Petition highlighting the miseries and privations of the miners at the new township of Mount Ararat in Victoria and asking that every miner be allowed to occupy and cultivate an acre of Crown Land. Ararat was first settled by Europeans in the 1840s after the surveyor Thomas Mitchell passed through the area in 1836. It was in 1857 that a group of Chinese miners en route to Central Victoria struck gold at the Canton Lead making it the only city in Australia to be founded by the Chinese. This petition then dates from the very beginnings of the development of Ararat and deals particularly with the poor diet of the miners 'the impossibility of obtaining a proper quantity of vegetable food' but also highlights the relative poverty of the small society at Mount Ararat where 'profits are too frequently the price of virtue.'. ‎An Act for the further Preventing Robbery Burglary and other Felonies and for the more effectual Transportation of Felons.‎

The First Transportation Act of 1718 which allowed courts to sentence convicts to seven years in America in order 'to deter criminals and to supply the colonies with labour' Shaw Convicts and the Colonies p. 25. This Act which first formally involved the British Government in the practice of transportation was discontinued with the War of Independence in 1776 but lay at the heart of the renewal of the practice in the mid-1780s when the colony in New South Wales was being planned. As a result this Act should be considered central to the pre-history of Botany Bay. The Act begins lamenting the present state of affairs where thieves sent to the West Indies regularly return to crime with a high incidence of capital punishment for such reprobates. This dire situation is contrasted with a significant labour shortage: 'in many of His Majesty's colonies and plantations in America there is a great want of servants who by their labour and industry might be the means of improving and making the said colonies and plantations more useful to this nation.' Although now formalised as government policy this Act would still rely on private merchants who could moreover profit from the sale of the convicts once they had arrived in the New World. As a result the Act promotes transportation to America for a term of seven years as an alternative to the usual punishments for larceny - flogging branding of the hands or confinement in workhouses and other penitentiaries. Significantly it notes that those found guilty of crimes previously punished by death specifically the purchase and resale of stolen goods could now be eligible for transportation and labour for a period of fourteen years. Of additional interest are clauses stipulating the terms and conditions of return to the United Kingdom upon completion of the transportation sentence including costs to be incurred by the ex-convict. An important Act for the future subdivision of New South Wales into separate colonies namely Victoria in 1851 and Queensland in 1859. The Act describes the possible need for separation given the 'great extent' of New South Wales as the entire eastern portion of the Australian continent. Governing this vast area from Sydney posed serious problems of communication and effective administration and discontent with the existing system was becoming increasingly obvious by the time this Act was passed in 1840. This Act allows Queen Victoria to appoint Legislative Councils for the new colonies who may draft new laws subject to approval before parliament in Britain. This provision was to be especially important in the case of Victoria where separation from New South Wales was soon followed by the gold-rushes. Rare: with the same short-title as the Transportation Act of 1718 this is the first significant amendment of that Act giving details of the institution of transportation and relating some new additions to the types of crime punishable 'whereas the laws in being have not yet proved effectual to the suppression of Robbery Burglary and other Felonies.'. This Act gives more concrete information regarding the ways in which anyone convicted of the type of crime by which 'they may be sent or transported to any of His Majesties Colonies or Plantations in America' is to be treated including details on their status while pending transportation and the penalties due to any person who seeks to assist or rescue these felons. Uncommon: a significant eighteenth-century Act of Parliament amending and continuing the practice of transportation. It was in 1784 that the English government proclaimed the legal reinstitution of transportation with "An Act for the effectual Transportation of Felons and Other Offenders" Ferguson 3 and its companion Act for Scotland Ferguson 4bb. These two 1784 Acts laid out all of the basic conditions of transportation but interestingly had time limits imposed which meant that they could not last indefinitely and that continuations were required periodically. An Act extending the use of transportation as a form of punishment in the army during periods of grievous unrest and mutiny. With regards to the transportation of felons this Act gives the Secretary at War or his deputy the same powers as the Commander in Chief of the Kings armies in Great Britain and Ireland. The Act was generated to avoid confusion of jurisdiction in the event of there being no acting Commander in Chief. By assuming the powers in this Act the Secretary at War can notify the king of sentences of transportation passed and reciprocally he is empowered to inform mutineers charged with death of the Royal pardon. Tall quarto volume containing two above-titled publications relating to convict transportation; bound with other material related to Scottish prisons Poor Relief and other legal matters; all in fine condition green cloth with red leather spine label. A fascinating selection of documents relating to the last years of convict life in Australia. This collection of bound parliamentary papers contains two publications titled 'Further Papers on the Subject of Convict Discipline and Transportation' dated July 1863 and February 1864 respectively. Both print a selection of correspondence between Australian Governors and the Secretary of State regarding the convict system. At this stage transportation had ceased to all colonies excepting Western Australia where it continued on a limited scale until 1867. Accordingly these two publications form a detailed record of the final years of the convict system in Western Australia. Aside from discussion of finance and logistics several of Governor Hampton's dispatches concern the selection of men best suited to the conditions of his colony. Much of the success of transportation to Western Australia lay with the selection of men suitable for assigned labour and the relatively lenient ticket-of-leave system here practised in contrast to the indiscriminate transportation of large numbers of felons to Van Diemen's Land in the 1840s that caused widespread social upheaval and disruption. Of additional interest is a dispatch titled 'Breaking up of the convict establishment at Bermuda and transfer of Prisoners to Western Australia' that includes correspondence between the Governor of Bermuda and the Secretary of State on the subject. Dispatches from Tasmania include a report of three pages on the convict establishment at Port Arthur followed by a breakdown of the number and description of convicts for the year 1862. Overall correspondence from the Governors of other Australian colonies report widespread public hostility to any possibility of a return to the convict system. Fuelled by rumours that transportation was once again before British parliament for consideration these 'Memorials against Transportation' played an important part in forming a confident and distinct Australian national identity. Two very rare reports setting out the earliest official information on the Swan River colony to be published in England. The reports were published within a fortnight of each other in 1831 and print a wealth of information from the new colony. The first report begins with a list of the vessels sent to Swan River headed by the Parmelia the salaries of the main officials and a long and informative dispatch from Governor Stirling to Sir George Murray. The report concludes with abstracts of settlers from the General Muster Book other settlers and a list of land claims. The second report is even more detailed printing material by some of the most important settlers. Of note is a letter from Stirling two succinct but important reports of inland exploration including one to Cape Leeuwin undertaken by the indefatigable John Septimus Roe and a third report by Lieutenant Dale the officer responsible for the famous King George's Sound then part of the Swan River Colony panorama but here describing an expedition east of the Darling Mountains. The report concludes with a fourth notice of a series of attacks made on Lieutenant Dale's party by local tribesmen written by F. C. The purpose of the act is to pay for the use of ships during the war: "Whereas for the reducing of the Kingdom of Ireland to its due obedience to his majesty several ships of his majesties subjects were hired for transporting forces ammunition and provisions into the said kingdom". The rest of the money is to go to the crown. It is interesting that the duties are to be applied to goods imported into England Wales and specifically Berwick upon Tweed.
