‎Kelsen Hans. Max Knight translator‎

‎Pure Theory of Law. English Translation 2d Revised and Enlarged Ed‎

‎2005. ISBN-13: 9781584775782; ISBN-10: 1584775785. Kelsen Hans. Pure Theory of Law. Translation from the Second German Edition by Max Knight. Originally published: Berkeley: University of California Press 1967. x 356 pp. Reprinted 2005 by The Lawbook Exchange Ltd. ISBN-13: 9781584775782; ISBN-10: 1584775785. Paperback. New. $36.95 Second revised and enlarged edition a complete revision of the first edition published in 1934. A landmark in the development of modern jurisprudence the pure theory of law defines law as a system of coercive norms created by the state that rests on the validity of a generally accepted Grundnorm or basic norm such as the supremacy of the Constitution. Entirely self-supporting it rejects any concept derived from metaphysics politics ethics sociology or the natural sciences. Beginning with the medieval reception of Roman law traditional jurisprudence has maintained a dual system of "subjective" law the rights of a person and "objective" law the system of norms. Throughout history this dualism has been a useful tool for putting the law in the service of politics especially by rulers or dominant political parties. The pure theory of law destroys this dualism by replacing it with a unitary system of objective positive law that is insulated from political manipulation. Possibly the most influential jurisprudent of the twentieth century Hans Kelsen 1881-1973 was legal adviser to Austria's last emperor and its first republican government the founder and permanent advisor of the Supreme Constitutional Court of Austria and the author of Austria's Constitution which was enacted in 1920 abolished during the Anschluss and restored in 1945. The author of more than forty books on law and legal philosophy he is best known for this work and General Theory of Law and State. Also active as a teacher in Europe and the United States he was Dean of the Law Faculty of the University of Vienna and taught at the universities of Cologne and Prague the Institute of International Studies in Geneva Harvard Wellesley the University of California at Berkeley and the Naval War College. The general thesis however is clear enough to students of legal history. The notes are full of curious and amusing matters and almost as good reading as the text." Law Quarterly Review 18:98. Widely considered the father of legal history Frederic William Maitland 1850-1906 was an English jurist and historian best known for the standard The History of English Law Before the Time of Edward I 2 vols. 1895 written with Sir Frederick Pollock. He was educated at Eton and Cambridge and studied at Lincoln's Inn London. Maitland was called to the bar in 1876 and practiced until 1884 when he became a reader in English law 1884 and professor 1888 at Cambridge. He founded the Selden Society in 1887. Hailed for his original outlook on history his works profoundly influenced legal scholarship. Other sections consider its approach to open and secret diplomacy the ratification of conventions and the function of related technical organizations. ‎Hamilton Marci A.; Foreword by Hon. Edward Becker‎

‎God vs. The Gavel: Religion and the Rule of Law‎

‎2005. Hamilton Marci A. God vs. The Gavel: Religion and the Rule of Law. Foreword by the Honorable Edward R. Becker. New York: Cambridge University Press 2005. xii 414 pp. Hardcover. Cloth in dust jacket. New. $10. Hamilton challenges the pervasive assumption that all religious conduct deserves constitutional protection even if it is otherwise unacceptable. The thesis of the book is that anyone who harms another person should be governed by the laws that govern everyone else. This may not sound like a radical proposition but it has been under assault since the 1960s. This book intends to change the course of the public debate over religion by bringing to the public's attention the tactics of religious entities to avoid the law and therefore harm others. unknown books‎

He abandoned his practice when he was appointed to the first chair of Jurisprudence at the University of London in 1826 a post he held until 1835. Reprint of the uncommon first London edition. New Commentaries is an exposition of English law that preserves Blackstone's topical arrangement and the sections from his text that were still relevant in Stephen's day. These are set off with square brackets. A successful work it went through twenty editions by 1938. In the Dictionary of National Biography Dicey observed that "in reality it was an original production differing essentially in character and merit from his predecessor. . Stephen showed the qualities in which Blackstone was comparatively deficient--consummate logical power and singular precision and accuracy of style. Had the work been published as an original treatise it would have stood upon a level with Blackstone's work" XVIII:1047. Laeuchli A Bibliographical Catalog of William Blackstone 511. unknown books‎

