New. $49.95 One of the most distinguished historians of English common law Holdsworth produced this manual to provide students of real property with a concise history of the field. This background was necessary he argued because contemporary land law was hard to comprehend apart from its history. "Holdsworth has cheerfully carried through the task of giving us an elementary survey of one part of the vast subject in the mastery of which he stands alone. Most writers of manuals have to popularize the results of the labour of others; Professor Holdsworth need pillage few storehouses but his own." --Law Quarterly Review 44: 1928 105. William S. New York: Oxford University Press 1920. xix 605 pp. Reprinted 2003 by The Lawbook Exchange Ltd. ISBN-13: 9781584771715. ISBN-10: 1584771712. Hardcover. New. $120. With an extensive appendix of source readings. Scott 1866-1943 presents a detailed and comprehensively documented history of the American Constitution from its roots in the Mayflower Compact and other colonial associations through the Eighteenth Amendment. It can be read in this regard as a survey history. His study is especially interesting however as a political document written to address the effects of the First World War. Scott wrote this book for a European audience hoping that his analysis of the Constitution would influence the creation of an international organization of states governed by a "Court of Nations" modeled on the American Supreme Court. As such he emphasizes the Constitution's role as an agent of peace and cooperation among different political units. Scott's ideas were later reflected in the establishment of the International Court of Justice the League of Nations and the United Nations. unknown books‎

‎2006. ISBN-13: 9781584776376; ISBN-10: 1584776374. Verplanck Gulian C. An Essay on the Doctrine of Contracts: Being an Inquiry How Contracts are Affected in Law and Morals By Concealment Error Or Inadequate Price. New York: Published by G. & C. Carvill 1825. vi 234 pp. Reprinted 2006 by The Lawbook Exchange Ltd. ISBN-13: 9781584776376; ISBN-10: 1584776374. Hardcover. New. $95. Reprint of the first edition. In his discussion of early American works on contract law in The Transformation of American Law Horwitz observes that "nowhere were its underlying bases more brilliantly and systematically rethought" than in Verplanck's Essay 281. Indeed compared to those of Dane and Story "Verplanck's reconsideration of the philosophical foundations of contract law was by far the most penetrating among the American treatise writers" 283. It is a landmark in the development of the will theory of contract and an elaborate critique of the doctrine of caveat emptor which had recently been adopted by the U.S. Supreme Court in Laidlaw v. Organ 1817. On a broader level this key work is interesting for its insights into the tandem development of contract law and the market economy on the cusp of the economic boom of the 1820s. unknown books‎

Under the Action are treated in part two preliminaries summons proceedings in jure formula dangers of the formulary system different kinds of actions. confession neglect of defence use of the oath judicium execution appeal and reversal. Compiled from the Judicial Biographies of John Lord Campbell. With an Appendix Containing the Case of Passmore Williamson. Edited with an Introduction. Originally published: New York and Auburn: Miller Orton & Mulligan 1856. 432 pp. Reprinted 2006 by The Lawbook Exchange Ltd. ISBN-13: 9781584775409; ISBN-10: 1584775408. Hardcover. New. $95. Compiled in the midst of the American debates over the extension of slavery into the western territories Hildreth's decidedly anti-expansionist views were beset by a fundamental historical dilemma. On the one hand "it was. by judicial far more than by legislative institutions that among those progenitors of ours private rights and public liberty were guarantied" 11. On the other judges in England and by inference those in the United States were perfectly capable of restricting the expansion of liberty in service to "petty tyrants" be they Stuarts or American slaveholders. Drawing from Campbell's Lives of the Chief Justices and Lives of the Lord Chancellors Hildreth highlights judges who served the interests of oppression such as Roger Le Brabancon and Robert Wright. The appendix contains the case of Passmore Williamson a famed Philadelphia abolitionist and member of the Underground Railroad who was prosecuted under the 1850 Fugitive Slave Act. Hildreth 1807-1865 was the author of The Slave 1836 Despotism in America 1854 and other popular books on slavery law and American history. unknown books‎

Three lectures by the Harvard Law School professor examine legal positivism and natural law. In the course of his analysis Fuller discusses Kelsen's theory as a reactionary theory and Hobbes' theory of sovereignty. He defines legal positivism as the viewpoint that draws a distinction "between the law that is and the law that ought to be" and interprets natural law as that which tolerates a combination of the two. He looks at the effects of positivism's continued influence on American legal thinking and concludes that law is necessary in a democracy as a principle of order. LON L. FULLER 1902-1978 was a professor at Harvard Law School and is remembered for his contributions to the law of contracts. His debate with H.L.A. Hart in the 1958 Harvard Law Review Vol. 71 is noteworthy because it provided the framework for subsequent debates about legal positivism and natural law. unknown books‎

