I have myself not the least doubt that Savigny Friedrich Carl von Savigny German jurist and historian presumably is right I am not good at diagrams nor have I a good memory for shape - but I have seen examples in 12th - 13th century MSS which have clear examples of the transition from symbols here - see Image by corruption. I realise that my attempt at drawing only makes the thing seem more improbable. I can't say I've studied the question however & as you have your own opinion which I shall consuly -thank you for citation - is worth more Signature and Postscript including symbolsymbol is the true 12th Century abbrev. I think."; LETTER TWO: Two pages 12mo 2 Feb. 1922 to presumably the same "Sir" responding to his reply. "You make myremarks seem very superficial. I confess that I am no palaeographer. & have not enough sense of form ever to become one. I admit that a corrupt D is not very satisfactory. Still it is not simply a D but D with a stroke throughit D with a stroke through it is the sort of thing; then; symbol it becomses & then ff. Again it isn't exactly a blunder but a conventional sign naturally developed. Is it really as early as 9th or 10th century Earliest I've seen is middle 13th. Cappelli marks it XV. I will ask Mr Madan at Bodley. Will you accept enclosed which is the most serious piece of palaeographical work I've dome .". Note: For what it's worth he published "Digest 41 1 & 2. About the Book:- The absolute theory of punishment, on which we must therefore fall back rests on the assumption that crime as crime must be punished; The state as representing society at large springs from a moral necessity. It is not a matter of choice whether we will live under government. Some government, some from of civil organization, we must have. And the state is not to be guided simply by expediency or by the merely external purposes of society. It has an existence of its own to maintain, a conscience of its own to assert, moral principles to vindicate. Penal justice, therefore is a distinctive prerogative of the state, to be exercised in the service and in the satisfaction of the duty of the state and rests primarily on the moral right fulness of the punishment inflicted. About Author:- Francis Wharton (Philadelphia, Pennsylvania, March 7, 1820 – February 21, 1889) was an American legal writer and educationalist. Wharton graduated from Yale in 1839, was admitted to the bar in 1843, became prominent in Pennsylvania politics as a Democrat, and served as assistant attorney-general in 1845. In Philadelphia, he edited the North American and United States Gazette. He was professor of English, History, and Literature at Kenyon College, Gambier, Ohio, from 1856-1863. In 1871-1881 he taught ecclesiastical polity and canon law in the Protestant Episcopal Theological School at Cambridge, Massachusetts, and at this time he lectured on the conflict of laws at Boston University. For two years he traveled in Europe, and after two years in Philadelphia he went to Washington, DC, where he was lecturer on criminal law (1885–1886) and then professor of criminal law (1886–1888) at Columbian (now George Washington) University; in 1885-1888 he was solicitor (or examiner of claims) of the Department of State, and from 1888 until his death was employed on an edition (authorized by Congress) of the Revolutionary Diplomatic Correspondence of the United States (6 vols, 1889, ed. by John Bassett Moore), which superseded Jared Sparks's compilation. First and only edition of a magnificently illustrated encyclopaedic survey of the cultures, traditions, manners and customs of non-European peoples, notably the Japanese and the Chinese. The work is not arranged geographically but divided into six books successively treating (natural) history, politics and warfare, religious ceremonies, arts and sciences, hunting, and funeral traditions. The plates include depictions of a Japanese crucifixion, a lady from Nagasaki, Chinese temples, Brazilian cannibals, Japanese wrestlers and musicians, Indians from Florida, several torture methods, a tower cemetery, etc. - Erasmus Francisci (or Finx) was a prolific polyhistor and is considered one of the most influential figures of the German Baroque period. The present work carries on from his 1668 Ost- und West-Indischer wie auch Sinesischer Lust- und Stats-Garten, which was also arranged by topics rather than regions. - In very good condition. On mesure donc qu’il s’agit aussi bien d’une anticipation de la théorie de l’institution que de l’école sociologique du droit. Peu courant.
