Gente a cui si fa notte inanzi sera. La pena di morte nella storia
Da che mondo è mondo, chi detiene il potere si arroga il diritto di mandare a morte coloro che commettono reati di varia gravità. In questo libro abbiamo raccolto trentasette descrizioni di esecuzioni capitali che sono state eseguite tra il VII secolo d.C. e il 1930. Sono in gran parte redatte da persone che hanno assistito personalmente a tali eventi. Crediamo, infatti, che solo chi è stato testimone oculare possa comunicare per intero tutto l'orrore che esse suscitano in chi ha saputo conservare un briciolo di umanità. Alcune di queste le dobbiamo ad autori che sapevano usare la penna con grande maestria: Marin Sanudo; Pietro Verri; William Makepiece Thackeray; Charles Dickens; Mark Twain; Ivan Turgenev; George Orwell. Lo spettacolo della morte, così come quello della sessualità, stimolava emozioni forti e attirava folle enormi che spesso passavano la notte all'addiaccio pur di accaparrarsi i posti più vicini al palco. E bene tuttavia che il lettore non coltivi l'illusione che si tratti di un retaggio dei tempi passati: è molto probabile che proprio in questo momento, da qualche parte del mondo, qualcuno stia salendo i gradini che lo portano al patibolo, talvolta senza nemmeno che un giudice abbia emesso una sentenza contro di lui. Il 1881 fu considerato da Tolstoj l'anno d'inizio della sua autentica rigenerazione interiore, una religiosità ispirata al Discorso della Montagna epurato dal soprannaturale e spesso in contrasto con la chiesa ufficiale. Nel 1881 Alessandro II viene assassinato e Tolstoj scrive al successore, Alessandro III, per esortarlo a essere clemente con gli attentatori del padre. Contro il lusso, il consumismo, l'odio sociale, la guerra, la pena di morte ecc.Parla anche della crudeltà verso gli animali e propone il vegetarianismo. Edizione rara (dichiara di essere la prima assoluta "rimasta finora segreta"!) e ignota a SBN.

"Ho potuto accorgermi e persuadermi, non lusingandomi, o caro, né ingannandomi, ché il lusingarmi e l'ingannarmi pur troppo m'è impossibile, che in me veramente non vi è cagione necessaria di morir presto, e purché m'abbia infinita cura, potrò vivere, bensì trascinando la vita coi denti, e servendomi di me stesso appena per la metà di quello che facciano gli altri uomini, e sempre in pericolo che ogni piccolo accidente e ogni minimo sproposito mi pregiudichi o mi uccida" dice il Leopardi nella lettera al Giordani del 2 Marzo 1818. Il tema della morte in Leopardi è da intendere non come contenuto peculiare ma come elemento strutturale e fondamentale di un intertesto che percorre come un filo rosso tutta l'opera del recanatese in un circuito echi, allusioni, richiami e rimandi che si rispondono e che sembrano il segno di una vera e propria ossessione.

In 8° (18,5x11,5 cm); XLVIII, 196, (2) pp. Legatura coeva in piena pergamena con titolo impresso in oro al dorso. Tagli spruzzati in rosso. Qualche leggera brunitura, ininfluente, come tipico della carta napoletana. Rara riedizione settecentesca del noto trattato del noto giureconsulto ed umanista parigino, Joannes Trochaeus Rogeraius edito per la prima volta a Lione nel 1550. L'opera è dedicata al giureconsulto francese, Jean Papon, 1507–1590 che fu tenente generale di Forez dal 1545 al 1585. L'opera, dal forte afflato umanista, contiene un commento critico al “Marcianus libro secundo de publicis iudicis" ed il "Claudius Saturninus libro singulari de poenis paganorum" testi di diritto romano fortemente legati l'uno all'altro ed inerenti al diritto penale criminale. Il testo vero e proprio del cinquecento, è in questa edizione del 1774, preceduto da un lungo com mento, anonimo, che prende spunto dal dibattito suscitato dalla pubblicazione dei “De' delitti e delle pene” nel 1764. Si legge all'inizio della lunga introduzione, di trenta pagine, anonima, intitolata “Lettera di un anonimo scritta ad un amico personaggio ragguardevole, Su di alcuni punti interessanti della Giurisprudenza Crimimale”: “Amico Carissimo, Vi ringrazio di avermi trasmesso il trattatino del Marchese di Monte-Rosato, a cui si dà il titolo di Riflessioni Politiche intorno all'efficacia e necessità delle pene: come altresì quello del Rischiaramento di alcuni punti importanti intorno alla Criminale Giurisprudenza, dedicato al Signor di Voltaire; e l'altro impresso in Roma di Filippo Maria Renanzi, intitolato Elementa Juris Criminalis; e se mai altro ne uscirà, che si raggiri sugli assunti, che non è stato per altro il prim o il Signor Beccaria di ponere in campo, io ne avrò a voi sempre buon grado, se continuate a mandarmene; e per darvi un segno di gratitudine vi soddisfo nel comando datomi di palesarvi il mio sentimento intorno a quanto fu tal materia si è scritto, e si continu erà forse a scrivere nella nostra Italia non meno, che ne' Paesi oltramontani ancor sul torno del discorso pronunciato nel Parlamento di Grenoble dal Signor Servand, che da voi ancor l'ho ricevuto.
