‎An Act for the more effectual repairing and preserving the Piers and Harbours of Whitby in the County of York‎

‎London: Thomas Baskett 1750. Very good. Folio pp. 661-672 pp. including armorial title; stitch-sewn evidence of having been disbound at some time. An interesting 1750 Act of Parliament relating to the port of Whitby just as it was on the cusp of becoming one of the great shipbuilding ports where famous Australian and Pacific vessels including Cook's Endeavour and First Fleet ships the Golden Grove and the Fishburn were constructed. This Act was instrumental in the repairing of the harbour at Whitby and instituted a series of works which were paid for by the bustling coal trade. The harbour's central importance to Cook's career in particular is well known as it was while working out of Whitby that the great mariner established his credentials and also became enamoured of the sea-going properties of Whitby colliers. Single foolscap leaf printed both faces 2pp. The Beatrice arrived at the fledgling settlement of Adam Bay in northern Australia during late December 1865 delivering supplies to John McKinlay and his exploring party. Contains much good description of Malay trepan traders local Aborigines the fate of the Port Essington settlement and the like. bound with Northern Territory Correspondence. 28th September 1866 No. 80. Foolscap folio tinted 12 pp. A rich source of primary information on the early exploration and settlement of North Australia printing despatches and correspondence from the Government Resident J.T. Manton explorer John McKinlay surveyor R.H Edmunds and others. Of particular interest is the publication of the journal of Clement Young described as 'clerk and accountant' covering the period November 1865 to July of the following year. It contains much detail of contact with local Aboriginal tribes the progress of McKinlay and the myriad challenges of landing and keeping stock in the tropics. Government printer unknown‎

‎Papers relative to the Separation of the Moreton Bay District from New South Wales and the Establishment of a Separate Government‎

‎London: Eyre and Spottiswoode 1858. Tall quarto vi 66pp. last blank with a folding handcoloured map measuring 550 x 405 mm. very good condition. Important collection of parliamentary papers detailing the separation of the Moreton Bay district from New South Wales the precursor to the declaration of Queensland as a discrete colony in December 1859. The papers include a significant Arrowsmith map of the region proposing new border divisions coloured by hand. In 1851 the first Moreton Bay representative was appointed New South Wales parliament; by 1858 nine members represented districts north of the Clarence River. The isolation of the settlement from Sydney brought a sense of neglect alongside serious administration problems motivating squatters and free settlers towards political self-determination. The large folding map bound into this report was printed by renowned London cartographer John Arrowsmith. It is dated January 1858 and titled Map shewing the proposed boundary between News South Wales and the Moreton Bay Colony and the proposed division of that Colony into Electoral Districts. The new border between the two colonies is handcoloured red and yellow and runs along the 29th parallel until following the course of the Barwon and Dumaresq rivers. Electoral districts north of the border are coloured in green while those in New South Wales are yellow. The map details the entire coastline from the mouth of the Clarence River at Shoal Bay to Cape Gloucester near present day Bowen above the 20th parallel. The report presents a rich and varied collection of documents illustrating both sides of a contentious debate. Petitions for and against separation from all the northern districts are included some of which shed valuable light on local aspirations for political self-determination. The issue of debt features prominently given the colony of New South Wales carried the considerable burden of £2234700; accordingly several of the submissions included in this report discuss how this is to be shared with the nascent Moreton Bay Colony. Likewise the resumption of transportation is openly broached in the report - an important issue given the history of Moreton Bay as a destination for violent recidivists until abandoned for this purpose in 1839 in favour of Port Arthur. Although the township at Moreton Bay had existed as a free settlement for some years squatters desired a return of transportation to solve the shortage of labour. Ultimately the colony of Queensland was formed without a resumption of transportation to the eastern seaboard of Australia. Eyre and Spottiswoode unknown‎

‎Report from the Select Committee on the Conduct of General Darling while Governor of New South Wales. With the Minutes of Evidence and Appendix‎