New. $39.95 Reprint of the fourth and final edition of one of the earliest American treatises on the subject. The Anglo-American tradition of granting patents has often been marked by confusion over their scope and intent. Reflecting for example on the fundamental question of whether patents create monopolies juridical commentators and the bench had come down firmly both in favor and against the idea. Curtis argued that it did not according to the common law. Instead a patent was a "grant by the government to the author of a new and useful invention of the exclusive right for a term of years of practising that invention" xxi. Better known for his Nationalist interpretation of the Constitution Curtis 1812-1894 was prominent New York patent attorney and the author of works on admiralty and equity jurisprudence. unknown books‎

Written near the end of Millar's career the present study is a brilliant summary of his life's work. It discusses antecedents of the Anglo-American system the evolution of procedure and American and English civil procedure in the nineteenth century. Other chapters discuss the development of specific areas such as introduction of the cause mode of trial and voluntary dismissal. "In a society which so often confuses quantity with quality - or at least tends to regard quantity as a necessary ingredient of quality - it is not surprising that American legal texts labeled "great" have generally been multi-volumed ones. While the number of volumes certainly does not detract from the worth of a Williston on Contracts or a Wigmore on Evidence their sheer size has made them more easily recognizable in our society as classics. On the other hand the single volume American law books receiving the label of greatness would make a sparse list indeed. To this elite list must now be added Professor Millar's Civil Procedure of the Trial Court in Historical Perspective." --Philip P. Kurland Harvard Law Review 66 1952-1953 1542 Robert Wyness Millar 1876-1959 a professor at Northwestern University Law School was a leading authority on civil procedure and its history. Analyzing the meaning of reasonable value as defined by the courts he finds that the answer is based on a notion of reasonable conduct. Expanding this point to encompass the habits and customs of social life he shows that court decisions are based on customs that are powerful forces shaping the economic system. New. $28.95 Goodnow's major work this book analyzes the distinction between `politics' and `administration.' According to Goodnow politics is concerned with policy and other expressions of state will. Administration is concerned with the faithful execution of enacted legislation. He observes that administration has a tendency to overstep this boundary and concedes that politics must therefore monitor administration to keep it in line with the people's will. Reprint of first edition. While a member of the Columbia faculty Frank J. Goodnow 1859-1939 was the first individual in the United States to hold a professorship in administrative law. He became the first president of the American Political Science Association which offers an annual award in his name. He was president of Johns Hopkins University from 1915-1929. "From both the legal and historical standpoint the book contains many things that are richly suggestive. There is very little in our legal or political literature so penetrating as for example the exposition of the effects of confinement of the principle of separation of powers to the central government. . It is not written for the legal profession directly but to those lawyers who seek more than a working tool in their profession a true appraisement of the administrative law it will appeal. The writing of such a work moreover is a signal public service." --6 Columbia Law Review 1906 133. unknown books‎

ISBN-13: 9781584775485; ISBN-10: 1584775483. Hardcover. New. $44.95 In Latin with a parallel English translation. The Gaii Institutionum Juris Civilis Commentarii Quatuor or Institutes of Gaius was compiled around 161 CE. It is a deeply influential elementary textbook on Roman private law. Well-arranged and clearly written it was the standard textbook for the next 300 years. One of the five authorities accepted by Justinian it is the primary source of the Institutes. It was also the basis of the Breviarium Alaricianum or Lex Romana Visigothorum. Gaius c.115-180 was a teacher and writer who probably lived in Rome. The Tituli ex Corpore Ulpiani also known as the Epitome Ulpiani Regulae Ulpiani or Rules of Ulpian is a collection of legal rules attributed to Ulpian c.160-228 CE who is considered to be the last great classical Roman jurist. Many of the rules in this collection are similar to those in Gaius and it is fruitful to have both works in the same volume for the purposes of comparison and clarification. unknown books‎

New. $24.95 Published in 1797 The Philosophy of Law Rechtslehre stands as one of the most significant late works by the great Prussian philosopher. Though he lived in an atmosphere of political and social repression it is evident that Kant 1724-1804 was sensitive to the revolutionary spirit that was spreading throughout Europe in the wake of Napoleon's armies. Claiming that man is born with reason and an innate desire for freedom he argued that the union of these natural gifts could bring about a new sense of order and harmony in future generations. This edition also reprints Kant's later Supplementary Explanations 1797 which was added to the second edition 1798. unknown books‎
