‎Collective Security Under International Law‎

‎2011. ISBN-13: 9781616191825; ISBN-10: 1616191821. Kelsen Hans. Collective Security Under International Law. Originally published: Washington D.C.: United States Government Printing Office 1957. vi 275 pp. Reprinted 2011 by The Lawbook Exchange Ltd. ISBN-13: 9781616191825; ISBN-10: 1616191821. Paperback. New. $49.95. The noted jurist Hans Kelsen advances his theory that collective security is ".an essential function of law national as well as international and that therefore there exists an intrinsic connection between international security and international law; in other terms that collective security of the state is just as collective security of the individual within the state by its very nature a legal problem." Foreword p. ii. "Professor Kelsen's high standing as a scholar is sufficient to commend in advance any volume that comes from his pen. But in this case he has chosen a subject that will at once challenge attention. The main function of the volume in the words of the author 'is to show that collective security is an essential function of law' that it is 'by its very nature a legal problem.' A generation ago there were many in high places to contest the thesis. Today the bitter lesson of two world wars has established the principle for practical purposes in spite of the difficulty of putting it into practice. But the legal aspects of the thesis remain to be clarified and this is what Professor Kelsen does with all his power of legal analysis and systematic presentation. . We must be grateful for what we are given an acute analysis of a fundamental principle the applications of which we can make from our own knowledge of recent history." --C. G. Fenwick American Journal of International Law 52 1958 811. Possibly the most influential jurisprudent of the twentieth century Hans Kelsen 1881-1973 was legal adviser to Austria's last emperor and its first republican government the founder and permanent advisor of the Supreme Constitutional Court of Austria and the author of Austria's Constitution which was enacted in 1920 abolished during the Anschluss and restored in 1945. Biblical Law: Being a Text of the Statutes Ordinances and Judgments Established in the Holy Bible - with Many Allusions to Secular Laws - Ancient Medieval and Modern - Documented to the Scriptures Judicial Decisions and Legal Literature. Originally published: Portland Ore.: Binfords & Mort 1943. xxiv 304 pp. Reprinted 2000 2011 by The Lawbook Exchange Ltd. ISBN-13: 9781616192426; ISBN-10: 1616192429. Paperback. New. $14.95 First edition. Clark offers a systematic presentation of the commandments precedents and customs found in the King James Version of the Bible. Following the organization of a legal text the work is divided into sections on General Principles Political Law Civil Law Economics and Welfare General Laws Penal Law Crimes and Punishment and Procedure and Administration of Law. "`A PANDECT of Profitable Laws against Rebellious Spirits!' Thus the Scriptures are described in the preface to the King James Version. Indeed the Holy Bible is not only a repository of early laws; it is the code at once most ancient and best known by those who have been observers of the Christian Creed; and to it our later laws and governmental processes are in essential and enduring parts immediately indebted. . . . The author in order that Biblical law may be of easy access-has extracted the many commandments precedents and customs which are to be found throughout the sacred writings and has sought to present them logically and systematically in the style of a modern law book." -- Preface v. unknown books‎

