Col crimine nasce l'uomo
br. Psicoanalisi e criminologia condividono da sempre una logica comune: quella che con Freud possiamo definire come effetto del disagio della civiltà. Le due pratiche, distinte nelle loro modalità e finalità, trovano un asse comune nell'intreccio colpa-responsabilità-legge, portando da un lato al percorso di reintegrazione sociale, dall'altro all'assunzione della responsabilità soggettiva. Le riconfigurazioni contemporanee del disagio interrogano però oggi in maniera nuova l'esercizio dell'analisi come anche quello della criminologia. I testi qui raccolti provengono dalle discussioni nate durante un Seminario organizzato dalla Segreteria milanese della SLP insieme al Dipartimento di Scienze Biomediche per la Salute, dell'Università degli Studi di Milano.

Donne violenza e ancora violenza. Al di là della pena e del biasimo
br. A fronte di un dibattito pubblico che alterna giudizi che vanno dalla pena alla compassione, dalla sfiducia al biasimo nei riguardi delle donne maltrattate e del comportamento che esse assumono in risposta alla violenza subita, in questo saggio si considera un modo alternativo per indagare il fenomeno della violenza domestica e tentare di capire l'esperienza vissuta dalle vittime degli abusi. Anziché avventurarsi - come generalmente accade sul terreno scivoloso che si apre davanti alle tradizionali domande di senso comune, l'autrice prova ad analizzare il caso della violenza domestica in riferimento al concetto di libertà e i suoi vincoli. La tesi di fondo che si intende convalidare è che un'indagine sulla libertà e sugli ostacoli che le donne (in quanto tali e non solo quelle direttamente esposte ai maltrattamenti) incontrano nel compiere le proprie scelte ha il vantaggio di rendere conto delle decisioni e delle azioni delle vittime di violenza senza mai pretendere di spingere l'interpretazione nel profondo della psiche soggettiva.

Violenza e democrazia. Psicologia della coercizione: torture, abusi, ingiustizie
br. Democrazia è parola mimetica, spesso asservita alla retorica dei potenti. Tra i fenomeni disturbanti nascosti dal mantello mimetico della democrazia c'è la coercizione, agita con la minaccia, la punizione e l'uso della forza fisica. Anche in uno Stato di diritto, l'apparato di coercizione che può essere dispiegato contro i cittadini è imponente. Nell'esercizio di un simile potere, le autorità devono autodisciplinarsi per non oltrepassare il limite della legittimità, pena il rischio di trasformare la coercizione in violenza. Il libro analizza questo crinale scosceso portando il lettore in una stanza di tortura, mettendolo di fronte agli abusi delle forze di polizia, invitandolo nei reparti psichiatrici che praticano la contenzione meccanica, e infine chiamandolo a misurarsi con i costi umani generati dal neoliberismo. Un percorso assistito dalla convinzione che i contributi offerti dalla psicologia sociale aiutano a comprendere e gestire i conflitti tra libertà e coercizione in democrazia.

Attraverso la problematizzazione del concetto di maschilità e del posizionamento teorico dei maschi all'interno del discorso socio-criminologico, il saggio mostra come il comportamento deviante e/o criminale "maschile" non possa essere interpretato facendo riferimento a predisposizioni naturali, a caratteristiche innate o a meri condizionamenti ambientali. Governare il conflitto. La criminalizzazione del movimento No TAV
br. Straordinaria attenzione mediatica, cinquanta procedimenti penali, più di 1.500 indagati, un maxiprocesso con 53 imputati, carcerazioni preventive e accuse di terrorismo: queste le principali caratteristiche della criminalizzazione del più longevo e pervicace movimento sociale in Italia. Fenomeni simili sono diffusi a livello internazionale, laddove progetti dal forte impatto ambientale, come le grandi opere, incontrano l'opposizione delle popolazioni, una resistenza a cui si risponde sistematicamente con la gestione penale del conflitto. Qui il potere giudiziario s'inserisce nella dinamica politica e non opera un bilanciamento fra diritti in cui anche l'opposizione riceverebbe tutela; al contrario, tende a proteggere la società da questo dissenso e a difendere le scelte di politica economica dello Stato. Una lettura inedita della criminalizzazione dei movimenti sociali che sviluppa la strategia dell'accerchiamento teorizzata da Foucault e costituisce il primo tassello di una genealogia del principio di difesa sociale.

Rosemarie. La figlia più amata del miracolo tedesco
br. Era il 1° novembre 1957 quando Rosemarie Nitribitt veniva trovata strozzata nel proprio appartamento di Francoforte. La prematura scomparsa della cocotte di lusso, famosa per la clientela di magnati dell'industria e per l'inseparabile Mercedes 190SL, ebbe un forte impatto mediatico: i giornali si prodigarono in rivelazioni piccanti e le indagini sul delitto appassionarono per mesi l'opinione pubblica della Germania occidentale. Tuttavia, come nel caso italiano della ventunenne Wilma Montesi (1953), l'assassino è rimasto ignoto. Da protagonista di un episodio di cronaca nera, Rosemarie è diventata il simbolo di ciò che sta dietro la facciata del miracolo economico tedesco grazie all'interpretazione critica che il giornalista Erich Kuby diede del delitto e del suo contesto. Questa è stata accolta con enorme successo sia nella versione cinematografica (La ragazza Rosemarie, 1958, regia di Rolf Thiele) sia in quella narrativa.

