons born in the United States who are foreigners aliens who belong to the families of ambassadors or foreign ministers accredited to the government of the United States but will include every other class of person. Howard died in Detroit and is interred in Elmwood Cemetery. paperback

Washington DC: Towers Printer 1865. Pamphlet. Good. Pamphlet. 15 pp. A speech considering the readmission of Louisiana to the Union philosophically pondering the implications of the Civil War and the Southern or Rebel States and their leaving the United States or Union. It appears Howard favored treating Southern states as foreign countries and not allowing them the rights of former states. Jacob M. Howard helped Abraham Lincoln and other drafting and passing the 13th Amendment which abolished slavery as well as working on the 14th amendment. GOOD condition. Heavy tattering chipping and creasing along the extremities. Minor toning and soiling. Pencil note on the upper front cover suggesting the item was a gift from Henry W. Longfellow of Cambridge although no provenance for this is available. Several pages unopened along the top edge. Outer pages almost completely separated along the spine. Towers, Printer unknown

Washington D.C.: n.p. 1866. First edition. A very good copy with inch marginal closed tear light soiling faint marginal stain. Broadside. 6 x 9 1/2 inches. Michigan senator Jacob Merritt Howard 1805-1871 who had worked closely with Lincoln in drafting and passing the Thirteenth Amendment was a strong supporter of his measures including "emergency actions during the secession crisis and advocated 'severe exemplary and speedy punishment of the rebels. He was especially vocal on all matters pertaining to the confiscation of rebel property and the emancipation of slaves. He was also one of the most forceful advocates of the 1863 Conscription Act" ANBO. His ire extended to trying for treason the Confederate leaders. In December he wanted to know why Davis had not been put on trial and now despite it being well-known that Davis did not have complicity in Lincoln's murder he declared in this resolution that Davis be "charged with the crimes of having incited the assassination of Abraham Lincoln President of the United States and with the murder of soldiers of the Unites States held a prisoners of war during the rebellion and other cruel and barbarous practices in violation of the rules and usages of civilized war." Clement C. Clay was also to be tried. It appears that Merritt's resolution never made it to the floor for a second reading as was required by law. Scarce. We could find only one in auction or dealer sales records in 1964.
