American Lawyer Autograph Letter Signed 'Geo. S. Hillard' from Harvard lawyer G.S. Hillard later D.A. for Massachusetts to W. W. Greenough written from Paris in the 'Year of Revolutions' 1848 analysing the political situation there.
Paris France; 16 May 1848. 4pp. 4to. Bifolium. Ninety lines of text. Good on lightly-aged paper with small hole on second leaf causing damage to a few words of text. Addressed with two postmarks one French one American on the reverse of the second leaf to 'William W. Whitwell Esq Boston. Mass. United States of America'. A significant letter written from Paris by an astute and cultured American jurist on the day following the demonstration of 15 May 1848. Hillard begins by explaining that having been in Paris for three weeks he has only two complaints: 'the extreme heat' and 'the number of guns and drums which every where invade the ear and flash upon the eye'. He doubts whether the Parisians will 'be always content to carry about those heavy muskets as mere holiday toys for children to admire and maidens to smile upon them. When there is such preparation for war war itself will naturally follow. The legitimate object of a weapon is not to be simply brandished in the arm but to take away somebody's life.' He finds the 'character' of Paris 'much changed and the aspect which it now turns to me is not that usually presented to strangers though the difference is less than might be expected because the French temperament is so elastic and they have so remarkable a faculty of extracting happiness from the present without thinking of the past or the future. All business is deranged the glittering shops find few customers; the old relations between employer and employee are broken up and your tailor and bootmaker will tell you that he will execute your order as soon as possible - but when he cannot say and there is much distress extending even to classes and persons to whom it was before unknown'. Hillard contrasts the position of 'the old the rich the thrifty and prosperous bourgeoisie - the men who have "two gowns and every thing handsome about them"' - with 'the young and the ardent'. 'And the laborers and "proletaires" too seem to have got a notion into their heads that a republic means eating without working or at least that it is the duty of the state to furnish employment to every citizen'. Constructing a 'well-ordered State' out of such 'combustible and explosive materials' while avoiding the extremes of 'despotism & anarchy' is 'as difficult as to build a house out of friction matches and fire-crackers'. There are however 'more wise and good and thoughtful men in France than they who look at her through English spectacles'. He is not sure his view of the matter is any better informed in Paris than it would be if he were back in Boston: 'I read the papers observe what passes around me and get light wherever I can find it; but I speak the language but imperfectly and have no privilege of access to men of consideration and influence'. But of one thing he is certain: 'The new constitution is likely to be too democratic. The proposal of an upper house like our Senate meets with no favor.' Nevertheless 'the old spirit in Paris is not dead. The gas lights on the Boulevard at night make another day and gild innumerable groups of gay idlers who smile and chat and daff the world aside.' He finds the French 'rather a selfish & shallow-hearted race essentially but their superficial varnish of politeness is exhilarating to the passing stranger and gives a certain flavor to daily life'. He ends by describing his homesickness for Boston and by urging Greenough to join him in England - 'we will put ourselves upon a diet of beefsteak and porter and grow fat and rosy under the gills'. He reports that Charles Curtis is in Paris and sends his regards to Greenough's family with a reference to Dickens's 'Pickwick Papers'. Paris, France; 16 May 1848. unknown

Harvard-educated lawyer Holograph poem by the Harvard-educated lawyer George Stillman Hillard Attorney General of Massachusetts titled 'To the Friday Club'. With engraved portrait of Hillard.
Signed 'Geo. S. Hillard April 1. 1859.'. 3pp. 12mo. A fair copy. Very good on lightly-aged paper. The twenty-eight-line poem is arranged in seven four-line stanzas with Hillard's firm signature and the date at the end. The poem begins with unintentional but no less curious sexual overtones: 'The rod of Aaron severed long From its ancestral bowers Felt in its veins the sap of youth And shone with buds of flowers. The rigid staff smoothworn and dry In living green was dressed. And wild bees hummed above the spot The old man's hand had pressed.' Together with a photographic engraving 9 x 11.5cm on paper 16 x 24cm of a portrait of a bearded Hillard in late middle-age with facsimile of his signature beneath the image. In an address given at the University of Virginia in 1883 William Cabell Rives describes William Barton Rogers' membership in Boston of 'a select club known as the Friday Club. Among the members of that club besides himself were such men as the thoroughly informed and sparkling Amory the cultured Hillard the learned Ticknor the scholarly Felton the logical and profound Curtis the genial enthusiastic world-renowned Agassiz'. Soft cover 24 cm 416 pp. ISBN: 978-960-622-424-9.</p><p>Confronté à sa propre violence voire aux forces de la nature l’homme n’a cessé d’exprimer un besoin celui d’être rassuré et protégé. Ainsi le droit à la sécurité est dès la création des sociétés organisées un principe primordial de leur existence. Depuis les attentats du 11 septembre 2001 la question de la sécurité préoccupe fortement l’actualité politico-médiatique. La mise en place de politiques de sécurité performantes est un objectif qui excite les foules un facteur qui renforce l’exécutif. Cet objectif est caractérisé comme « besoin social impérieux ». Toutefois sur le plan purement textuel le droit à la sécurité n’apparaît pas d’une façon explicite comme norme constitutionnelle. La sécurité usant des techniques les plus avancées exige sur le plan juridique une adaptation du droit à l’ère numérique. Les systèmes de vidéosurveillance les téléphones portables la toile et les fichiers automatisés constituent les nouvelles armes de l’appareil policier. A ce titre le traitement des données représente le noyau dur des nouvelles orientations de sécurité. Toutefois l’utilisation des nouvelles technologies pour des raisons liées au maintien du bon ordre nécessite également un autre devoir: le respect des libertés fondamentales préoccupation manifeste du droit. Pour autant la surestimation des politiques de sécurité et la prolifération des mesures sécuritaires sont susceptibles d’entraîner une certaine dégradation ou un affaiblissement du droit à la protection des données principe fondamental du droit de l’UE dès l’adoption du traité de Lisbonne. Face à ce défi le droit cherche un juste équilibre entre vie privée et sécurité.</p><p>Certes l’équation est ancienne mais ses modes de résolutions évoluent en raison des innovations technologiques qui se rient des frontières et mettent à mal le principe de souveraineté territorial inhérent à l’Etat. Les droits nationaux supportent également mal cette abolition des frontières. La comparaison des ordres juridiques grecs et français avec certes leurs différences en sont de belles illustrations notamment dans le cadre de l’UE où la sécurité nationale en demeurant de la seule responsabilité des Etats membres crée des disparités entre les législations nationales. Dans cet environnement les AAI de protection des données des pays comparés se trouvent à la marge captives dans des cadres juridiques précis. Seule le juge reste pour faire le contrepoids face aux abus des services policiers.</p><p>Dans l’état actuel des traités constitutifs la protection des données traitées à des fins policières par la juridiction luxembourgeoise est impossible. Ainsi la Cour EDH constitue la seule juridiction européenne dotée d’opérer une conciliation des deux exigences fondamentales: maintien de l’ordre public et protection des données. En effet elle n’exerce qu’un contrôle de proportionnalité des mesures appliquées.
