'Is it heretical to assert that Christ and the apostles had none of the things that come into use in human life either in regard to ownership or of dominion over them?' From 1321 to 1323, debate about this question sparked a passionate and bitter controversy over the Franciscan doctrine of the 'absolute' poverty of Christ and the apostles and hence of the basis of the Franciscan practice of poverty. The controversy pitted the Franciscan Order against Pope John XXII and the Dominican Order. This volume contains a translation of two works from that controversy - Hervaeus Natalis's The Poverty of Christ and the Apostles and a Vatican scribe's summary of the positions of several Franciscan clergy including those of two prominent cardinals: Vital du Four and Bertrand de la Tour. Hervaeus Natalis (d. 1323), a distinguished philosopher and theologian, was Master General of the Dominican Order during the controversy. His work, which John XXII read and annotated, provides a comprehensive and rigorous analysis of the central philosophical, theological and scriptural themes at the heart of the controversy. It presents a clear contrast to the positions held by the Franciscans. In their works Hervaeus and the Franciscans treat a wide range of enduring themes in religious and social life: the nature of poverty; the relation of poverty and wealth to perfection; the interpretation of scriptural and patristic authorities; the relationship between ownership, rights and use; the justification for making provision for the future; and so forth. Apart from those works by Thomas Aquinas, this volume presents the only English translation of a principal Dominican treatise on poverty. It concludes with a bibliography and a comprehensive index. The birth and flowering of canonical jurisprudence in the twelfth century is one of the most striking and fruitful developments of the age, marking an important turn in the history of the Church and in framing the essential elements of the rule of law in political and social life. Raymond of Penyafort was an important participant in these developments. Born near Barcelona in 1175, he became a teacher of canon law at Bologna, the greatest centre of legal studies. He joined the newly founded Order of Preachers (Dominicans), and championed multilingual education of the friars for a more effective evangelization of Muslims and Jews. He became Master General of the Order in 1238, and died in 1275. He was canonized in 1601 and has been declared the patron saint of canon lawyers. Pope Gregory IX appointed Raymond to produce a comprehensive compilation of papal legal decisions. The result, the Decretals of Gregory IX (1234), would remain normative in the Catholic Church until 1917. Raymond drew on it to compose his Summa on Marriage, a summary of learned reflection on the law of marriage, to aid his Dominican brothers in hearing confessions, where numerous problems touching on marriage would have been encountered. The definition of marriage and of its ends, stages and impediments, arrangements and consequences are the subject of the work. The Gesta Alberonis records the exploits of Albero von Montreuil (Archbishop of Trier, 1131-1152), portrayed as a daring hero doing battle on behalf of the 'Liberty of the Church'. During the late eleventh and early twelfth centuries, political and ecclesiastical rulers alike sought to clarify the responsibilities, rights, and obligations they had in common and those that were unique to their different but related kinds of rule. Balderich opens the Deeds with explicit reference to these struggles for power, which later came to be known as the Investiture Controversy. This conflict between the church and the German emperor centred on the question of control over the appointment of bishops: clergy and princes alternately allied with and fought against one another, seeking to consolidate their respective powers through different structures of governance. As a young cleric in Metz, Albero resisted an imperially appointed bishop. His audacious use of disguise while travelling on secret missions for his church show him to be very much a folk-hero. And once Albero had been appointed archbishop, Balderich characterizes him as the lynchpin in the actions of popes and kings. Albero ensured the election of King Conrad III, and led troops on campaigns in Italy and northern Germany. But it was Albero's rule as prince-bishop that proved paramount. Albero directed the spiritual affairs of the church in Trier while exercising political rule over the principality, and it is this aspect that is Balderich's principal focus, and which makes the Deeds the remarkable document that it is. Early in the 1240s the university of Paris hired a recent graduate from Oxford, Roger Bacon by name, to teach the arts and introduce Aristotle to its curriculum. Along with eight sets of questions on Aristotle's natural works and the Metaphysics he claims to have authored another eight books before he returned to Oxford around 1247. Within the prodigious output of this period we find a treatise on logic titled Summulae dialectices, and it is this that is here annotated and presented in translation. The book is unique in several respects. First, there is the breadth of its sources. Not only do we find explicit reference to the usual authors such as Aristotle, Plato, Boethius, Porphyry, and Priscian, we also find unexpected reference to Augustine, Bernardus Silvestris, Donatus, Terence, and Themistius, along with mention of the Muslim philosophers Algazel and Ibn Rushd. Second, it is clear that Bacon is drawing on or reacting to an extraordinarily wide variety of medieval sources: Garland the Computist, Hugh of St. Victor, Master Hugo, Hugutius of Pisa, Isidore of Seville, Nicholas of Damas, Nicholas of Paris, Richard of Cornwall, Robert Kilwardby, Robert of Lincoln, and Robert the Englishman. Third, it unexpectedly presents a full-blown treatment of Aristotle's theory of demonstration. And finally, Bacon reveals a highly unorthodox view of the signification of common terms. The Book concludes with eight Distinctions on the last things ' the resurrection of the body, purgation, hell, the last judgement, and eternity.