In a ringing dissent Justice Alphonso Taft the father of William Howard Taft declared: "This great principle of equality in the enjoyment of religious liberty and the faithful preservation of the rights of each individual conscience is important in itself and is essential to religious peace and temporal prosperity in any country under a free government. But in a city and State whose people have been drawn from the four quarters of the world with a great diversity of inherited religious opinions it is indispensable" 417. Described by David Pannick QC in the Times January 17 2006 as "one of the great works of legal literature of our times." Should horses in Charleston be required to wear diapers Does the 'hotchpot' rule apply when dividing a testator's 17 residuary elephants Which verse in the Old Testament was the life-saving 'neck verse' May sexual intercourse be conducted on a 'without prejudice' basis These questions and many others like them are raised but not always fully answered in A New Miscellany-at-Law. This follows the same style as its two predecessors but consists of entirely new material some of it suggested by the readers of the first two volumes. Like them it collects accounts of strange and remarkable cases striking court-room exchanges wise and witty utterances from the Bench and much else that illumines the law. For the common law world its reach is global with many riches from the USA; and Scotland is not forgotten. Although the book is primarily for lawyers a glossary and explanatory footnotes enable non-lawyers to share in the humour. Some may read the book from cover to cover; but for most there will be the pleasures of browsing often surprisingly prolonged. A New Miscellany-at-Law also includes many other jewels. There is the touching Conveyancer's Ode to His Beloved the court's refusal to consider whether trespassing bees should be classified as invitees licensees or trespassers a deplorable account of a wife being part-exchanged for a Newfoundland dog the future Lord Denning's reference to a wife who 'was actually committing adultery while denying it in the witness box' and 'fustum funnidos tantaraboo' in Chancery. Phillipson addressed the future of international law at a time when many questioned its validity. Although he acknowledges that the war made a shambles of international law he is hopeful that memories of the war's human and material costs when the fighting ends will lead to a renaissance of international law. Indeed he predicts that nations will work to enforce it through a "World Tribunal." His conclusions are based an a careful analysis of the war's causes its immediate effects on combatants non-combatants and prisoners of war. unknown books‎

Smythe sewn light blue cloth bound hardcover with blue and gilt lettered spines. New. $85. Probably originally compiled by John le Breton around 1290 it is the oldest English law book in French. Consisting of French text with parallel English translation and a glossary of French terms this edition edited and translated by Nichols is considered the "standard edition" by Walker. Along with Fleta Britton is one of two significant law books produced during the reign of Edward I 1272-1307. The origins of Britton may be traced to a project of Edward I to produce a digest of the English law in the spirit of Justinian's Institutes. Book One outlines the authority of justices and officers and defines the nature of various personal pleas including pleas of the crown. Book Two describes disseisins and their remedies. Book Three treats intrusions and their remedies. Book Four describes pleas relating to advowsons and the property of churches and of attaints. Book Five outlines pleas of dower and entry. Book Six defines different kinds of proprietary actions. In all this treatise offers an incomparable overview of British law during the medieval era. New. $34.95 A set of biographical sketches of eminent jurists from the 17th through 19th centuries including Lord Bacon John Selden the Earl of Mansfield Sir William Jones and Lord Brougham. Conceived for young readers Adams offers a series of "Great Man" portraits in the manner of Carlyle in the hope that their lives will encourage emulation. Adams 1828-1891 therefore emphasizes the outstanding moral character determination and diligence of his subjects and their crucial contributions to Britain. Like many Victorians Adams feared that the need for professional specialization created by the growth of science and industry would eliminate the type of well-rounded personality dear to the English. This concern is evident in his choice of representative figures. He demonstrates in each case that these were men of many parts and that their breadth of interests contributed to their greatness in the annals of the law. unknown books‎

Fisher 1856-1927 was a prominent historian and lawyer who was admitted to the Pennsylvania bar in 1883 after legal studies at Harvard University. Asserting that the Constitution was neither an imitation nor an invention Fisher traces every material clause back to its origin. Twenty-nine colonial charters and constitutions seventeen Revolutionary constitutions and twenty-three plans of union are the resulting source materials from which Fisher draws his analysis. Abundant quotations from the sixty-nine documents illustrate the evolutionary nature of the Constitution and make this a valuable sourcebook for the reader who desires to find in one volume the Constitution's many and varied origins. unknown books‎