Marginal water-stain affects the last twenty or so leaves title-page thumbed with small loss of a little letterpress due to past adhesion; a good copy overall. Foolscap folio iv 168 pp. in handsome quarter brown calf with gilt label. This report clears former governor Ralph Darling now promoted to General of the serious charges brought against him during the impeachment instigated by William Charles Wentworth. The charges concerned several matters namely the dubious nature of grants of crown land made by Darling the case of Captain Robert Robinson and the mismanagement of funds for the New South Wales Veteran Companies and also Darling's attempts to limit the freedom of the public press. The most serious and controversial of the charges related to his harsh disciplinary treatment of the two soldiers Sudds and Thompson which resulted in the death of the former. The Select Committee cleared Darling of wrongdoing and here publishes their findings along with the testimonies provided during the investigation. With regards to the military punishment the Committee ruled 'the conduct General Darling with respect to the punishment inflicted upon Sudds and Thompson was under the peculiar circumstances of the Colony especially at that period.entirely free from blame'. Ferguson comments that this report is 'An extremely important source of information with reference to this famous case.' Parliamentary printing of correspondence relating to the foundation of the Van Diemen's Land company published within months of its ratification. The report publishes four letters between Earl Bathurst and Edward Curr Secretary of the Van Diemen's Land Company and former Lieutenant-Governor William Sorrell. The Van Diemen's Land Company was founded along similar lines to the Australian Agricultural Company - vast areas and surplus convict labour could be brought to profitable advantage with a Company to attract investors into the fold. The Company was offered vast tracts of land beyond existing settled areas and opened up lands previously unseen by European eyes. A significant publication in the early history of South Australia being the first report of the Colonization Commission tasked with selling land in the infant colony to provide the capital for colonial development. The sale of land in South Australia owed much to the 'science of colonial management' propounded by Edward Wakefield Gibbon and within a decade was confounded with difficulty as the colony accrued massive debt from the British government. This report publishes important correspondence relating to the early survey including the letters of instruction to Surveyor-General William Light and his assistants including Boyle Travers Finniss. The lithographed map by Arrowsmith is titled "Part of Southern Australia from the 132 to 141 degree of East Longitude". Boothby challenged the interpretation and application of Colonial law drawing the ire of parliamentarians and the general public alike. He created further contention through meddling in politics and was publicly lambasted during several trials where it was asserted he used coercion to control the decision of the jury. Preliminary leaves bear the neat stamps of the Birmingham Law Society likewise gilt blocked to the front board very good in original brown cloth rebacked. Foolscap folio 162 pp. original brown cloth. Historically informative report on "secondary punishments" meted out to repeat offenders already within the prison system most famously within the Australian context Norfolk Island and Port Arthur. As a matter of course the reports include significant notice of transportation inland settlement the granting of land and also relations with Aborigines. The 1832 companion follows directly on from that of the previous year and begins with notice of the pressing urgency of further investigation and reform before presenting its own series of interviews including a repeat performance by the prominent viticulturist James Busby. Those who provide testimony for this report are a fascinating lot and include the botanist Allan Cunningham and the magistrate John Stephen. For the first time several people involved with the prison hulks were called in and even some prisoners were allowed to speak including a remarkable interview with one "A.B." who had been confined on the Hulk Retribution at Sheerness for six years awaiting transportation. ‎An Act for abolishing Capital Punishment in case of returning from Transportation. Cap. LXVII‎

‎London: George Eyre and Andrew Spottiswoode 1834. Folio sheet pp. 525-526 armorial letterhead recent green boards bookplate of H. Mackenzie-Begg. A rare instance of clemency: this Act repeals previous legislation ordering the execution of escaped convicts 'at large within any Part of His Majesty's Dominions without some lawful cause'. Much of the appeal of New South Wales as a place for transportation lay in its isolation and the great difficulty of escape. Nonetheless some convicts did make the attempt and a handful successfully absconded aboard merchant vessels visiting Sydney Harbour. One famous example is the 'Scottish Martyr' Thomas Muir who slipped aboard the American trader Otter in early 1796 it was rumoured that Muir a political radical had appealed to the republican sentiments of the American captain to negotiate his transport from the penal colony. In addition to repealing the death penalty for escapees the Act ameliorates punishment for those convicted of harbouring or assisting an escaped convict. Recommendations of the Select Committee principally involve disallowing certain persons from claiming compensation while awarding 150 to Dr. Carr 'at present an inmate of the Lunatic Asylum Yarra Bend' for providing surgical services to the wounded. The Minutes of Evidence record the testimony of Resident Goldfields Commissioner Robert Rede regarding Bentley's Hotel a highly informative record of the tumultuous events running into five pages. The appendix exceeding 300 pages includes testimony from all the major players in the establishment of the colony - the Wakefields George Grote Robert Torrens George Grey and many others. The four maps maps are of interest to the survey and settlement of the city of Adelaide providing a record of land division and settlement immediately adjacent to the city centre. An excellent copy of a rare report printing a decade of major dispatches from New South Wales Governors on the subjects of the Aborigines of New South Wales. In this report are included reports from Macquarie Brisbane and several by Darling. Macquarie reports the Reverend Cartwright's "Native Institution" at Parramatta in a report which prints two of Cartwright's letters dated 1819 & 1820 while the despatches of Brisbane and Darling chiefly deal with the work of the London and Church Missionary Societies most notably the travails of the Missionary and early linguist L.E. Threlkeld including comments on his work in preparing grammars and translations. The work was prepared at the request of Henry Grey Viscount Howick in his capacity as Under-Secretary of State for War and the Colonies. 23 September unknown‎

‎An Act to amend an Act.for the Transportation of Offenders from Great Britain; and for punishing Offences committed by Transports kept to labour in the Colonies. Cap. XXXIX‎

This Act contains a variety of new laws relating to the Australian colonies with special reference to the ongoing problem of liquor smuggling in convict establishments. The sixth clause of the act expressly forbid the provision of liquor and fermented products of any description to felons convicted of transportation. It is clearly aimed at those found guilty of smuggling liquor to convict establishments and places of confinement. The trade in sly grog had been lucrative from the earliest days of the colony and in the lead up to the so called 'Rum Rebellion' under Governor Bligh officers of the New South Wales Corps were implicated in the trade. This act tightens up existing prohibitions and stipulates that those suspected of provisioning liquor to convicts can be detained in custody for up to three months unless able to pay an immediate surety of between 10 and 20 pounds. Other clauses empower the Governor of New South Wales to transfer convicts ambiguously charged with 'disorderly conduct' to other colonies namely Van Diemen's Land. Presumably this was enacted to break up groups suspected of sedition and troublemaking. Likewise the Act allows the Governor to take felons intended for other destinations 'if he shall deem it expedient' and also clarifies legal confusions arising from the delivery of convicts to the wrong location by transportation contractors. Of some historical interest is information on emigration including the details of pauper emigrants to South Australia and the costs incurred during their settlement. The South Australian Company raised an emigration fund from land sales and this report details the distribution and expenditure of this considerable pool of capital.
