‎A RARE COLLECTION OF 32 ORIGINAL COLONIAL GOVERNMENT PAPERS‎

‎Tasmania: James Barnard 1856 - 1895 An important and revealing series of documents recording some of the earliest decisions taken by the young Tasmanian colony as it emerged from its first era as a penal colony dependant on a distant Imperial Government to a more independent settlement in the post transportation era. All the papers are issued by the newly formed House of Assembly which was first established in 1856 under legislation passed by the British Parliament creating the independent Colony of Tasmania. The Legislative Council had already existed since 1852. The first elections for the House of Assembly were held in October 1856. The first papers show the growing frustration of the Colonial settlement with the distant Imperial Government as it fights for financial compensation and support for the vast numbers of Imperial Convicts still within its penal establishments even though transportation had officially ceased in 1853. The later papers show the Colony coming to grips with its responsibilities to the people it now recognizes as its own with the founding of such institutions as the Boys' Home Industrial School in 1867. Finally with the last paper the series comes full circle with a reflective account of the Colony's first settlement. The earliest papers stem from the Convict Department which was part of the Imperial as distinct from Colonial establishment and was directly responsible to the Governor. By 1871 the number of Imperial convict or ex-convicts in lunatic asylums was so few that they were transferred to colonial custody though their costs continued to be met out of Imperial funds. The Colonial Government was always looking for ways to increase its independent income and one of the papers concerns the issuing of Bounty Tickets which could be purchased in the Colony and sent to friends and relatives of the settlers back in Europe to assist with emigration. Interestingly many of the documents list the names of the convicts held what ship they arrived on what they ate what work they accomplished how often and how many became sick and died. One or two papers examine the lives of a few named individuals who have emerged from the mass to come to the attention of the Government particularly: the capture and trial of Daniel Stewart alias Wingy William Ferns alias Flowers Peter Haly and William Thornton; the granting of a free pardon to William Robinson. Although transportation to the Eastern colonies of Australia officially ceased to Tasmania in 1853 the colony was still being affected by the arrival of transported convicts in Western Australia who often escaped to or were released to the eastern colonies after arrival. Western Australia "that Colony situated at a great distance from all others" Earl of Newcastle received its last convicts in 1868 but it was not until 1872 that the Earl of Kimberley announced that the Imperial Government was determined to insert in future Pardons granted to Convicts in Western Australia a condition that "the Convict shall not go to any Australasian Colony and that a breach of this condition will entail a forfeiture of the Pardon". Government paper number 32 recording the official investigation into "Whether Convicts under Colonial sentence have been employed 'without authority' by the Comptroller-General Lieutenant-Colonel Hamilton Mr. Boyd Mr. May or by other Officers of the Convict Department 'for their own benefit in the construction of private houses' or for any other purpose; and to ascertain the number of men so employed 'without authority' - the period of their being so employed - and at what rate of wages". The enquiry also seeks to discover any other "abuses in the Convict Department which may appear to affect the Colonial interest" namely whether materials and vessels belonging to the Colonial Government have been used for private purposes. Colonial Convicts are distinct from Imperial ones in that they are serving sentences for crimes charged to them in Australia rather than back in Britain and their expenses are met by the Colony rather than the crown. These include the withholding of its "fair contribution towards the maintenance of Police and Gaols and the Administration of Justice in the Colony"; the "gradual reduction and the eventual discontinuance of the Imperial contribution towards the maintenance of Police Gaol and Judicial Establishments" since the discontinuance of Transportation on the 22nd February 1853; the introduction "to this Colony of upwards of 700 desperate Criminals from Norfolk Island after the cessation of Transportation to it from the United Kingdom operated as a breach of the Royal promise and has entailed vast expense and great social evils on this community"; a similar influx of "irreclaimable criminals from the penal establishment of Port Arthur". This very long list of tasks includes all of those expected relating to farming building and maintaining the Colony's infrastructure but also one or two unexpected such as "Bookbinders: Repairing Library Books Account Books making Envelopes &c" which employed 434 convicts. Itemizing the costs of the capture and trial of Daniel Stewart