In 1496 the poet laureate Nagonius presented Henry VII with a manuscript of Latin panegyric poetry. This elaborate diplomatic gift from Pope Alexander VI solicited the King's support against Charles VIII of France. The verse emphasized the mutual benefit of an alliance: if Henry supported him the Pope would acknowledge disputed Tudor claims to England's throne. For Henry, the gift represented a literary and political coup. With all the rhetorical skill of a learned poet, Nagonius presented the King as a classical hero on an epic scale in the latest Italian style. The work thus acknowledged Henry's international significance. Other recipients of Nagonius's panegyric verse include Holy Roman Emperor Maximilian I, Vladislav II of Bohemia, Louis XII of France, Doge Leonardo Loredan, the condottieri Niccolo Orsini and Gian Giacomo Trivulzio, Giovanni Bentivoglio, lord of Bologna, and Duke Ercole d'Este of Ferrara. The presentation of a deluxe manuscript to Julius II, celebrating the pontiff 's campaign in the Romagna, marked the climax of the poet's career. This analysis of the life and works of Nagonius thus provides a fascinating insight into the world of late medieval and early Renaissance court cultures. Several papers consider the troubled times during the late fourteenth and early fifteenth centuries in England, when a number of major translation projects were undertaken; others explore the place of translation in daily life (pro forma letters, gynaecological treatises, forged documents in support of a local shrine, texts rewritten so as to update legal references in them); another considers the importance of paper for the rapid dissemination of translated texts. Also featured prominently is the translation of different sorts of religious texts, originally variously in monastic, eremitical and mendicant milieux, and including the 'translations' for their readers of divine messages received by female visionaries. The more generous understanding of the term indicated by the use of quotation marks for these latter is also reflected in a paper considering representations of heaven and hell in visual arts. All the contributions share an awareness of translation as culturally specific - as originating in and addressing specific contexts: of; for example; nationality, politics, class and gender. In this process of transmission, translation plays a central part. Most of the texts in the anthology are translations from Latin or French into Middle English. In addition, the anthologist's selection and ordering of texts within the volume, intended to further the readers' spiritual lives, translates them anew for his intended audience. This study provides finely detailed analyses of the texts in the textual and material context of the Amherst anthology as well as in their religious and historical contexts. It also offers a first-time edition of Quedam introductiua extracta, a Latin compilation contained in the manuscript, and a discussion and listing of verbal marginal annotations reflecting early readers' reactions to the texts. Fundamental to all translation work, the concept of 'displacement' allows one to take into account the multiple successive states inhering in a single text, and to interpret these variations. Translation is, in effect, a form of transfer; more specifically, it involves a movement from one context to another, be it national, social, political, historical, linguistic or religious. The texts examined here illustrate, each in their unique way, the relationship between contextual change and audience. They are also the product of subtle interactions between a variety of elements, the result of which is a 'reinvention' of their respective roles and uses over time. For example, a text intending to entertain may also have educational outcomes; a book of local miracles may attract pilgrims and contribute to the economic life of a monastery; a text and its translations may at some point be appropriated for polemical purposes, while a library of translated texts founded on humanist principals may also serve political ends. Furthermore, each successive adaptation and its accompanying annotations impacts upon the tonality of a text. While this diversity of meanings may inspire some (such as the medieval poet Marie de France), it moreover raises a number of important and difficult questions for the modern translator. How, for example, does one translate the 'harmonics' underlying a series of mystical puns? The 'solution' usually involves a compromise that both enhances and undermines the translated text. This volume presents a selection of twenty-eight papers delivered at the Seventh International Conference dedicated to The Theory and Practice of Translation in the Middle Ages, which took place at the University of Paris III - Nouvelle Sorbonne in July 2004. The period covered by the texts and their translations extends from antiquity to the present day. The literary and critical breadth of these papers, as well as the rigorous interrogation of the modern translation theory, illustrates the remarkable vitality and diversity of current scholarship in this field.
