2018brossura Il libro propone alcune riflessioni critiche sulla legge n. 219 del 22 dicembre 2017: "Norme in materia di consenso informato e di disposizioni anticipate di trattamento", che ha come elemento principale il biotestamento. Il testo, secondo l'autore che è a favore di questo diritto del malato, è scritto però con un linguaggio nebuloso, spesso ambiguo nei concetti espressi, e di conseguenza, variamente interpretabile. Di conseguenza inganna il cittadino, tradisce il malato e umilia il medico e soprattutto stravolge la sua plurimillenaria funzione e la sua professione che è quella di curare in "scienza e coscienza" ogni paziente. Queste affermazioni sono giustificate anche da un ampio excursus con il parere di vari esperti. L'auspicio che è che la legge sia emendata e modificata in quelle parti che potrebbero indurre il malato a scelte non volute ma condizionate e soprattutto venga ristabilita quell'alleanza fiduciaria o terapeutica tra medico e paziente, base di ogni cura.

Il 16 gennaio 2018, è stata firmata la legge n. 219 del 22/12/2017, più comunemente conosciuta come la legge sul biotestamento volta, infatti, ad indicare le norme in materia di consenso informato e disposizioni anticipate di trattamento. Questo breve commento alla legge intende essere un sussidio che offra delle chiavi di lettura su alcune criticità che il testo legislativo presenta, in un quadro complessivo comunque accettabile. L'auspicio è che quanti sono chiamati ad essere guide, nella formazione delle coscienze, possano ravvisare in questo strumento un valido aiuto, così da poter declinare la fede nelle nuove sfide del mondo di oggi. All'interno è riportato il testo integrale della legge in oggetto.

2017Scegliendo come fil rouge la distinzione uccidere/lasciar morire, il volume affronta le principali problematiche del fine vita. Nello specifico, l’autrice si chiede se abbia senso distinguere l’uccidere dal lasciar morire oppure se il provocare la morte di un paziente (per esempio attraverso la somministrazione di sostanze letali) e il lasciarlo morire (mediante il mancato avvio o la sospensione di un trattamento di sostegno vitale) siano da considerarsi delle azioni moralmente equivalenti. Il testo prende le distanze da due posizioni molto nette che sono tra loro opposte. Da un lato infatti si rifiuta la tesi secondo la quale uccidere e lasciar morire sarebbero degli atti moralmente equivalenti perché danno luogo alle medesime conseguenze (la morte altrui); dall’altro si ritiene che non sia neppure giustificata la tesi della sussistenza di una differenza morale assoluta, che renderebbe sempre illecito l’uccidere e sempre lecito il lasciar morire.
