Il s’agit d’une description du système parlementaire anglais. « Lothar Bucher continue là où Venedey s’arrête. Il décrit le parlementarisme – sous entendu le parlementarisme anglais. En Allemagne, le terme parlementarisme désigne le système que les Anglais et les Américains appellent le “constitutional government”. Bucher en fait la différence par rapport au constitutionnalisme d’origine française ou belge. Le système politique et sociétal de l’Angleterre, qui s’est naturellement développé et qui est basé sur un certain nombre de compromis est comparé à celui de la France tendant à l’unilatéralisation et à la systématisation (die “Spinnmaschine des Bonapartismus” [la filiation/rouet du bonapartisme]. Les Allemands, par contre, tendent à la théorisation, à l’unilatéralisation émotionnelle et à la recherche de l’idéal, et ceci assez fréquemment dans leur analyse du système anglais et de sa constitution politique. Bucher lui-même succombe à la mode actuelle en introduisant des termes technico-scientifiques. Son hypothèse va jusqu’à envisager peut-être un jour un calcul mathématique de l’évolution historique. Bucher (1786 - 1854) begann sein Studium in Marburg bei Savigny und promovierte bei seinem Vater, Johann Peter Bucher, damals Professor in Marburg. 1808 von König Jérôme zum Ordinarius an der Universität Halle ernannt, wechselte er 1818 an die Universität Erlangen. Mit seiner Monographie über das Recht der Forderungen legt Bucher - mehr als 200 Jahre nach dem grundlegenden Werk des Gemeinrechtlers Francisco Salgado de Samoza (de cessione iurium et actionum) - eine umfassende Darstellung dieses für das gesamte Zivilrecht zentralen Rechtsgebiets vor und gibt dessen nunmehr erreichten Zustand wieder, der sich von den römischen Grundlagen aus seit dem Mittelalter in besonders hohem Maße fortentwickelt hat. Die Schrift wurde 1830 noch einmal aufgelegt. Zu seinen sonstigen Werken gehören ein "System der Pandekten" (1808 und öfter) und eine "Systematische Darstellung des im Königreich Westphalen geltenden napoleonischen Rechts" (1809). Außerdem hat Bucher die letzten zwölf Bände der vorletzten Nürnberger Ausgabe des Zivilrechtskommentars von Hugo Donellus herausgegeben (1822-1834). Dès le début de son règne Justinien s’applique à la mise en oeuvre d'une grande réforme juridique. Diverses commissions sont chargées de remettre de l’ordre dans l’ensemble des constitutions impériales publiées depuis Hadrien. Cette réorganisation, le Corpus Juris Civilis, est ce que nous appelons le Code Justinien. En 533 est publié aussi le Digeste (ou Pandectes), qui correspond à une modernisation de toute la législation antique ainsi qu’à une synthèse de la jurisprudence antique. À cela s’ajoute un manuel pour enseigner le droit, les Institutes. Les Institutiones ou Elementa forment la première partie du corps de droit de Justinien et servent, pour ainsi dire, d'introduction aux trois autres : le Code, le Digeste ou les Pandectes et les Novelles. C'est à la fois un texte de lois, puisqu'il a été promulgué, et en même temps un livre didactique, puisque Justinien a ordonné de le composer pour faciliter l'enseignement et l'étude du droit. Il contient, outre le préambule, quatre livres : le premier traite des personnes; le deuxième, des choses (propriété et diverses manières d'acquérir, servitudes, prescription, testaments); le troisième, de l'hérédité, des obligations et des contrats; le quatrième, enfin, des obligations provenant d'un délit ou d'un quasi-délit et des actions.
