Margulies was a Warsaw-born scholar who later taught at the Jewish Theological Seminary. His major work was a critical edition of Midrash Va-Yikra Rabbah, 5 vols. (195360) , which is considered to be a model of critical editing of a midrashic text. Margaliot [Margulies] also contributed to scholarly publications and was the editor of two popular biographical dictionaries, one on the sages of the Talmud and the geonim. L'intera storia delle istituzioni umane è piena di società discriminatorie, che davano e danno di volta in volta per scontato che gli schiavi, gli stranieri, le donne e ogni altro genere di "diversi" non siano soggetti morali e giuridici nella loro pienezza. Ma se - seguendo Kant - il soggetto morale è libero, e se la libertà non può essere descritta, chi sia il soggetto morale non solo non è ovvio, ma non può mai esserlo. Se il soggetto dell'etica e della politica deve essere pensato come un soggetto libero, una filosofia pratica così impostata non sa e non può "vedere" coloro di cui parla. Ci troviamo di fronte alla questione della "giustizia degli invisibili": è possibile costruire un'etica e una politica che assumano la soggettività morale come un problema e non come un dato di fatto' Svolgendo un argomentato confronto con Kant e con un mondo pluralistico e gerarchico come quello della filosofia greca antica - e in particolare con Platone - l'autrice mostra che possiamo scegliere, per dominare la questione, due itinerari alternativi: a) assumere come data un'immagine e una gerarchia particolare di soggetti morali (come nella metafisica di Aristotele) e trattare etica e politica come qualcosa di valido per loro, e solo per loro: oppure b) assumere come postulato la libertà del soggetto morale, e cercare di costruire le leggi etiche basandoci il meno possibile sulla descrizione delle creature cui siamo abituati a riconoscere dignità etica. Il primo itinerario si rivela un vicolo cieco, appena si mette a confronto con la storia, la quale ci mostra che l'inclusione e l'esclusione dalle comunità morali non sono così ovvie come appaiono al metafisico; il secondo si caratterizza perché tiene aperto un problema - quello dell'"invisibilità" del soggetto morale - che si rifiuta di risolvere.
