A New Law Dictionary Intended for General Use as Well as For.
2004. ISBN-13: 9781584773566; ISBN-10: 1584773561. With New Introduction by Bryan A. Garner Burn Richard. A New Law Dictionary Intended for General Use as Well as For Gentlemen of the Profession and Continued to the Present Time by John Burn. Originally published: London: Printed by A. Strahan and W. Woodfall 1792. 2 vols. i new introduction vii 442; 446 pp. Reprinted 2004 by The Lawbook Exchange Ltd. With a new introduction by Bryan A. Garner President LawProse Inc. ISBN-13: 9781584773566; ISBN-10: 1584773561. Hardcover. New. $95. Sole edition. Intended to be a practical tool Burn 1709-1785 eliminated several French definitions found in earlier dictionaries that were made obsolete by a 1733 decree of George II ordering writs and pleadings to be given in English. The elimination of these entries seems to have cleared space for other material and longer entries. Indeed Burn's articles on such subjects as judgment jury purchase and will are broader more detailed and better organized than they are in earlier dictionaries of this kind. It is unclear whether Burn intended to publish this book; it was edited expanded and published posthumously by his son John Burn 1744-1802. unknown books

Bennett Walter
The Lawyer's Myth: Reviving Ideals in the Legal Profession
2001. ISBN: 9780226042558. Bennett Walter. The Lawyer's Myth: Reviving Ideals in the Legal Profession. Chicago: University of Chicago Press 2001. 251 pp. Cloth hardcover in dust jacket. New. ISBN: 9780226042558. Publisher's Price USD 52. Special $25. Lawyers today are in a moral crisis. The popular perception of the lawyer both within the legal community and beyond is no longer the Abe Lincoln of American mythology but is often a greedy cynical manipulator of access and power. In The Lawyer's Myth Walter Bennett goes beyond the caricatures to explore the deeper causes of why lawyers are losing their profession and what it will take to bring it back. Bennett draws on his experience as a lawyer judge and law teacher as well as upon oral histories of lawyers and judges in his exploration of how and why the legal profession has lost its ennobling mythology. Effectively using examples from history philosophy psychology mythology and literature Bennett shows that the loss of professionalism is more than merely the emergence of win-at-all-cost strategies and a scramble for personal wealth. It is something more profound-a loss of professional community and soul. Bennett identifies the old heroic myths of American lawyers and shows how they informed the values of professionalism through the middle of the last century. He shows why in our more diverse society those myths are inadequate guides for today's lawyers. And he also discusses the profession's agony over its trickster image and demonstrates how that archetype is not only a psychological reality but a necessary component of a vibrant professional mythology for lawyers. unknown books

Originally published: Tahlequah I.T.: National Advocate Print 1881. vi i-vi new introduction 370 vi pp. Reprinted 1998 by The Lawbook Exchange Ltd. With a new introduction by Michael Weber. ISBN-13: 9781886363427. ISBN-10: 1886363420. Smythe sewn hardcover with gilt stamped front cover and spine. New. $34.95 This volume provides a unique legal and historical record. It is an exact reprint of an 1881 compilation originally published by the Cherokee National Council of "the laws of the Cherokee Nation now in force." These laws -- the 1839 constitution of the Cherokee Nation and the basic laws passed under it -- provided the framework for the government of the Cherokee Nation from 1839 until the early 1900s when the Cherokees' independence was ended by the United States Congress. Within scarcely more than a generation the Cherokees consciously transformed themselves from being a society that lived under an age-old unwritten set of norms and traditional cultural practices to one governed by a written constitution and code of statutes. The Cherokees made this transformation in the vain hope that it would make it easier for them to live peacefully surrounded by the United States. They closely modeled their constitution in most respects on the United States Constitution. Yet there are some fascinating differences concerning the judiciary and land ownership. Contained in this volume are the Cherokees' 1839 constitution along with amendments to it necessitated by the 1866 treaty between the Cherokee Nation and the United States; the 1838 Act of Union between the Eastern and Western Cherokees; numerous basic laws and miscellaneous acts covering a huge variety of subjects from the duties of the principal chief to the killing of game; agreements between the Cherokees and the Creeks and Osages Delawares and Shawnees; and an appendix containing documents relating to the boundaries of the Cherokee Nation as defined by agreements with the United States. unknown books

The history and contents of the Magna Carta 1215 and the Bulla Aurea 1222 are remarkably similar so much so that the latter document is often called the "Magna Carta of Hungary." These similarities are remarkable given the differences between the nobility of England and the Holy Roman Empire. In this fascinating study Hantos traces Hungary's constitutional development during the thirteenth and fourteenth centuries. Turning to the laws and institutions they engendered Hantos considers examples where developments were similar or divergent. This study will interest students of medieval law comparative law and constitutional history. unknown books

With extensive notes the first 122 pages in English a life of Ruggle 1575-1622 commentary explaining the jokes and an extensive glossary of legal terms. Main text in Latin. It had gone through at least nine editions prior to this one all of them according to Hawkins were "failures." Ruggles' classic acerbic satire of the English bench and bar was written in Latin and first performed in 1615. Designed to ridicule the language of the common law and the dullness of lawyers the play is based on events relating to a legal dispute between the vice-chancellor of Cambridge University and the mayor of Cambridge Francis Brakin. The lawyers who were the subject of the play's satire did not enjoy the work; Sir Edward Coke the Lord Chief Justice believed that he was a target of some of the barbs. The play provoked a quarrel between academics and lawyers. The lawyers responded with satirical poems and ballads which inspired responses by the academics to create a passionate controversy. Ruggle's play even had an influence in the reform of legal language in England. 64 Critical Review 333. unknown books

ISBN-13: 9781584770084. ISBN-10: 1584770082. Hardcover. New. $27.95 "The life of the law has not been logic; it has been experience." Oliver Wendell Holmes Jr. "Max Radin is the rare and finished product of our American legal system. He is skilled in the semantics of the law. But unlike some legal scholars and some judges too he does not use semantics to make law a facile thing to fit the idiosyncrasies of the author or to satisfy the moods of the moment. The law which he fashions is flavored with an earthy quality of function and practicality. He is quick to sense the enduring values of the democratic system and to see the law as the vehicle for their perpetuation." -William O. Douglas 36 California Law Review 163 1947-1948. "Mr. Radin is too good a logician to accept the popular antithesis between logic and experience as contraries white and black or as contradictories white and not white. Rather logic and experience are viewed as divergent directions in analysis. The shape of anything that lies within the field of law may be described therefore in terms of distances from `our ordinate of logic and our abscissa of experience.' Upon this framework Mr. Radin proceeds to analyze the various compounds of logic and experience that constitute law evidence arbitration punishment and justice. --Felix S. Cohen 54 Harvard Law Review 711 1940-1941. MAX RADIN 1880-1950 received his LL.B. from New York University in 1902 and his Ph.D. from Columbia University in 1909. He was a law professor at the University of California Berkeley and UC-Hastings School of Law and a member of the Institute for Advanced Study at Princeton.
