The Baseline Evaluation Team BET was convened to decide which type of plutonium purification process should be chosen for the Modern Pit Facility MPF baseline. The two main alternative purification baselines which was the basis for this evaluation were referenced as B1b and B2a. After review of the two proposed feed purification baseline flowsheets the BET selected Baseline B1b for the MPF. Baseline B1b is a combination of aqueous and pryo-chemistry utilizing tilt-pour furnaces developed by the Lawrence Livermore National Laboratory and was ranked higher 62% vs. 38% See Table E-1 in meeting the performance goals identified by the Technology Working Group TWG Chartered Study Team and the Department of Energy. The methodology to choose between these two baseline technology would be used for future TWG technology selections. The most commonly invoked privilege incorporated within Exemption 5 is the deliberative process privilege the general purpose of which is to "prevent injury to the quality of agency decisions." Three policy purposes consistently have been held to constitute the bases for this privilege: 1 to encourage open frank discussions on matters of policy between subordinates and superiors; 2 to protect against premature disclosure of proposed policies before they are finally adopted; and 3 to protect against public confusion that might result from disclosure of reasons and rationales that were not in fact ultimately the grounds for an agency's action. Since the Modern Pit Facility project was abandoned none of the three policy purposes appear to apply. It is believed that the limitation no long applies. While no DOE review was made an individual who had been trained as an Authorized Derivative Classifier who also had Official Use Only training suggested that there was no longer a basis for the OUO marking.
