In the Name of National Security: Unchecked Presidential Power in .
2006. Fisher Louis. In the Name of National Security: Unchecked Presidential Power in the Reynolds Case. Kansas: University Press of Kansas 2006. xiii 282 pp. ISBN: 0700614648. Cloth hardcover in fine dust jacket with Mylar cover. First edition. As new excellent condition. $15. When a B-29 bomber exploded over Georgia in 1948 the victims' families were denied access to crucial information relating to the accident because the federal government claimed such access would endanger national security. When the Supreme Court upheld that claim in United States v. Reynolds 1953 a new precedent was established allowing the executive branch to assert an all-encompassing "state secret privilege" as a basis for withholding information from public scrutiny. For more than fifty years that decision has been viewed with apprehension by a great many scholars and citizens who feel it has fostered a dangerous cult of secrecy and undermined accountability by declaring that only the executive branch can be trusted with sensitive material. Now Louis Fisher America's leading authority on separation of powers recounts the story of Reynolds to reassess its lasting impact on our society. Taking us back to a time when Americans were preoccupied with protecting military secrets from the Red Menace Fisher shows how this case produced fundamental distortions in the judicial process that have increased with each passing year. He critiques the government's arguments in Reynolds from district court to Supreme Court and dissects the landmark opinion authored by Chief Justice Fred Vinson. He also explains how Reynolds affected subsequent battles over executive-held information both within the courts-the Pentagon Papers the Watergate tapes-and between Congress and the president as exemplified by the Freedom of Information Act and the much-debated Foreign Intelligence Surveillance Act. Drawing upon declassified documents and interviews with surviving family members he weaves a compelling story-one that took a new twist when it was finally discovered that the information originally withheld was not sensitive at all but rather revealed Air Force negligence. Especially in light of the Bush administration's continued use of Reynolds to justify its post-9/11 claims to unilateral authority Fisher's work could not be more timely. His book is essential rea. unknown books

FISHER George Bulteel 1764 1834 after; J. W. EDY engraver
Six Views in North America from Original Drawings Made on the Spot by Lieutenant Fisher of the Royal Artillery. Engraved in Aqua Tinta by J. W. Edy
London: J. W. Edy 1795. Broadsheet folio. 29 x 21 inches. Six aquatints printed in sepia. Two with expert repairs to splits at plate mark. Bound to style in half morocco and brown moire cloth covered boards

A very rare complete series of stunningly beautiful aquatint views of North America: "Probably the most beautiful prints of Canada ever published " Spendlove.

Views comprise titled as per titles on the prints: 1 View on the St Anns or Grand River 2 View of St Anthonys Nose on the North River Province of New York 3 View of the River St Lawrence Fall of Montmorenci from the Island of Orleans 4 Fall of Montmorenci 246 perpendicular feet 5 View of the Falls of Chaudière 6 View of Cape Diamond Plains of Abraham and part of the Town of Quebec and River St. Lawrence A beautiful set of aquatints produced by J.W. Edy after the original artwork of George Buteel Fisher. Lieutenant Fisher had already established himself as a respected artist having exhibited at the Royal Academy when he came to Canada as aide-de-camp to the commander-in-chief of the Canadian forces in Nova Scotia Prince Edward later the Duke of Kent father of Queen Victoria. These images of some of Canada's most striking landscapes were executed during the four years of their tour of duty and were dedicated by the artist to his royal patron. John William Edy as talented in aquatint as Fisher was with a brush executed these prints in 1795-96. The series has long been considered among the most beautiful images of early Canada to be published. These prints are renowned for their sweeping dramatic portrayal of the Canadian landscape. In each are found Indians engaged in various activities ships or other devices enabling the artist to add perspective to the romantic landscapes. Of particular note is the view on the St. Ann's about which the noted authority on early Canadian illustration George Spendlove says "this is probably the highest development of the Romance Landscape in the iconography of Canada." Together the six views provide an excellent sense of 18th-century Canada as it would appear to her colonists being at once both harsh and intimidating while still possessing a certain peace that Spendlove credits to "the Divine Almighty Architect." A superb suite of prints.