‎2011. ISBN-13: 9781616192358; ISBN-10: 1616192356. Kelsen Hans. The Law of the United Nations. A Critical Analysis of Its Fundamental Problems. Originally published: New York: Frederick A. First published under the auspices of The London Institute of World Affairs in 1950. With a supplement Recent Trends in the Law of the United Nations 1951. A critical detailed highly technical legal analysis of the United Nations charter and organization. "A number of reasons why this book is bound to appeal to delegates as a source of quotation. One such reason obviously is the international reputation of its author particularly his prestige in European and Latin American countries. Another is the comprehensive and systematic character of the book which covers almost all of the basic legal problems presented by the Charter. Most important perhaps is the fact that delegates - and other readers - are likely to be impressed with the fundamental approach of the book: its close analysis of the structure of rules and their inter-relationships; the eschewing of political and ideological considerations; the emphasis on legal duties rather than purpose and functions; the awareness of the creative role played by the law-applying organs. These guiding principles which are derived from though not logically dependent on Kelsen's pure theory are welcome elements in a study of this kind; they promise objectivity toughmindedness and technical skill attributes which in a legal treatise will command more respect than idealism or imagination. For these reasons the book may exert a significant influence of developments in the United Nations." --Oscar Schachter 60 Yale Law Journal 1951 189-190. With notes and references to English and American cases. "Of all the French writers upon Commercial Law Emerigon holds the first rank. His writings and his reputation are not confined to France alone for the jurists of Great Britain and the United States have equally derived assistance form his labors and have borne their united testimony to his great learning and diligence. Lord Ellenborough says "who has equaled Emerigon as a theoretical and practical writer on the Law of Insurance He has exhausted every topic so far as materials were within his reach; and upon all new questions his work for illustration and authorities and usages is still unrivalled." Chancellor Kent has spoken with equal warmth and truthfulness of Emerigon for he remarks that his Essay on Maritime Loans "very far surpasses all preceding works in the extent value and practical application of his principles. It is the most didactic learned and finished production extant on the subject. He professedly carried his researches into the antiquities of the maritime law and illustrated the ordinances by what he terms the jurisprudence of the tribunals; and he discusses all incidental questions so as to bring within the compass of his work a great portion of international and commercial law connected with the doctrines of Insurance. In the language of Lord Tenterden no subject in Emerigon is discussed without being exhausted and the eulogy is as just as it is splendid.'"-J. G. Marvin Legal Bibliography 1847 292. BALTHAZARD-MARIE EMERIGON 1716-1785 was the leading French authority on commercial law. His reputation rests on his Nouveau Commentaire sur l'Ordonnance de la Marine. unknown books‎

ISBN-10: 1584778245. Gilt-stamped cloth. Hardcover. New. $40. Sold to the Library of Congress in 1815 to replace volumes burned by the British during their occupation of Washington Jefferson's library comprising 6700 volumes was one of the finest in the United States. The taxonomically arranged catalogue that accompanied these books was a remarkable work one that offered great insight into the broad and systematic nature of Jefferson's mind. Unfortunately it was lost. Using Jefferson's notes and the first edition of the Library of Congress catalogue Gilreath and Wilson recreated Jefferson's original compilation. It contains an extensive collection of legal books arranged under the general heading "Philosophy." Beginning with the broad designations of "Ethics" "Moral Philosophy" "Law of Nature and Nations" and "Religion" Jefferson proceeds to such topics as "Common Law" "Maritime Law and "Foreign Law." It is valuable both for its insights into Jefferson's legal mind and as a guide to the titles one would want to include in a first-class American law library of the period. unknown books‎

New. $24.95 Beard's interpretation proposes that the Framers of the Federal Constitution were motivated primarily by economic concerns. This argument was widely held until the late 1950s when it was gradually undermined by later research much of it stimulated by Beard's work. Although most scholars today see the origins of the revolution in terms of the history of ideas especially republicanism Beard's work remains fundamental and has insured a continued focus on the economic aspect of the nation's establishment as well as a wider awareness of the role of economic interests in history. ‎The Book of Lord Shang. A Classic of the Chinese School of Law‎

‎2011. ISBN-13:9781616191870; ISBN-10:1616191872. Shang Yang. The Book of Lord Shang. A Classic of the Chinese School of Law. Translated from the Chinese with Introduction and Notes by Dr. J.J.L. Duyvendak. Originally published: London: Arthur Probsthain 1928. xiv 346 pp. Reprinted 2011 by The Lawbook Exchange Ltd. ISBN-13: 9781616191870; ISBN-10: 1616191872. Paperback. New. $14.95 Reprint of Volume XVII in Probsthain's Oriental Series. With a Chinese index and an index of names and references. The Book of Lord Shang was probably compiled sometime between 359 and 338 BCE. Along with the Han Fei-Tzu it is one of the two principal sources of Legalism a school of Chinese political thought. Legalism asserts that human behavior must be controlled through written law rather than through ritual custom or ethics because people are innately selfish and ignorant. The law is not effective when it is based on goodness or virtue; it is effective when it compels obedience. This is essential to preserve the stability of the State. Roscoe Pound recommended this book for the study of old Chinese law in Outlines of Lectures on Jurisprudence 5th ed. 235. unknown books‎