alias Wingy William Ferns alias Flowers Peter Haly and William Thornton shot dead at the time of capture which amounted to 1620 pounds 19 shillings and 3 pence. The Parliamentary session of 1858 became known as the 'Hanging Session' because after it three bushrangers were executed. "Earlier in mid-October 1858 Parliament had passed an 'Offences Against the Person Act'. But it was flawed because it did not perpetuate sentences for crimes under the old law. Therefore three bushrangers Daniel Stewart alias 'Wingy' and Peter Haley alias 'Black Peter' and William Fern alias 'Flowers' were truly in limbo� In 'Tasmanian Gallows' Richard Davis describes these bushrangers as 'Norfolk Island graduates' who had committed mostly minor offences after their escape from detention. He also places them in the 'chivalrous school of Martin Cash' because of their lenient policy towards females. And in their support 160 citizens signed a petition to save them because they claimed to have only shot at a constable's horse and not at the rider hurting neither� When new urgent legislation finally passed the Legislative Council it had sat for only three hours and thirty-seven minutes and the House of Assembly four hours and five minutes. The next day after formally reconvening at 2pm the Governor simply prorogued the 'hanging session' after just a few minutes by saying: "Thanking you Gentlemen for your attendance I now prorogue this Parliament to 1st June next'. With the legal loophole closed on February 13 1859 'Wingy' 'Black Peter' and "Flowers' were hanged - 'launched into eternity' - along with two others: John King who had shot his de facto wife and William Davis an axe murderer. Before this public executions in Tasmanian had ceased in 1855 after the scaffold had been relocated at a cost of 157 pounds. But with five held on one day the 'Hobart Town Courier 'called these executions ' the most exciting event of the week'! The 'Courier' was also unimpressed with 'Wingy's final 'reckless demeanour' refusing to shake hands with the officiating priest insisting 'this is worse than a savage Government to hang men for doing nothing at all'. Whilst not as pithy as Ned Kelly's 'Such if life' the Courier retaliated saying 'the law of the land is too strong to permit outrages with impunity in the wildest fastnesses of our island. sooner or later justice will overtake the evil-doer'" Parliament of Tasmania online. In the meantime a response was obtained from Sir Edward Bulwer-Lytton which the local government found unacceptable: "The inequitable operation of these rules in transferring the charge of the maintenance of incorrigible British Criminals from Imperial to Colonial Funds will be manifest from an inspection of the Return to which we have referred. It will be seen that of 337 Convicts borne upon Colonial Funds during the year ending April 1859 305 had been British Convicts 8 could not be traced and only 24 or one-fourteenth of the whole number had always previously been free� These facts speak for themselves and scarcely require comment. They demonstrate that the existing system operates merely as a process by which the burden of maintaining irreclaimable British Felons is gradually but surely shifted from British to Colonial Funds" Police Cases. - 1859. Government paper 89. The report roundly condemns the existing building as "very defective and entirely unsuited to the purposes of a Gaol. It does not afford sufficient space either in the day rooms or dormitories for more than half the number of Prisoners frequently confined within its walls. It admits of no classification whatever so that the most hardened criminals men even under sentence of death when not locked up in their cells and persons only committed for examination or trial are frequently found commingling with each other". A report of the Select Committee to enquire into the system under which Convicts were discharged from Port Arthur with the Indulgence of a Ticket-of-Leave and calling for complete reform of the system. Tickets-of-Leave were granted to those nearing the end of their sentence and based entirely on good conduct during that sentence which in this context means: "only an absence of grave crimes. The frequent commission of minor offences does not to any considerable extent retard the claim to indulgence". "The previous career of the criminal the nature of his crimes the number of preious convictions are not taken into account when his claim is considered". On their release the convicts were encouraged to find work and offered a bed until they do so at the Barracks. However very few convicts took up this offer preferring to find somewhere to live in the City or further afield: "the outrages committed by Ticket-of-Leave men in the country districts are matters of painful notoriety; and it is to be feared that many atrocious crimes never see the light and are followed by no punishment� the class to which they belong their general inferiority as labourers and the growing dread of the frightful practices to which it is well known many of them are addicted render their search for employment often tedious and difficult. The position in which many of them thus find themselves