Spendlove pp. 22-25; Deak 186. J. W. Edy unknown books

Surratt fled to Italy after the assassination but he was identified in 1866 and extradited. Surratt was tried in a civilian court of the District of Columbia instead of a military one as his mother had been. She was convicted as a co-conspirator and was the first woman executed by the Federal government. Surratt's attorney admitted Surratt's part in plotting to kidnap but not murder the president. Surratt was ultimately released after a mistrial. The government attempted to retry him but the statute of limitations thwarted this plan. unknown books

Fisher Elwood
LECTURE ON THE NORTH AND THE SOUTH DELIVERED BEFORE THE YOUNG MEN'S MERCANTILE LIBRARY ASSOCIATION OF CINCINNATI OHIO JANUARY 16 1849
Washington: Towers 1849. 32pp spine reinforced clean text. Very Good. In this piece first printed in Charleston earlier in 1849 Fisher rebuts the conventional wisdom that the South is falling behind the North in population manufactures the arts and trade. "The harbors of Norfolk of Richmond of Charleston and Savannah have been deserted for those of Philadelphia New York and Boston; and New Orleans is the only Southern city that pretends to rival its Northern competitors. The grass is growing in the streets of those cities of the South which originally monopolized our colonial commerce and maintained their ascendancy in the earlier years of the Union. Manufactures and the arts have also gone to take up their abode in the North. Cities have been expanded and multiplied in the same favored region." In fact however in the production of food housing and other indicia of wealth despite southerners' oft-expressed fears of their decline the South is prospering. Slavery and an agricultural way of life have enhanced the South's prospects. By contrast the proliferation of cities in the north brings "inequality of condition great depravity of morals great increase of want and of crime." The Library Company notes five different printings of this pamphlet in Howes F150. Sabin 24458. LCP 3670. Towers unknown books

Fisher 1856-1927 was a prominent historian and lawyer who was admitted to the Pennsylvania bar in 1883 after legal studies at Harvard University. His Evolution of the Constitution collates for the first time all the various provisions of colonial documents that served as source material for the Constitution. Asserting that the Constitution was neither an imitation nor an invention Fisher traces every material clause back to its origin. Twenty-nine colonial charters and constitutions seventeen Revolutionary constitutions and twenty-three plans of union are the resulting source materials from which Fisher draws his analysis. Abundant quotations from the sixty-nine documents illustrate the evolutionary nature of the Constitution and make this a valuable sourcebook for the reader who desires to find in one volume the Constitution's many and varied origins. unknown books

Fisher Hubert F. 1877 1941
PROF. WOODROW WILSON'S LECTURES AT PRINCETON UNIVERSITY THREE MANUSCRIPT NOTEBOOKS ON POLITICS AND CONSTITUTIONAL GOVERNMENT 1900-1901 RECORDED BY H.F. FISHER A STUDENT AND LATER A CONGRESSMAN FROM TENNESSEE
Three manuscript notebooks 8 x 5 in. cloth-backed marbled boards a total of approx. 285pp. in pencil & ink some 22000 words in a legible hand. Fisher's lecture notes during his graduate studies year at Princeton in 1900-01 for three different courses all taught by Woodrow Wilson: "Jurisprudence" "Constitutional Law of the United States" and "Politics." Wilson was chair of the Jurisprudence and Political Economy Dept. at Princeton University from 1890 and became President of the school in 1902. Some scuffing and wear to bindings hand-written paper labels with Wilson's name and the course title laid down on each cover H.F. Fisher's name in each volume. Hubert F. Fisher was a graduate of the University of Mississippi where he played football before enrolling in graduate school at Princeton in 1900. Fisher also played football for Princeton in the 1901 season before moving to the University of Tennessee to coach the Tennessee Volunteers from 1902-03. He studied law and had a practice in Memphis before being elected to the state legislature in 1913 the year Woodrow Wilson was first elected President. Pres. Wilson appointed Fisher the U.S. District Attorney for the western district of Tennessee a post he held from 1914-17 and was then elected to the U.S. Congress as a Democrat serving from 1917-1931. He served on the House Committee on Military Affairs during his tenure. see his brief biography in the Univ. of Tennessee Magazine vol. 16 1902 and in the "Biographical Directory of the U.S. Congress".
A close reading of Woodrow Wilson's lecture notes give both the breadth and limits of his philosophy of law nationalism and politics. For example in the "Politics" class Fisher records Wilson's observations: "What constitutes national character It is noteworthy that a common national character can be imparted to a vast & heterogeneous population drawn like our own from almost all the races of the civilized world provided 1st that differences of language be eliminated & conducting media be provided for thought principle & idea. 2nd a vital common life exists which will unite classes by freeing individuals by keeping economic channels open upon equitable conditions to all and by organizing political action in the common interest upon a true cooperative principle. etc." Yet his notes on "Constitutional Government" include the following: "This is the great problem of today what government is best fitted for the people In our case we have the Phillipine sic Islands and the question is a vital one- the world has the question of a government for China. It is the question of how far our "constitutional" government can be suited to these undeveloped races-races that have been stagnant for centuries."

hardcover books
