Thorton and Son, Paris, Oxford, 1953, 129 pp. Bel exemplaire en bel état, provenant de la propre bibliothèque de l'auteur, le professeur Georges-H. Bousquet (1900-1978). Celui-ci était juriste de formation (Docteur en droit en 1923 avec une thèse sur "L'évolution sociale en Hollande 1914-1922"), mais est surtout connu comme économiste proche de Pareto et Schumpeter, ainsi que comme un islamisant de l'école de Goldziher et Snouck-Hugronje. En matière d'Islamologie, Georges-H. Bousquet résumait ainsi ses travaux (dans les mélanges qui lui furent consacrés dans les Cahiers Pareto en 1965) : "Très en gros, on pourrait dire à ce sujet que je suis parti intellectuellement de la Loi rituelle, morale et juridique de l'Islâm (fiqh) et ai essayé de voir dans quelle mesure cette étrange casuistique (dont j'ai traduit de nombreux textes et dont j'ai exposé les règles dans divers ouvrages) est appliquée, ou non, dans les sociétés musulmanes d'Afrique du Nord surtout (mais également en Indonésie). La caratteristica più evidente dello spazio pubblico interculturale è quello di offrire ai soggetti che compongono la complessità la chance di integrare, senza demolire, il contesto di riferimento. La cifra politica di questo nuovo modo di intendere la convivenza civile parte dal presupposto che la persona umana rappresenta la "posta in gioco" più preziosa da preservare e che le comunità, i gruppi, le organizzazioni, hanno il compito di supportare questa risorsa senza pretendere di egemonizzare il rapporto con i poteri pubblici. Sulla base di questo presupposto, chiunque può ritrovare le ragioni per non considerarsi "estraneo" ovunque risieda, valorizzando il proprio bagaglio culturale all'interno di una dimensione inclusiva e non respingente. Compito del diritto interculturale sarà quello di "tradurre" le dinamiche del confronto in regole progressivamente accessibili, facili da declinare perché flessibili, senza imporre modelli rigidi frutto di una visione della società fortemente condizionata da canoni monoculturali. L'islam rappresenta una buona cartina di tornasole per verificare come la democrazia costituzionale si predispone a guidare i grandi cambiamenti in corso. E l'Europa, quella dei diritti e delle libertà fondamentali, attraverso i suoi documenti e l'azione dei suoi tribunali, si presenta come lo spazio politico-istituzionale e ordinamentale più importante per analizzare fino a dove e attraverso quali soluzioni è possibile spingersi per dare risposte ai problemi della post-modernità.