placed cannot fail to create in their minds a sense of hardship. It becomes a temptation and is no doubt often used as a justification for entering upon a fresh career of crime" page 5. Police. The total amounted to 69 of which 30 were single tickets for women who were classed as relatives rather than servants. Those wishing to assist friends and relatives in their emigration to Tasmania bought "Bounty Tickets" from designated agents in the Colony. In 1868 the sale of payments was: a family ticket including a man and his wife with all their children under 12 years of age at the time of embarkation - �15; a single female - �5; a single male - �10; children of 12 years of age or upwards at embarkation are to be considered as adults and must each have a separate single ticket. "No ticket will be issued for the introduction of any "single" person above the age of 60 years at the time of sailing of the vessel from the United Kingdom unless upon payment of 16/. and documentary evidence of the age of any immigrant must be produced when required to the satisfaction of the Immigration Agent upon the immigrant's arrival in the Colony otherwise the person introducing such immigrant will be liable for the whole of the passage money. In the case of families if the parents or either of them arc over the age of 60 years at the time of sailing the deposit to be made by the person procuring the ticket will be 20/. The "engagement " set out in the Bounty Ticket must be signed by the emigrant for himself and family agreeing not to leave Tasmania within four years after arrival without having previously paid to the Immigration Agent at Hobart Town or Launceston one-fourth of the whole cost of the passage money for every year wanting to complete four years residence in the Colony and a proportionate sum for every part of a year. The recommendation was to employ the convicts in felling and preparing timber for use in ship-building and as railway sleepers; the men would also be employed in building the ships as Mr. Watson reports: "that when at Port Arthur he had under him several men classed as 'desparate' offenders' - that with few exceptions he found them most willing to learn a trade which some of them are now following in this and neighbouring Colonies certain of them having become Master Ship-builders; he also states that many of the Boys turned out very well and after becoming free followed their business as Shipwrights" page 4. The conference was concerned with finding ways to abolish the Imperial transportation of convicts to Australasia not out of concern for the effects of the system on the convicts themselves but out of concern for the safety of the established settlements. Although transportation to the Eastern colonies of Australia had ceased by the time of this conference these colonies were still being affected by the arrival of transported convicts in Western Australia who often escaped to or were released to the eastern colonies after arrival. So adamant were they that one resolution states: That in the event of the Imperial Government refusing to put an end to Transportation to Western Australia it will be expedient and necessary� to terminate immediately the present mail contract with the Peninsular and Oriental Steam Packet Company unless the Company agree to prevent their mail steamers touching at any port of Western Australia" page 1. The Duke of Newcastle as Secretary of State had ruled in 1854 that only transported convicts who re-offended within twelve months of their release would be considered as being under an Imperial sentence and therefore maintained at the expense of the Imperial Government. In their first Despatch the Colonial Government requests that that period be extended to six years: "There can be no doubt that during the last few years in which Prisoners were transported to this Colony few but the most abandoned characters were sent out. These men are frequently Criminals by profession: reformation on their part is hopeless; and if they are not convicted in a short time after their release from prison it is more often because they are undetected than because they are innocent" Thomas Gore Browne Governor of Tasmania page 1. The dispatch was address to the Governor of New Zealand Sir G. Bowen who had reported "the circumstances under which a party of eight Convicts with Conditional Pardons granted in England had arrived in New Zealand from Western Australia and the measures taken to remove them under the Colonial Law of 1867". The colonies of South Australia Victoria and New Zealand had passed laws excluding the settlement of convicts from other colonies leaving New South Wales Tasmania and Queensland vulnerable. The cost of keeping them per head is 22 pounds 11 shillings and 4 pence per Convict 16 pounds 10 shillings and 1 pence per Pauper 18 pounds 1 shilling and 6 pence per Hospital patient and 23 pounds and 3 shillings per Lunatic. The first four reports concerning the Boys' Home Industrial School including a brief history of the school's founding: "In the year 1867 public attention having been for some time drawn to the increasing number of destitute and neglected children in Hobart Town a Committee of