‎Umschlag mit leichten Randläsuren, ansonsten altersgemäß tadelloser Zustand - Unter dem mittelalterlichen ?Leihezwang? versteht man allgemein einen Rechtssatz, der die deutschen Könige seit der Stauferzeit verpflichtet habe, freigewordene Reichs- fürstentümer und -grafschaften innerhalb von Jahresfrist wieder als Lehen zu vergeben. Vakante Fahnlehen zum unmittelbaren Krongut zu schlagen und die Zentralgewalt auf diese Weise zu stärken, sei den Königen verwehrt gewesen. Man schiebt heute diesem Gesetz gern die Schuld daran zu, daß dem deutschen Königtum - im Gegensatz zur französischen Monarchie - im Mittelalter und in der frühen Neuzeit der Aufbau eines geschlossenen Einheitsstaates nicht gelungen sei. -- Der Verfasser untersucht dieses Problem auf breiter Grundlage und stellt fest, daß die communis opinio der wissenschaftlichen Forschung hier irrt. Der Satz vom Leihezwang hat niemals reichsrechtliche Gültigkeit besessen, und die verschiedene Entwicklung in Deutschland und Frankreich ist auf andere Ursachen zurückzuführen. So erinnert der Verfasser besonders daran, daß Deutschland immer ein Wahlkönigtum hatte, während in Frankreich die Thronfolge erblich war. -- Um die Resultate seiner Forschung zu erhärten, erstreckt der Verfasser seine Untersuchungen auf die gesamte Lehnspolitik der deutschen Könige und auf die vielschichtigen Fragen der Erblichkeit der Reichslehen von ca. 1150 bis 1792. He was born in Goshen, Connecticut on January 25, 1749. He attended Goshen Academy and graduated from Yale College in 1770. He taught school, studied law in Litchfield, Connecticut, was admitted to the bar and commenced practice in Hartford. He moved to Springfield, Massachusetts in 1784, was elected a member of the Massachusetts House of Representatives, and served in the Massachusetts State Senate. He was a justice of the court of common pleas of Hampshire County, and was elected as a Federalist to the Fourth, Fifth, and Sixth Congresses and served from March 4, 1795, until November 6, 1800 when he resigned.
