‎2016. ISBN-13: 9781584775157; ISBN-10: 1584775157. The Second Edition Edited by His Son W.W. Story Story Joseph. Story William Wetmore Editor. Commentaries on the Constitution of the United States: With a Preliminary Review of the Constitutional History of the Colonies and States Before the Adoption of the Constitution. Originally published: Boston: Little Brown and Company 1851. Two volumes. xxxiii 734; 632 pp. Reprinted 2005 2016 by The Lawbook Exchange Ltd. ISBN-13: 9781584775157. ISBN-10: 1584775157. Hardcover. New. $125. Reprint of the second edition with additions by his son W.W. Story 1819-1895. First published in 1833 this work is generally considered to be the most important work written on the American Constitution before the Civil War. Dedicated to John Marshall it presented a strongly Nationalist interpretation. It is divided into three books. Book I contains a history of the colonies and discussion of their charters. Book II discusses the Continental Congress and analyzes the flaws that crippled the Articles of Confederation. Book III begins with a history of the Constitution and its ratification. This is followed by a brilliant line-by-line exposition of each of its articles and amendments. Comparing it to The Federalist James Kent said that Story's work was "written in the same free and liberal spirit with equal exactness and soundness of doctrine and with great beauty and eloquence of composition. Whoever seeks.a complete history and exposition of this branch of our jurisprudence will have recourse to this work which is written with great candor and characterized by extended research and a careful examination of the vital principles upon which our government reposes.": cited in Marvin Legal Bibliography 669-670. unknown books‎

Interpreting Such Difficult and Obscure Words and Terms as are Found Either in Our Common or Statute Ancient or Modern Laws. With References to the Several Statutes Records Registers Law-Books Charters Ancient Deeds and Manuscripts Wherein the Words are Used: And Etymologies Where They Properly Occur. Originally published: London: Printed by Tho. Newcomb for John Martin and Henry Herringman 1670. Unpaginated 284 pp. Text printed in double columns. Folio 8" x 12". Reprinted 2004 by The Lawbook Exchange Ltd. ISBN-13: 9781584774150; ISBN-10: 1584774150. Hardcover. New. $75. Reprint of first edition. Blount 1618-1679 was a member of the Inner Temple. Prohibited to practice at the Bar because he was a Catholic Blount turned to legal scholarship and lexicography. Blount aimed to correct the defects he found in Cowell's Interpreter 1607 and Rastell's Termes de la Ley 1523. In his preface he observed that Cowell "is sometimes too prolix in the derivation of a Word setting down several Authors Opinions without categorically determining which is the true"; Rastell "wrote so long hence that his very Language and manner of expression was almost antiquated." He hoped that by correcting these flaws he would create a dictionary useful to everyone in the profession from "the Coif to the puny-Clerk." The Nomo-Lexikon is clearer and more detailed than its predecessors. It is also the first English-language dictionary with entries that include word etymologies and citations. An immediate success that quickly supplanted its predecessors it was reissued in larger and revised editions throughout the eighteenth century. unknown books‎

This sophisticated study analyzes the social and political factors that shaped California's state constitution which was enacted in 1879. It also addresses a broader topic. As Swisher states in the preface he was drawn to his subject because it provided an excellent opportunity to study "the motives which dominate men in determining their activities when they act together with other men and the techniques which they use in making themselves effective." Swisher 1897-1968 was a professor of government at Columbia University and a distinguished constitutional historian. unknown books‎

A Complete Stenographic Report of the Famous Court Test of the Anti-Evolution Act at Dayton July 10 to 21 1925 Including Speeches and Arguments of Attorneys. Originally published: Cincinnati: National Book Company 1925. 4 339 pp. Reprinted 1997 2010 by The Lawbook Exchange Ltd. ISBN-13: 9781886363311; ISBN-10: 1886363315. Hardcover. New. $49.95 Complete transcript of the celebrated "monkey trial" the case of the State of Tennessee vs. John Thomas Scopes a 24-year old high school teacher accused of violating a recently enacted state law that banned the teaching of Charles Darwin's theory of evolution. Perhaps the first modern media event the trial attracted enormous national and international attention. A star-studded cast of trial attorneys included the great orator and three time Democratic presidential candidate William Jennings Bryan and the brilliant trial lawyer and champion of the downtrodden Clarence Darrow among others. The climax of the trial came on the seventh day when the defense put the senior Bryan on the stand as an expert on the Bible and he was ruthlessly interrogated by Darrow. As a milestone in the American struggle between modernity and the forces of Protestant fundamentalism and a vivid manifestation of the clash between two valid principles academic freedom and democratic control of the public schools the Scopes case has tremendous historical significance. This edition also includes statements by scientists entered at the defense's request and the text of a lengthy concluding speech that Bryan prepared but never delivered. unknown books‎

