L’opera esamina la storia e le condizioni dell’istruzione pubblica (soprattutto primaria e secondaria) nel ducato estense dal 1772 (anno in cui fu promulgata la Costituzione di Francesco III relativa al regolamento universitario) sino all’annessione del ducato al Regno d’Italia (marzo 1860). Volume N. 12 appartenente alla Collana: Biblioteca di filosofia e di pedagogia. Scrive Formiggini in Trent’anni dopo, parlando degli inizi suoi e della Collana: “Come spesso accade agli esordienti, non avevo ancora una meta preordinata, e mi sembrò di fare una gran bella cosa iniziando, nel 1908 (fino al 1920), col Saggio di una bibliografia filosofica italiana compilato da Alessandro Levi e da Bernardino Varisco, con la collaborazione di E. Prima trad. italiana dell'opera di questo importante pedagogista tedesco (1869-1966), punto di riferimento della pedagogia cattolica laicale, che si impegno' per l'introduzione di un pacifismo etico nell'educazione e nella didattica. La sua dottrina pedagogica si ispirava all'ideale della totalita' armonica della persona e sull'accettazione della trascendenza cristiana. In quest'opera sostiene la necessita' dell''umanizzazione della punizione' che non equivale alla 'mollezza'. Il detenuto deve ritornare alla societa' 'non gia' rintontito, ma anzi rianimato [...]. La pena deve avere il significato d'un dolore o d'una rinuncia [...] ma e' inutile, anzi addirittura dannoso il deprimere in qualunque modo l'animo del prigioniero colla tetraggine dell'ambiente, colla nudita' dell'arredamento della cella, col trattamento ruvido e sprezzante'. L'A. mette in rilievo come tutta la letteratura carceraria americana sottolinei l'esigenza che i funzionari trattino il prigioniero fair and gentlemanly. Nelle migliori prigione americane, ad esempio, il direttore ha una cassetta per le lettere nella quale i prigionieri possono depositare i loro reclami.