Descrizione di una battaglia. Attori e strategie della prova in un processo per femminicidio
br. Spostando l'attenzione dalla dimensione della verità a quella della veridizione e analizzando la sentenza come una battaglia dialettica che ridefinisce i confini delle identità degli attori coinvolti, il libro propone l'esame di un caso di femminicidio andato in giudizio nel dicembre del 2015. È l'omicidio di una donna che viene insolitamente definito dai giudici come un femminicidio e il cui movente è rinvenuto nel desiderio di possesso dell'omicida nei confronti della vittima. Un caso del quale la cronaca si è poco occupata, anche per il basso livello socio-economico e culturale di vittima e assassino. A renderne ancor più ricca la narrazione, il fatto che di esso (e della giovane vittima) ne abbiano parlato alcuni dei testimoni privilegiati intervistati durante la ricerca.

Storie di serial killer. Nella mente degli assassini seriali attraverso l’analisi della scrittura
Chi è il tipico serial killer? Secondo la definizione della serie televisiva Dexter si tratta di un maschio, bianco, single, sulla trentina, emotivamente dissociato. Ma è ancora così? Per rispondere a questa domanda Lidia Fogarolo ha preso in considerazione un campione di quarantacinque scritture di serial killer, responsabili di un ampio ventaglio di aberrazioni che vanno dallo stupro seriale al cannibalismo. Un viaggio nell’inferno della psiche umana, che consente di toccare con mano l’eterogeneità di questi soggetti: anche solo sfogliando il testo, si evince con immediatezza l’incredibile diversità delle scritture, e quindi delle personalità coinvolte in questo tipo di reati, che riflette le problematiche esistenziali più disparate. La ricerca conferma l’impossibilità di identificare una struttura di personalità prevalente, seppure sia possibile riconoscere alcune problematiche ricorrenti, collegate a specifici segni grafologici che la studiosa tratta, suscitando l’interesse e il fascino per una disciplina – la grafologia – frutto di un articolato lavoro in ambito psicologico. La maggior parte dei serial killer non sono dei disadattati sociali che vivono da soli. Non sono dei mostri e non necessariamente presentano segni di «stranezza». Molti serial killer si nascondono in piena vista dentro le loro comunità, hanno spesso casa e famiglia, esercitano un’attività professionale e sembrano essere normali membri della loro comunità. Hindu Law of Inheritance: As in Viramitrodaya of Mitramisra
The institutes of various sages, as embodied in the Dharmasastra, which form the primary source of the Hindu law, treat Law in the widest sense of the term. In these institutes, no distinction was drawn between Positive law on the one Hand and Laws of morality and Religion on the other. But the distinction appeared gradually, some traces of it can be found in the institutes of Yajnavalkya, which devote a separate chapter, called Vyavahara, to the positive law. This authority is held in the highest esteem by The Hindu lawyers. The Mitaksara of Vijnanesvara, which gives a systematic exposition of The Law and is held to be the highest authority in almost all schools, professes to be but a Commentary on Yajnavalkya. The most important part, the Vyavahara, as in Yajnavalkya and Mitaksara, comprises the sections on the law of inheritance and succession. The gradual development of the Hindu law, which was originally moulded by the Institution of family, consisted of the recognition of individual rights and in the introduction of cognates as heirs in preference to more distant agnates. The Viramitrodaya, composed by Mitramisra (17th cent.) is a well known treatise (nibandha) and has always been regarded as an authority of considerable importance by the High Courts and Legal experts in British India. It presents in a very systematic way the Views of Yajnavalkya and Mitaksara and upholds their opinions, particularly of the latter against critics like Jimutavahana. It also gives a satisfactory exposition of which may have been left doubtful by the Mitaksara. The Section on Vyavahara or litigation of the Viramitrodaya is divided into four parts, the third of which describes eighteen Topics of litigations, one of these topics being law of inheritance and succession, called Vibhaga or Dayabhaga, i.e. partition of inheritance. About The Author:- Born on October 4, 1920, Satya Pal Dang graduated from Government College, Lahore. Since early fifties the Dangs have lived in Chheharta (Amritsar). They built up the first municipal committee here as a model municipality and Mr. Dang was its president from 1953 to 1967, when he entered the Punjab Assembly after defeating the then Chief Minister Gurmukh Singh Musafir in Amritsar West, retaining the seat until 1980. He was a minister for a brief period in the first non-Congress ministry where he set a record for his honesty, efficiency and simple living. He and his wife stuck to Amritsar throughout the tragic years of terrorism, organizing the people, giving relief to victims of terrorism and building communal harmony. The Dangs set another example by voluntarily withdrawing from elective posts in the CPI and outside. In 1997, he was honored with the Padma Bhushan award. About The Author:- D.G. Bhattacharyya was born in 1913 in a family of Zamindars. The family had taken up commercial activity, which suffered reverses forcing the closure of the business and making the young scion seek employment After graduating in Science from the Calcutta University, Bhattacharyya joined the Indian (Imperial) Police Service, and retired from the same in 1971 with the rank of Inspector General of Police. Retirement opened up new vistas for Mr. Bhattacharyya and he founded one of the most successful security and investigation agencies in Eastern India.
