But what precisely distinguished this code from the rest of Israel's law? Could it ever have been practised? It is such questions as these which concern Dr. Phillips, who approaches the Decalogue from the standpoint of the law courts. He argues that the ten commandments constituted the stipulations of the covenant entered into at Sinai by which Israel came into being, observance of which maintained her existence. But since breach of any of these stipulations threatened the entire covenant relationship, Israel herself treated such breach as a crime, that is an offence against the community, which the community itself punished by execution. Thus Israel technically distinguished crimes from civil wrongs (torts), for which the individual would sue personally for compensation, the injury being of no direct concern to the community. Dr. Phillips therefore maintains that the ten commandments had an inner unity of which he argues that both the Book of the Covenant and Deuteronomy take note.