Two of them are careful historical discussions of the origin of the American doctrine that courts can declare acts of the legislature void; a third shows the influence of theories of political philosophy upon the ante-bellum controversy regarding the nature of the Union; and the remaining two consider the significance of American political parties and their real function in popular government. The two papers first mentioned seem to be contributions of great and permanent value to the discussion of their topic. The style of all of these essays is easy and delightful and their argument sane thoughtful and persuasive." J.P.H. Harv. L. New. $29.95 Through the influence of Doctors' Commons and the universities the civilians played an important role in the development of English law especially in the fields of commercial estate and admiralty law. Despite its value study of the civil law had entered a moribund phase by the eighteenth century. Several student handbooks attempted to correct this deficiency and Beaver's translation of Ferriere's treatise is among the best. Accompanied by Duck's learned essay that connects the civil law to the common law the work is among the first in English to establish the confluence of these legal traditions. Also included is Beaver's translation of The History of the Origine of the French Laws Translated from the French by J.B. Esq. Shewing the Analogy of the Laws of the Antient Gauls and Britons. First published anonymously in 1703 it has been attributed to Ferriere Gabriel Argou and Claude Fleury. Claude Joseph de Ferriere ca. 1680-ca. 1748 was a well known French jurisconsult dean of the Faculty of Law in Paris and the author of legal treatises and an important legal dictionary Dictionnaire de Droit et de Pratique. unknown books‎

‎Stone Julius; Benjamin Ferencz New Introduction‎

‎2011. ISBN-13: 9781584776017; ISBN-10: 1584776013. With a New Introductory Essay by Benjamin Ferencz Stone Julius. Aggression and World Order: A Critique of United Nations Theories of Aggression. Originally published: Berkeley and Los Angeles: University of California Press 1958. xiv 226 pp. With a New Introductory Essay by Benjamin Ferencz Paradoxes of a Sharp Legal Mind: Professor Julius Stone and International Aggression. Reprinted 2006 2011 by The Lawbook Exchange Ltd. ISBN-13: 9781584776017. ISBN-10: 1584776013. Hardcover. New. $49.95 A title in The Lawbook Exchange series Foundations of the Laws of War. Efforts to enforce world peace during the twentieth century through international organizations created a demand for a legal definition of aggression. A U.N. committee attempted to provide one in a 1956 report. Stone rejected it for two reasons. Citing a broad array of examples he shows that the concept of aggression eludes definition. More important he argues controversially that a definition is not necessary for the goals of international peace-enforcement. "Professor Stone puts forward his arguments with his usual great learning and persuasiveness; the result is a stimulating and sane study of a problem whose discussion has so often been characterized by sterility and lack of proportion.": John Collier Cambridge Law Journal 1960 1960 247. Julius Stone 1907-1985 is recognized internationally as a leading legal theorist and authority on international law. Educated at Oxford and Harvard Law School he taught at Harvard where he was associated with Roscoe Pound. He went on to become Challis Professor of Jurisprudence and International Law at the University of Sydney. He held the Challis Chair from 1942 to 1972. Upon his retirement from Sydney in 1972 Stone became a visiting Professor of Law at the University of New South Wales. He was the author of numerous books on jurisprudence and international law including the influential The Province and Function of Law 1946 The International Court and World Crisis 1962 Israel and Palestine: An Assault on the Law of Nations 1981 and Precedent and Law: Dynamics of Common Law Growth 1985. The Julius Stone Institute of Jurisprudence was established in 1999 at the University of Sydney. Benjamin B. Ferencz was the Chief Prosecutor. unknown books‎

‎2001. ISBN-13: 9781584771661; ISBN-10: 1584771666. The First Significant Criticism of Blackstone's Commentaries Bentham Jeremy. A Fragment on Government. Edited with an Introduction by F.C. Montague. Originally published: Oxford: The Clarendon Press 1891. xii 241 pp. Reprinted 2001 by The Lawbook Exchange Ltd. ISBN-13: 9781584771661; ISBN-10: 1584771666. Hardcover. New. $29.95 Bentham's first published work an essay on sovereignty that criticizes Blackstone's Commentaries and attacks contemporary views on politics and law. This edition includes F.C. Montague's scholarly introduction that shows the significance of the Fragment and includes a biography of Bentham 1748-1832 and a discussion of his role in the history of jurisprudence. "The Fragment on Government is primarily a criticism. If it were nothing more it would have no interest for later generations which do not regard Blackstone as an authority upon speculative questions of politics or history and therefore do not need to have Blackstone's theories corrected or disproved. But in criticizing Blackstone's views Bentham necessarily expounds his own. As Bentham is one of the few English writers of mark upon the theory of political institutions and as his doctrine forms a link in the chain of English political philosophy we still read the Fragment of Government in order to see not how far Blackstone was wrong but how far Bentham was right.": Introduction 59.
