Woodcut title border composed of ten blocks. incorporating whimsical scenes ornamental borders and at bottom the arms of the Archbishop-Elector Albrecht of Brandenburg gothic types two typographic Fraktur initials. Bound at end is a leaf with a one-page contemporary manuscript commentary wider than the text block and folding. Title-leaf rehinged slightly darkened and with effaced marginal inscriptions initial on A2r hidden in gutter initial on A2v shaved quire E with a couple of small corner repairs. 2 35 leaves of 36 final blank removed. Large woodcut white-on-black pointillé opening initial Fraktur initials throughout. Marginal dampstaining last quire on a guard. Early 20th-century pastepaper over boards manuscript spine label.First Edition of the judicial statutes of the Electorate of Mainz the largest ecclesiastical province of Germany and one of the most prestigious and powerful states of the Holy Roman Empire; bound with the First Edition of the statutes of the lower court of the Mainz Prince-Bishopric or Erzstift. The archbishops under the Holy Roman Empire wielded secular as well as pastoral power. Part of the Emperor's program of consolidation of the far-flung empire was the codification and standardization of provincial laws. Both these procedural codes explicitly adopted the ius commune gemeines Recht a combination of Roman and canon law. Both establish precise rules for court procedure and include copious down-to-earth details including where the courts reside who should serve in them and how trials are to be conducted. As is common for German law books these editions are handsomely printed.1 The Mainz Hofgerichts Ordnung was drawn up in 1516 by Albrecht of Brandenburg Archbishop and Elector of Mainz and by his chancellor Johann Fürderer and approved in 1521 by the Emperor Charles V. The latter's ratification is printed at the beginning and end of the statutes. These cover the location of the court required functionaries a judge and a jury of at least 11 members of the nobility although a Doctor or university graduate would suffice duties of other judicial administrators including the court scribes frequency and timing of sessions and jurisdiction by subject and area. Also included are a dozen varieties of oaths for different court officials including the scribe and for special segments of the population e.g. poor people witnesses legal representatives and Jews for whom there is a special preface to the oath itself in which the Jewish defendant or witness must swear that should he not be telling the truth he must renounce all rights to the Holy Land or to participation in the coming of the Messiah. One statute establishes the right of the poor to legal representation which must be covered by the court. Procedural instructions are provided for every activity and eventuality including the recording of testimony of plaintiffs and witnesses fines and punishments for those who don't show up at court proper written documentation and forms rules for appeals execution of sentences and payment of attorneys. OCLC lists three copies in the US Harvard Law LC and Indiana U. VD 16 M 262; Otto Stobbe Geschichte der deutschen Rechtsquellen 1860-64 2: 410-11.  2 The 1534 lower court rules prescribe further details for the conduct of court business. These include how to handle the "law books" i.e. the court records which are to be maintained in "two volumes with locks kept in a safe place." f. 4r; more procedures to follow for uncooperative defendants a long section: evidently a common occurrence; bonds and bail; more oaths; and formularies for various charges appeals and judgments. These Mainz laws were adopted in 1538 by the archdiocese of Cologne and influenced other lower court statutes including those of Württemberg issued in 1555 Stintzing.OCLC locates one US copy Harvard Law. An important look at New York state in 1850 with some details on government found nowhere else. Bound in 3/4 calf over green paper covered boards red leather label gilt joints are tender wear to corners and spine ends only an occasional spot of foxing more so to endpapers. Autograph Letter Signed by a Drunk Texas Attorney in Rural Robertson County
Wheelock Tx 1855. Very good plus. 4pp. on a bifolium. Previously folded. Light even tanning. An unusual but fascinating 1885 letter by an travelling attorney in central Texas describing some of his experiences there and extolling the virtues of the state to his addressee. Remarkably the author who signs his missive only as "Feeney" seems to become progressively more drunk as he writes and the quality of penmanship and cohesiveness of thought diminish in subsequent paragraphs. Feeney writes from Wheelock a small town north of modern-day College Station founded in 1830 by the grandson of Eleazar Wheelock the scion of Dartmouth and the seat of Robertson County from 1850 to 1856. After a lengthy round of pleasantries he begins to describe his recent experiences practicing law in the state:<br/><br/>"Your letter reached me about a week before the District Court the same as your Circuit Court and at that time I was busy as a recruiting sergeant on a fourth of July - for filing suits and engaging counsel are the orders of the week . and of course I had to be as busy writing - talking electioning and advising as it behoved a law yerling upon his first legs - cases and clients should be ___ Since that time I have been on the 'circuit' transversing for six or eight weeks a territory as large as Alabama - since then making examination speeches - and playing - generally for the past two weeks - I did not get drunk Sir - after my first speech but somehow 'the gentlemen of the jury' 'duly impanelled' &c. and myself happened to come to the grocery at the same time and the records of the grocery show that I stand charged thereto with thirteen drinks - thus I recompenced their intelligence & uprightness in deciding on my side."