‎La caratteristica più evidente dello spazio pubblico interculturale è quello di offrire ai soggetti che compongono la complessità la chance di integrare, senza demolire, il contesto di riferimento. La cifra politica di questo nuovo modo di intendere la convivenza civile parte dal presupposto che la persona umana rappresenta la "posta in gioco" più preziosa da preservare e che le comunità, i gruppi, le organizzazioni, hanno il compito di supportare questa risorsa senza pretendere di egemonizzare il rapporto con i poteri pubblici. Sulla base di questo presupposto, chiunque può ritrovare le ragioni per non considerarsi "estraneo" ovunque risieda, valorizzando il proprio bagaglio culturale all'interno di una dimensione inclusiva e non respingente. Compito del diritto interculturale sarà quello di "tradurre" le dinamiche del confronto in regole progressivamente accessibili, facili da declinare perché flessibili, senza imporre modelli rigidi frutto di una visione della società fortemente condizionata da canoni monoculturali. L'islam rappresenta una buona cartina di tornasole per verificare come la democrazia costituzionale si predispone a guidare i grandi cambiamenti in corso. E l'Europa, quella dei diritti e delle libertà fondamentali, attraverso i suoi documenti e l'azione dei suoi tribunali, si presenta come lo spazio politico-istituzionale e ordinamentale più importante per analizzare fino a dove e attraverso quali soluzioni è possibile spingersi per dare risposte ai problemi della post-modernità.
