Maurice Pallasse, directeur de sa thèse de droit, M. Roland Ganghoffer est parti de l’idée suivante : l’évolution des institutions municipales pendant le IVe et le Ve siècle n’a-t-elle pas été différente selon qu’on envisage la partie orientale ou la partie occidentale de l’Empire romain ? Constantin, fondateur de Constantinople, a en effet donné le branle à une différenciation multiforme entre les deux moitiés du monde romain, concrétisée sur le plan politico-social par l’existence de deux Sénats distincts et de deux aristocraties sénatoriales foncièrement différentes. Il n’est pas impensable a priori que les institutions municipales aient elles aussi évolué de façons divergentes et que peu à peu les dissemblances aient été telles qu’elles aient justifié la séparation politique en deux Empires, division devenue définitive en 395. L’auteur a donc systématiquement distingué la législation orientale et la législation occidentale pour les opposer l’une à l’autre et pour définir la réalité politico-économico-sociale à laquelle elles s’appliquent dans chacune des deux parties de l’Empire. L’enquête aboutit aux trois résultats suivants, énoncés en ces termes dans la préface par M. Pallasse : 1° En Orient, les Puissants font partie des curies municipales, et même ils s’en servent. Mais, en Occident, ils les fuient. 2° En Orient, les curiales peuvent accéder aux fonctions d’État, voire au Sénat de Constantinople. En Occident, ils n’ont aucune espérance de sortir de leur curie, sinon en s’enfuyant sur les propriétés des Puissants qui leur sont étrangers. 3° En Orient, l’État recule devant les curies puissantes, devant la puissance de leurs membres. En Occident, il se substitue à elles avec ses curatores, ses defensores, voire ses comtes. »‎