<br/><br/>Thence Feeney's legibility and cohesion descend somewhat as he becomes apparently inebriated though the letter remains quite readable. In the remainder of his text just over half he gives his impressions and opinions of Texas in the hopes of persuading his acquaintance to try it for himself:<br/><br/>"The wealth of the state at its present status consists principally in cattle sheep horses & hogs and the profit derived from them is compared with farming immense. Cattle double in numbers a profit every three years - horses in less and sheep in less still. Land is a secondary consideration - men that passed as poor and are considered as hardly responsible men . and yet they have a patent for a league of 44411 acres or a half or a thrice any how - for recovering or defending a law suit with difficulty can a fee in money be procured but they will divide the land. I am retained in a case to annul a will - the gentleman told me he would not pay in money - but I might make my own arrangements for the fee in land - yet that same land is the richest I ever saw and worth as much hard cash as any for agricultural purposes can be - I think I never made a better move or performed a wiser trick than when I came to Texas. If my Lucie will only continue. This is in each and every respect the freest country in the world - There is no censorous standard of depredation on the one hand nor puritanism on the other - Yet the law is supreme and the morals are not the worst - Yet it is so in the absence of the restraints generally imposed by ordinance and church discipline." <br/><br/>Only the final paragraph in which he lauds his ability to "ride over the country in his shirt sleeves" and to "sleep upon the prairies" becomes a bit difficult to decipher. Recollections of George Washington Lent Marr Rice 1905 - 1987
Houston Texas: Not Published 1987. 25 pages; typed one side only. Appearing to be a final corrected draft of a group of anecdotes memories of George Washington Lent Marr Rice Jr. The author recounts his birth & early schooldays in Louisiana & Texas. Rice lived in several locations as his father was a construction supervisor for school-building projects for Caldwell Bros. At ten years old the family moved from Jena Louisiana to Beaumont and later Port Arthur Texas; he notes that the schools were closed for several weeks to prevent the spread of the influenza epidemic after the end of WWI. Rice gained a law degree at the U. of Texas and eventually went into practice and became a partner with Butler Binion Rice Cook & Knapp a large Houston law firm. Essentially a collection of anecdotes he recounts his first jury trial involving flimflam artists Standard Oil and land leases. He purchased a farm with frontage on the Trinity River which he unknowingly later sub-let to a member of the "Green Dragon Dope Ring" - the FBI & Secret Service let him know after the fact. Later he describes the 1940s with Butler Binion which was ".experiencing an unexpected volume of work which had developed from clients which included The Houston Post Armco Steel Corp. Sheffield the Jesse Jones Interests Brown & Root.McEvoy Company's contracts for the manufacture of machine gun mounts.Defense Plant Corporation's program for the production of molten iron at the Armco Plant with its requirements of coal leases in Oklahoma and iron ore leases in the North and South Basins of East Texas." The memoir ends abruptly with a group of short snippets about the growth and direction of the law firm. Approx. 8 1/2" x 11" standard white paper sheets stapled top left corner. While Law's fame was based on his A Serious Call to a Devout and Holy Life v. 4 and A Practical Treatise on Christian Perfection v. 3 it was his earlier writing on Mandevilles Fable of the Bees that brought him fame. V.1. Three letters to the Bishop of Bangor. -- v. 2. Remarks upon . the fable of the bee etc. -- v. 3. A practical treatise on Christian perfection. -- v. 4. A serious call to a devout and holy life. -- v. 5. A demonstration of the errors of a late book . and The grounds and reasons of Chrstian regeneration. v. 6. An answer to Dr. Trapp and An appeal to all that doubt . v. 7. The spirit of prayer and The way to divine knowledge. -- v. 8. The spirit of love. -- v. 9. An address to the clergy. His call for wealthy and cultivated readers to renounce the world and follow the gospel met no greater success than it does today for modern readers be they liberals or evangelicals. What many have overlooked was he spent a great deal of time reading Jacob Boheme as well as Madame Guyon and Thomas a Kempis. His small group of followers gave food clothes and money to beggars which was condemned by the established church. As he grew closer to the teachings of Jesus and the writers of the mystical tradition he was persona not grata in the religious world though today he is considered one of the most important writers on Christian devotion. The British National Biography notes that his 17th century devotional work continued even thought John Wesley attempted to abridge his writing. This 1892 is the last great edition of his works. Bound in blue-green cloth spines lettered in gilt dark blue coated endpapers. A very good set with minor wear to spine ends and some staining or rubbing to spines of a few volumes.