ISBN-13: 9781584776000; ISBN-10: 1584776005. Cloth. New. $95. This is the text of the trial transcript with narrative commentary by the recorder of the military tribunal that tried the conspirators. One of the most traumatic events in U.S. History the assassination of President Lincoln has several aspects that remain a subject of debate. One is the legality of the tribunal. For example it is unclear whether the assassins were guerrilla soldiers or civilians which raises questions about the choice of tribunal. In order to consider issues such as these it is useful to have access to the original source records. Pitman's annotated transcript is one of the most important. The appendix contains the verdict of the Military Commission together with President Johnson's approval and his Official Order for the execution of David E. Harold George A. Atzeroth Lewis Payne and Mary E. Surratt; an account of the their executions; and Mrs. Surratt's petition for a writ of Habeas Corpus with the President's indorsement suspending the writ in the case From The Trial of the Assassins and Conspirators at Washington City D.C. New. $44.95 Whiting's writings are widely believed to have profoundly affected President Lincoln's war actions. In Whiting's legal theories regarding war powers and the abolition of slavery espoused here Lincoln found justification for the Emancipation Proclamation and the constitutional authority to abolish slavery. Simply stated Whiting held that the abolition of slavery is constitutionally appropriate when viewed not as the objective end of the war but as a means to end the rebellion in order to save the republic. His writing style was geared to the average reader and this popular style along with the tremendous influence of his writings led to the work going through 43 editions in less than a decade. This the tenth edition is based on his earlier work The War Powers of the President and the Legislative Powers of Congress in Relation to Rebellion Treason and Slavery 1862 which is thought to have been the work that originally brought Whiting to Lincoln's attention and led to his appointment as Solicitor of the War Department. This edition includes various unpublished sensitive documents that he handled in the course of that position. unknown books‎

Reprint of the uncommon first edition. Chipman's Essay was the first original treatise on the subject written in the United States. Verplanck's An Essay on the Doctrine of Contracts 1825 was the second. In his Legal Bibliography 1847 Marvin criticized Chipman for "showing what the law of contracts ought to be rather than what the law of contracts is" 189. This remark indicates Marvin's failure to grasp the changing nature of contract law and it shows that Chipman's ideas were ahead of their time. Indeed as Horwitz points out Chipman was the first American to submerge the "dominant equity theory of contract in a conception of contractual obligation based exclusively on express bargains" determined by market values. Chipman 1765-1850 was a Vermont lawyer a professor of law at Middlebury a representative to the state legislature and the U.S. Congress and a delegate to several Vermont constitutional conventions. unknown books‎

"At the time that he wrote judges and lawyers lacked legal treatises which cited American decisions and showed how far the English common law had been followed by American courts or modified to suit new conditions. Textbooks presenting cases from all states were needed in order to encourage the development of national judge-made law rather than particularistic local doctrines. Hilliard was one of the first and most voluminous of the authors who met these needs." DAB V:53. His vast legal knowledge is aptly employed in this important early textbook which provides a summary of the basic principles of American law. His success with this first work which went into a second edition led Hilliard to go on to write numerous other well-regarded treatises many of which went into numerous editions including The Law of Torts 1859 the first English treatise on the subject. New. $44.95 The first edition of Rastell's law dictionary precedes in point of time the publication of the first general English dictionary and is the most important English dictionary before Cowell's controversial Interpreter 1607. Rastell d.1536 was a successful lawyer and printer. He published his dictionary around 1523 with the title Expositiones Terminorum Legum Anglorum. Later editions are titled Termes de la Ley or An Exposition of Certain Difficult and Obscure Words. Immediately successful it went through at least twenty-nine editions the last appearing in 1819. Hicks praised its value and described it as useful for its insights into the state of the common law at the close of the year-book period. This early edition is especially significant because it was printed by Richard Tottel fl. 1553-1594. Tottel was an important London printer who owned the patent for many common law books. 246. H. Haines' colorful history of the Supreme Court surrounding the John Marshall years gives particular attention to the "local particularist and democratic" principles Introduction p.4 that Haines an ardent Jeffersonian believed were neglected in favor of a conservative and nationalistic viewpoint found in earlier histories of the Court. He shows that the Supreme Court under Chief Justice John Marshall established the doctrine of judicial review as part of a Federalist effort to strengthen the central government and goes on to discuss attacks upon the Court and the decline of authority and prestige of the Court. In his description of the Court's major decisions he examines the issue of state versus national sovereignty and the status of common-law principles in the federal courts. He includes a discussion of opinions regarding the Dartmouth College case and the trial of Aaron Burr. Haines was a political scientist and professor of Political Science at the University of California at Los Angeles for twenty years.