gentlemen was formed to consider by what remedial measures the evil might be checked� Early in May the Hon. Mr. Kennerley moved by a strong desire to five practical shape to the provisions of the ensuing Act purchased a property of 3 acres with a dwelling-house in the western suburbs of Hobart Town�". Initially 20 boys were admitted to the school and after a year "visitors to the Home have again and again recorded the pleasure with which they have noticed its free yet well-ordered discipline as shown in the bright faces good manners and intelligent answers of the boys. They are employed every forenoon in the various occupations belonging to the house and ground - cooking washing wood-cutting milking gardening &c. - and every afternoon except Saturday when they are frequently taken for a ramble over the neighbouring hills in lessons in the school-room" page 3. The second annual report lists 26 boys by their initials and gives a brief account of their backgrounds which are remarkably similar. All were found on the street most of their fathers were dead or unknown and their mothers described as drunkards of very bad character. By the fourth annual report 10 boys had left the home and were employed in service another two had not faired so well. Opened in 1869 by Alfred Kennerley "a prominent Hobart citizen councillor one-time Lord Mayor of Hobart and philanthropist. The school also took in residents from outside Hobart. The Industrial Schools' Act and the Training Schools' Act of Parliament had been amended in 1867 to enable children `found to be begging vagrant in the company of reputed thieves orphaned deserted or declared Uncontrollable' to be admitted into the Boys' or Girls' Industrial Schools or in the cause of offenders the Training Schools or Reformatories as they became known. The Industrial Schools were intended for children 10 years and over. For babies and young children who were either orphaned or unable to be cared for by a parent the Boarded Out System was introduced. Government money was paid to foster parents who were tightly controlled by the Social Welfare Department. Most of these children were eventually sent to Industrial Schools to learn a trade and earn a living. The foster parents were chosen from the working class of society who were deemed needy of the money; in some cases they were related to the children. For families where there wasn't an income and who were deemed worthy of charity the Social Welfare Department would be given what was known as Outdoor Relief. The amount of money given was determined by the number of children in each family under the age of 12. Children over the age of 12 were expected to be apprenticed or in the work force with wages given to their families. In 1969 the old institution was sold and 4 large 6-bedroom cottages were purpose built to house boys and girls in need of long-term care. The inclusion of girls at this stage meant that brothers and sisters could be kept together this brought about a change of name to Kennerley Children's Home" CLAN online. House of Assembly. An extensive annual report for the Campbell Street Gaol which lists all the usual expenses but also the names of the prisoners transferred there from Port Arthur during the year the name of the ship on which they arrived their sentence and details of their onward transfer etc. The Cambell Street gaol was "first occupied for penal uses in 1821 when the prisoners barracks were built. Altered over the years to meet changing administrative demands as well as the needs of prisoners the precinct was in continuous use as a place of detention and correction until its closure in 1963. The law courts continued to be used as Criminal Courts and as the Supreme Court until 1975 and as Magistrates' and Coroners' Courts until 1983. As a place of law enforcement and correction the site had by far the longest continuous occupancy in Tasmania and one of the longest in Australia" National Trust Australia online. House of Assembly. Government paper number 10. Walker's history of the discovery of Norfolk Island in the South Seas its settlement as a penal colony and the subsequences for Tasmania when that colony foundered. It was the notorious Captain Bligh as Governor of New South Wales who ordered the evacuation of the Norfolk Island settlers to Tasmania. He gave them the choice of the Port Dalrymple or Derwent settlements and as compensation: the money compensation not to exceed 1000 pounds and they were to have grants in the proportion of two acres only to one acre of cultivated land surrendered. On the other hand they were to have houses erected of value equal to those given up; were to be victualled for two years at the public cost; those of the better class were to be allowed the labour of four convicts for nine months and of two for fifteen months those of less desert being allowed lesser privileges" page 10. Being 28 Government papers many with letterpress tables preliminaries a little spotted title-page with small hole/erasure near the head. Contemporary purple calf marbled paper boards gilt a little rubbed. An interesting and early collection of Government papers issued by the Legislative council of the Colony of