Hamburger Philip
Separation of Church and State
2002. Hamburger Philip. Separation of Church and State. Cambridge: Harvard University Press 2002. xiii 514 pp. Hardcover. Cloth in dust jacket. New. $40. Hamburger argues that the separation of church and state has no historical foundation in the First Amendment. The detailed evidence assembled here shows that eighteenth-century Americans almost never invoked this principle. Although Thomas Jefferson and others claimed retrospectively that the First Amendment separated church and state this separation did not became part of American constitutional law until much later. unknown books

Facsimile reprint of the complete text of the rare first edition in two volumes. "Most famous and influential American political work." Howes U.S.IANA 1650-1950 H114c. The views of Hamilton Madison and Jay expressed in this landmark work have had a lasting effect on U.S. Constitutional law. Eighty-five of the essays were almost entirely written by Hamilton and Madison and probably only five were written by Jay. Most of the individual essays appeared under the collective pseudonym "Publius" in New York newspapers and journals from October 27 1787 to early June 1788. The first edition was published anonymously and printed by the M'Lean brothers who collected and published the first 36 essays as Volume I in March 1788 with the final 49 essays in Volume II in May of the same year along with the text of the Constitution. The essays were intended to encourage ratification of the proposed constitution by New York State but were immediately recognized as the most compelling commentary on the most radical form of government the world had seen. Hamilton's essays especially express a strong concern for the rights of property over the natural rights of "life liberty and the pursuit of happiness" as outlined by Jefferson in the Declaration of Independence. Hamilton Marci A.; Foreword by Hon. Edward Becker
God vs. The Gavel: Religion and the Rule of Law
2005. Hamilton Marci A. God vs. The Gavel: Religion and the Rule of Law. Foreword by the Honorable Edward R. Becker. New York: Cambridge University Press 2005. xii 414 pp. Hardcover. Cloth in dust jacket. New. $10. Hamilton challenges the pervasive assumption that all religious conduct deserves constitutional protection even if it is otherwise unacceptable. The thesis of the book is that anyone who harms another person should be governed by the laws that govern everyone else. This may not sound like a radical proposition but it has been under assault since the 1960s. This book intends to change the course of the public debate over religion by bringing to the public's attention the tactics of religious entities to avoid the law and therefore harm others. unknown books

Hamilton's essays especially express a strong concern for the rights of property over the natural rights of "life liberty and the pursuit of happiness" as outlined by Jefferson in the Declaration of Independence. unknown