Paperback. New. $65. "The oldest Norwegian laws those of Gula and Frosta go back to a time when the culture of the Middle Ages was still a somewhat novel experience in Northern Europe. Though the copies that have survived seem to date from the twelfth century and later the codes must in considerable part have taken form in the eleventh century or as early as the first generation of the Christian age. Heathendom had by that time been outlawed but one seems justified in believing that the cult of strength and valor was for some time yet a force that had to be taken into account; for the principles that governed in the heathen age retained much of their ancient vigor and the old civilization rooted as it was in the soil itself was able in large measure to maintain both life and validity.": Foreword vii. unknown books‎

With a new introduction by Dr. Andreas Rahmatian Senior Lecturer School of Law University of Glasgow. Hardcover. New. $150. "To mould the principles of equity into a regular system was a bold undertaking. The pleasure of novelty gave it a lustre and made every article appear to be in its proper place." --Lord Kames Preface to the Present Edition p. xii. "We must every one of us acknowledge Kames for our master." --Adam Smith. "The Principles of Equity fills the gap between the philosopher who is often creative but not meticulous and the lawyer who is often meticulous but exegetic. Where the lawyer has to be meticulous and creative and needs the approach of an applied philosopher as well as a legal specialist particularly in the role as a legal theorist or as a draftsperson of statutes and contracts he or she will find an excellent teacher in Kames. His work shows that law is not rote learning of statutes and cases and their mechanical application but a craft as a basis for the art of justice a craft that should be rooted more in reason than in authority." --From the Introduction by Andreas Rahmatian. Henry Home Lord Kames 1696-1782 was the leading Scottish jurist of his day and an important figure of the Scottish Enlightenment. He was an important influence on David Hume James Boswell and Adam Smith. unknown books‎

"Few scholars match Warren Billings for the depth and integrity of their research or the elegance of their prose. These essays the fruits of four decades of immersion in technically difficult archives and spanning four centuries of Virginia and Louisiana history gracefully connect often arcane legal processes to the larger cultures in which they were situated. Even scholars well conversant with his work will benefit from having this selection of Billings' essays gathered in a single place. Even scholars well conversant with his work will benefit from having this selection of Billings' essays gathered in a single place. The lead essay a charming and deeply humane scholarly autobiography adds a grace-note to a volume rich in erudition and learning. Scholars of southern history especially will find much to savor in this supe. unknown books‎

‎Grotius on the Rights of War and Peace: An Abridged Translation‎

‎2011. ISBN-13: 9781616191511; ISBN-10: 1616191511. The Abridged Whewell Translation Grotius Hugo. Whewell William Editor and Translator. Grotius on the Rights of War and Peace: An Abridged Translation. Edited for the Syndics of the University Press. Originally published: Cambridge: John W. Parker 1853. xxxix 485 pp. Reprinted 2011 by The Lawbook Exchange Ltd. ISBN-13: 9781616191511; ISBN-10: 1616191511. Paperback. New. $24.95 Reprint of the sole edition of this abridged translation. In this momentous work Grotius describes the situations in which war is a valid tool of law enforcement and outlines the principles of armed combat. Though based on Christian natural law Grotius advanced the novel argument that his system would still be valid if it lacked a divine basis. In this regard he pointed to the future by moving international law in a secular direction. This edition was abridged by removing most of the quotations from "ancient historians orators philosophers and poets" which are identified in footnotes. As Whewell states in the preface they tended to "confuse the subject obscure the reasoning and weary the reader." By removing them he enhanced clarity and reduced the bulk of the work by "more than a half" vi. Originally published in 1625 De Jure Belli ac Pacis On the Law of War and Peace translated by Whewell as On the Rights of War and Peace is widely considered to be the first modern treatise on international law. HUGO GROTIUS 1583-1645 a pre-eminent contributor to international legal doctrine was an influential Dutch jurist philosopher and theologian. William Whewell 1794-1866 wrote on numerous subjects and is known for the breadth of his endeavors and his influence on the philosophy of science. He was one of the founding members and an early president of the British Association for the Advancement of Science a fellow of the Royal Society president of the Geological Society and longtime Master of Trinity College Cambridge. unknown books‎
