‎Society and Nature: A Sociological Inquiry‎

‎2000. ISBN-13: 9781584770640; ISBN-10: 1584770643. Kelsen Hans. Society and Nature: A Sociological Inquiry. London: K. Kegan Paul Trench Trubner & Co. Ltd. 1946. viii 391 pp. Reprinted 2000 2009 by The Lawbook Exchange Ltd. ISBN-13: 9781584770640; ISBN-10: 1584770643. Hardcover with dust jacket. New. $54.95 This interesting work offers a sociological and ethnographic perspective on Kelsen's juristic thinking. His central thesis which ranges over the history of humanity argues that the idea of causality developed from primitive ideas of retribution. He shows how early man developed his interpretation of nature through the laws of retribution and causality then developed our current concept of nature and society over time. He holds that the gradual emancipation of the law of causality from the principle of retribution is "the emancipation from a social interpretation of nature" a process "very important from the point of view of intellectual history." Introduction viii. Society and Nature was originally published in 1943 to mixed reviews. It deserves a fresh appraisal for its original ideas and insights into Kelsen's theory of pure positive law outlined in Pure Theory of Law and General Theory of Law and State. Possibly the most influential jurisprudent of the twentieth century Hans Kelsen 1881-1973 was legal adviser to Austria's last emperor and its first republican government the founder and permanent advisor of the Supreme Constitutional Court of Austria and the author of Austria's Constitution which was enacted in 1920 abolished during the Anschluss and restored in 1945. He was the author of more than forty books on law and legal philosophy. Active as a teacher in Europe and the United States he was Dean of the Law Faculty of the University of Vienna and taught at the universities of Cologne and Prague the Institute of International Studies in Geneva Harvard Wellesley the University of California at Berkeley and the Naval War College. unknown books‎

New. $24.95 Intended as an introductory treatise for law students this treatise serves as an excellent introduction and a useful reference. And as one would expect from a book co-written by Holdsworth 1871-1944 it goes beyond the law of his day to analyze its historical development. In addition to a valuable introductory chapter on the history of succession the authors enrich their discussion in the main text with observations on the ways its principles developed over time in response to particular conditions. Their functionalist view which owes much to Maitland's example enabled them to create a sophisticated text that avoids the pitfalls of contemporary formalistic and "scientific" treatises. unknown books‎

Jenks 1861-1939 defines the doctrine of consideration as it was practiced in the 1890s and traces its evolution to its origins in the twelfth century. He argues "the doctrine of consideration was apparently unknown to the Roman jurists. It came into English law purely as a matter of accident as an incidental consequence of a special manner of proof; and it was not until it was familiar in this capacity that men perceived its value as a doctrine of substantive law." pp. 224-225 The work of no single mind this evolutionary process demonstrated that "the English nation while it has perhaps produced few individual lawyers of genius has in its corporate capacity manifested something like an unconscious genius for law." p. 225 "This little book is very suggestive and well worth the attention of any one who cares for the history of the law.": G.R.P. Originally published: London: Macmillan and Co. 1863. xii 499 pp. Reprinted 2005 The Lawbook Exchange Ltd. ISBN-13: 9781584774785; ISBN-10: 1584774789. Hardcover. New. $27.95 Reprint of the first edition. Stephen 1829-1894 explores English law exclusive of penal actions of offences punishable by summary proceedings before magistrates and of special offences intended as sanctions for special statutory institutions but including all other acts commonly known as crimes. In a discussion of a later edition Holdsworth observed: "it was probably the best modern history of a particular branch of English law that had yet appeared in England. It won high praise from Pollock and Maitland. Though the more intensive study of the earlier history of our law has rendered some parts of it obsolete it is still the best history of the later stages of the law. And it has another merit which it can never lose. The fact that its author was a practising lawyer and a judge gives to his account of many parts of the law and especially to his analysis of famous trials the reality and vividness which comes of practical experience.": The Historians of Anglo-American Law 77-78. unknown books‎

Gracefully written and enriched with countless references this is an essential book. First published in 1895 it remains a primary text for students of legal history and the social history of medieval England. "Its interpretation of the making of the common law made all previous accounts completely obsolete and was unchallenged until the 1960s. . It is an astonishing achievement one of the truly great pieces of historical literature of all time these chapters by Pollock and Maitland.": Norman F. Cantor Inventing the Middle Ages 58 66. Sir Frederick Pollock 1845-1937 was an English jurist best known for this work as well as his extensive correspondence with US Supreme Court Justice Oliver Wendell Holmes which was published posthumously as The Holmes-Pollock Letters. New. $29.95 Reprint of the first English edition published in 1923 under the auspices of the Carnegie Endowment for International Peace. With an introduction by James Brown Scott. This important study written during the First World War was one of the first to propose a league of nations. Nippold a German jurist who lived in Switzerland argues that the First World War created a need for a radical reinterpretation of the law of war. Modern war cannot be given the character of a legal institution because it is really a negation of law. War is not an element of international law he concludes; it is self-help on the part of the aggressor nation. In his International Law C.G. Fenwick stated that this book would be an essential addition to a working library of international law. Compiled immediately after Borden's sensational trial the author aims to provide "a connected story of the whole case commencing with the day of the tragedy and ending with the day that Miss Borden was set free." He touches on such topics as the discovery of the murders the adjournment of the preliminary hearing and some the many theories that were advanced before any arrests were made. The book is handsomely illustrated with photos and line illustrations of the deceased the accused the jury and others. Edwin H. Porter 1864-1904 was the Police Reporter for the Fall River Daily Globe and a correspondent for the Boston Herald. A comprehensive reformation and codification of French civil law the Code Napoleon was enacted in March 21 1804 after a three-year period of 87 sessions. Produced by a commission appointed by Napoleon it embodies a typically Napoleonic mix of liberalism and conservatism. Most of the freedoms won by the revolution such as equality before the law freedom of religion and the abolition of feudalism were preserved. At the same time the Code reinforced patriarchal power by making the husband the ruler of the household. Renamed the Civil Code after the Bourbon restoration and still in force it has served as the model for the legal codes of more than twenty nations throughout the world. According to the Dictionary of National Biography this work was translated by George Spence 1787-1850 an English jurist and Barrister of the Inner Temple. ‎Marshall John; Oster John Edward Editor‎

‎The Political and Economic Doctrines of John Marshall‎

‎2006. ISBN-13: 9781584776413; ISBN-10: 1584776412. Marshall John. Oster John Edward Editor. The Political and Economic Doctrines of John Marshall. Originally published: New York: Neale Publishing 1914. Frontispiece 369 pp. Reprinted 2006 by The Lawbook Exchange Ltd. ISBN-13: 9781584776413; ISBN-10: 1584776412. Hardcover. New. $49.95 Reprint of the sole edition. Unlike his colleague Joseph Story Marshall 1755-1835 was not interested in formal scholarship. Devoted entirely to the bench and bar he had neither the time nor inclination to write essays or treatises. In order to locate the principles that guided his juristic thinking then it is necessary to look at other sources. This is Oster's approach. He assembles a wide selection of letters speeches miscellaneous writings and excerpts from decisions and arranges them thematically with narrative commentary. A useful guide to Marshall's ideas it also has the character of an intellectual biography. unknown books‎
