The great commercial struggle between France and England ca. 1807-1812 with tit-for-tat blockades Napoleon's Berlin Decrees and the so-called Continental System and British Orders in Council probably served little more than to damage both inter-European and American trade with Europe for a decade. The present detailed analysis unfortunately unidentified with an author or editor appears to be of some value as a contribution to the commercial history of this period. The author attempts primarily to address two cogent questions much debated at the time by the political and commercial classes. These questions asked whether neutrals were mistreated under international law on the one hand and whether the Orders in Council were consistent with the municipal law of England. Nous présentons la édition de ce traité, paru du vivant de l’auteur et complété par lui. Si les juristes des périodes postérieures, et spécialement du XVIIIe siècle, ont parfois contesté l’exactitude des citations des arrêts faites par Papon, l’intérêt principal de ce recueil est de donner une vue des plus complètes, et en français, de la jurisprudence des parlements de la première moitié du XVIe siècle. R. Martinage souligne, en particulier pour la matière du droit pénal, que les arrêts de Papon « n’illustrent pas seulement le combat entre la doctrine savante et la nouvelle législation, mais plus traditionnellement aussi la conciliation entre la doctrine et l’usage national. » (in Les recueils d’arrêts et dictionnaires de jurisprudence, Éditions La Mémoire du Droit, Paris, 2005, p. 240 et suiv.) S’il est vrai que par certains aspects, le texte porte encore la marque, un peu comme la Somme Rural de Bouthillier, des conceptions médiévales du droit, il n’en est pas moins des plus accessible (v. par ex. le livre Xe sur les "obligations exécutoires" qui constitue une exposition raisonnée du droit des contrats).

Il fut initialement publié en 1596 en Latin sous le titre Rerum judicatarum libri IV, puis traduit en français dès 1611 par Gabriel-Michel de La Rochemaillet et en 1623 par J. Tournet. Dupin n° 1337. Cette édition manque à la BNF et à Cujas.
