Se os Estados n�o se recusassem a cumprir o princ�pio de ius soli tambǸm analisado na presente obra e segundo o qual todo indiv�duo tem pelo menos direito �� nacionalidade daquele Estado em que nasceu o problema descrito simplesmente n�o existiria. Tal direito ao reconhecimento de um v�nculo com a terra criado pelo simples fato do nascimento naquele lugar parece ser o direito humano mais natural que Ǹ poss�vel imaginar. PorǸm no mundo jur�dico positivista em que vivemos aplique-se a fic��o poderosa de que o ser humano deve pertencer a uma pessoa jur�dica chamada Estado soberano em definir quem s�o os seus nacionais.
