Legal and Political Hermeneutics or Principles of Interpretation and Construction in Law and Politics with Remarks on Precedents and Authorities. Enlarged Edition. Originally published: Boston: Charles C. Little and James Brown 1839. xii 13-240 pp. Reprinted 2010 by The Lawbook Exchange Ltd. ISBN-13: 9781616190293. ISBN-10: 1616190299. Paperback. New. $14.95 This work received high praise from Chancellor Kent Henry Clay Rufus Choate Joseph Story and others. At the time of publication there was a great deal of debate about the interpretation of the United States Constitution and this book is Lieber's contribution to that debate. He asserts that Constitutions should be read closely since their words were carefully measured and distinguishes between interpretation "the art of finding out the true sense of any form of words" and construction as the drawing of conclusions respecting the subjects that lie outside the direct expression of the text. "The Hermeneutics was intended as a chapter of his Political Ethics but became so extended that it was published separately. His distinction between interpretation and construction had great influence among legal writers of his day." DAB. Lieber was a professor of history and political economy at South Carolina College and later at Columbia College and Columbia Law School. He is best known for drafting guidelines for the humane conduct of the Union army. One of these General Orders Number 100 better known as the "Lieber Code" was adopted by other nations and formed the basis for such international treaties as the Hague Regulations of 1907. The taxonomically arranged catalogue that accompanied these books was a remarkable work one that offered great insight into the broad and systematic nature of Jefferson's mind. Unfortunately it was lost. Using Jefferson's notes and the first edition of the Library of Congress catalogue Gilreath and Wilson recreated Jefferson's original compilation. It contains an extensive collection of legal books arranged under the general heading "Philosophy." Beginning with the broad designations of "Ethics" "Moral Philosophy" "Law of Nature and Nations" and "Religion" Jefferson proceeds to such topics as "Common Law" "Maritime Law and "Foreign Law." It is valuable both for its insights into Jefferson's legal mind and as a guide to the titles one would want to include in a first-class American law library of the period. unknown books

New. $14.95 Reprint of the third edition. Published after the Glorious Revolution of 1688 brought William of Orange and Mary to the throne but written in the throes of the Whig revolutionary plots against Charles II in the early 1680s John Locke offers a theory of natural law and natural rights which distinguish between legitimate and illegitimate civil governments and argues for the legitimacy of revolt against tyrannical governments. These radical ideas remain influential today. In these two treatises the political philosopher John Locke espouses radical theories which influenced the ideologies of the American and French revolutions and became the basis for the social and political philosophies of Rousseau Voltaire and the United States founding fathers. In the first treatise Locke aims to refute the doctrine of the patriarchal and absolute right of the Divine Right of Kings doctrine put forth by Sir Robert Filmer's Patriarcha. He examines key Biblical passages to prove that scripture does not support Filmer's premise. The second treatise offers Locke's positive theory of government in which he establishes a theory which reconciles the liberty of the citizen with political order. His basic premise is founded on the independence of the individual. He declares that men are born free and equal in their rights and that wealth is the product of labor. In his revolutionary theory of the social contract he proposes that a legitimate civil government must preserve the rights to life liberty health and property of its citizens and prosecute and punish those in violation of those rights. JOHN LOCKE 1632-1704 a leading philosopher of the Enlightenment is widely considered to be the father of liberalism. He was initially trained as a physician receiving a doctorate in medicine at Oxford. He was an important influence on Monte. unknown books

Bullington observes that "the most striking feature about this work is the method of treatment--quite the most effective which has yet been employed in dealing with the subject. Believing that the changes in international law have been the reflection of changes in the political theory and practice of states the author has divided his work into three major periods--the Age of the Prince the Age of the Judge and the Age of the Concert. Based on a wide knowledge of history filtered through an objective and realistic brain this book must take its place as one of the most valuable contributions to the history of international law." Scrutton Thomas Edward

2010. ISBN-13: 9781616190354; ISBN-10: 1616190353. "The Best Essay on This Subject" Scrutton Thomas Edward. The Influence of the Roman Law on the Law of England. Originally published: Cambridge: at the University Press 1885. xvi 199 pp. Reprinted 2010 by The Lawbook Exchange Ltd. ISBN-13: 9781616190354; ISBN-10: 1616190353. Paperback. New. $18.95 Reprint of the sole edition. The extent of Roman influence on English common law long a keenly debated topic was subjected to careful scrutiny during the establishment of modern English legal historiography in the late 1800s. Scrutton's revisionist essay a path-breaking work that won Cambridge University's prestigious Yorke Prize evaluates and mostly discredits the work of his predecessors most notably Finlason Coote and Seebohm. In its place he offers a history from the Saxon period to his day guided by a close reading of sources. Scrutton believed that Roman law was a minor influence until it was introduced to Oxford by Vacarius. It became considerable after that watershed event an argument he advances through a close reading of Glanville and a book-by-book demonstration of Azo's influence on Bracton. "Scrutton has written what we believe to be the best essay on this subject. It will be a useful guide to the authorities for any who are investigating the history of our law while the author's own opinions are for the most part sound and sober and are clearly and modestly stated.": Law Quarterly Review 2 1886 96. unknown books

New. $14.95 "The distinguished English historian Professor Holdsworth has contrived even during his moments of recreation to render us his debtors. No two books outside the bounds of technical law are more worth reading for law students than Pickwick Papers and Bleak House. Even a trained trial lawyer however is puzzled by some of the legal points brought up by Dickens because they have fortunately passed forever out of the realm of living law. Professor Holdsworth has performed a valuable service to lawyers and laymen alike in explaining these obscurities. And he has done much more than this. He has increased our admiration for the genius of Dickens by proving his great merit as a legal historian.": Zechariah Chafee Jr. Harvard Law Review 42:286-8. unknown books