Van Diemen's Land which only changed its name to Tasmania once it had achieved its status as an Independent Colony and a Legislative Assembly in 1856. The Assembly was a long time coming as this volume of papers opens with a Despatch from Earl Grey regarding the provision of a Representative Assembly for Van Diemen's Land a matter which at the time was being debated by the Parliament back home. In March 1848 Tasmania's Governor William Denison suggested that Tasmania ought to have two representative Chambers: 'There is an essentially democratic spirit which actuates the large mass of the community and it is with a view to check that spirit of preventing it coming into operation that I would suggest the formation of an Upper Chamber' At the time this was rejected as an untried form of constitution but in 1854 a select committee of the colonial Legislative Council presented a report and a draft constitution which recommended the creation of a bicameral Parliament Tasmanian Parliamentary Library online. During the same year the Transportation System by which prisoners convicted of crimes in Britain were transported to Van Diemen's Land from 1803 came under review and it was ruled that a period of incarceration in England would precede transportation making management of the convicts upon arrival in Tasmania much easier. There follows a very detailed "Estimate of the Expenditure of the Government of Van Diemen's Land for the Year 1849"; one or two personal petitions; a very detailed list of "Persons Free by Servitude or holding Conditional Pardons at the time of their Conviction in the Colony and now on the Registers of this Department showing their Condition prior to Colonial Conviction; together with the Date of such Conviction and Sentence. Compiled up to 1st June 1848". The list includes names of the convicts the names of the ship they arrived on details of their sentence etc. There is a "General Report upon the Public Day Schools in van Diemen's Land 1848"; a Despatch from Sir John Franklin subsequently the famous Arctic explorer. Later in the year a committee was appointed to consider "a Communication from the Members of the Midland Association representing the evil effects likely to accrue to the Wool-growing and Agricultural Interests from the increasing growth of Thistles all over the Colony.". In 1849 the struggle between the Imperial Government and the Colonial Government over who should pay for what continued unabated. The Colony presents its arguments in the form of petitions protests and detailed accounts. A similar argument but at a more local level was debated concerning whether the Colonial Government or the local district should pay for the making and maintaining of roads. There is also a debate about how much the Colony should contribute to the cost of transporting mail from Singapore to Sydney if the India and Australia Steam Packet Company should win the tender to convey "the Mails between Singapore and Sydney in three vessels of 200 horse-power for 26000 pounds per annum for a period of not less than six years" paper number 188. Importantly the creation of a local government in Van Diemen's Land based on the principles of "Popular Representation" are debated as is a Constitution for the Colony and the creation of a two house system: ". under the peculiar circumstances of these Colonies I should most strenuously recommend the adoption of a Second or Upper Chamber. When we consider the elements of which society here is composed - when we see the low estimate that is placed upon every thing which can distinguish a man from his fellows with the sole exception of wealth - when we see that even wealth does not lead to distinction or open the road to any other ambition than that of excelling in habits of self-indulgence - it can hardly be subject of surprise that so few are found who rise above the general level or that these few owe more to the possession of a certain oratorial facility than to their powers of mind or the justness of the opinions which they advocate. The broad plain of equality as in America receives the whole of the community; and although there are many who would gladly avail themselves of any opportunity of raising themselves above the general level yet here as in America any attempt to do so would be frustrated by the jealousy of the remainder of the community" Lieut-Governor Sir W. The Bill that was was presented to the Imperial Government in May of 1849 is printed in full arguing that the 'ancient possessions' of the Crown 'their prevailed until the commencement of the 19th-century the almost invariable usage of establishing a local legislature consisting of three estates - that is of a Governor appointed by the Sovereign of a Council nominated by the Sovereign and of an Assembly elected by the people'. However this was not the case in the Australian colonies which lacked the third estate. The Bill requested that this third estate be granted to the colonies in New South Wales South Australia a new colony of Victoria and Van Dieman's Land but NOT to that in Western Australia because the people are unable and unwilling to sustain themselves from local revenue. government paper number 144.
