Likely a copy of a book that circulated in manuscript and which was never printed this appears to have been the work of a practitioner with an interest in scholarship. It has a title page that simulates a printed example a table of contents an 18-page glossary of Latin terms with English translations which is called a dictionary and an 18-page preface that traces the evolution of agreements from the verbal promises of "the first Ages of the World" to "written Evident Chirography hand writing" and the practice of "our nation of Scotland." The preface draws an interesting connection between secular education and the promotion of "subtitly" and "deceit" and presents the subsequent collection of styles as a corrective. The contents are summarized on the title page: "1. A Collection of Speciall & Singular Clauses through all securities Alphabetically Digested. 2. Symbolls and Solemnities used for the perfecting and Consumating of these writs and rights. 3. The order of the Chancelllary and the styles of writs that are issued therefrom. 4. Light browning some soiling to exterior margins trimmed closely with loss to page numbers and words on a few leaves legibility not affected. $750. This urgent early 18th-century economic tract offers a remarkable window into the systemic financial distress gripping Scotland. The anonymous author soundly illustrates the scale of the crisis noting that over the preceding forty years "almost the Fourth Part of all the Estates in Scotland had Changed Masters or Proprietors through their becoming bankrupt." To remedy this economic paralysis the author proposes a radical overhaul of Scottish bankruptcy law and debt collection procedures. By streamlining legal mechanisms and "preventing tedious law-suits" the project aims to unlock frozen assets protect desperate creditors and ultimately revive a stagnant merchant trade. The publication of this pamphlet in 1721 is highly significant. It was printed in the immediate chaotic aftermath of the collapse of the South Sea Company in late 1720. Popularly known as the "South Sea Bubble" this historic event was the world's first global financial crash. The speculative bubble ruined thousands of investors across Great Britain devastated credit markets and triggered a wave of high-profile bankruptcies. This tract represents a direct localized Scottish response to that imperial financial catastrophe capturing the desperation of creditors trying to salvage what remained of their fortunes. This pamphlet is of the utmost rarity. A single copy is located globally between the OCLC and the English Short-Title Catalogue housed at the National Library of Scotland. It is notably absent from the premier economic collections of the period. Not in Goldsmiths.' English Short-Title Catalogue T192280. unknown books

This substantial folio preserves a sequence of decisions of Scotland's supreme civil court during the mature decades following the Acts of Union 1707 a formative period in which Scots law though operating within a unified British state maintained its distinctive doctrinal identity. The Court of Session-established in the sixteenth century and central to the development of national jurisprudence-continued in these years to articulate a mixed legal tradition drawing upon Roman civil law authority alongside indigenous customary and feudal principles. Collections of "Decisions" such as the present volume belong to the early and only partially systematized tradition of Scottish law reporting often compiled for the use of advocates and practitioners rather than issued under formal judicial auspices. They constitute an important record of precedent before the standardization of reporting in the later eighteenth and nineteenth centuries. The cases recorded here reflect the core business of the court in this period including disputes concerning heritable property succession entail and the expanding sphere of commercial relations in an Atlantic economy. The imprint of Bell & Bradfute among the principal Edinburgh legal publishers of the later eighteenth century situates the volume within the professional print culture that sustained the Scottish bar. The early ownership signature to the title page may be that of John Pollok 1858-1938 Procurator Fiscal for Selkirkshire suggesting later use within the Borders legal community. "In this series of 'Letters' defending the issuance of Scottish banknotes Scott benefits from his work on Swift by patterning the Malachi Malagrowther letters on Swift's Drapier's Letters" Todd & Bowden p. 621. "In February 1826 there may have been a degree of calculation in Scott's entering the debate on a government measure introduced to deal with the economic crisis which would have restricted the rights of the Scottish banks to issue their own notes but Scott represented it as a nationalist issue 'the late disposition to change every thing in Scotland to an English model' Journal 94. In February and March he wrote three letters to the editor of the Edinburgh Weekly Journal in which he used the currency issue as an exemplum for the larger tendency. The letters caused a sensation. Ministerial friends were very angry but withdrew the measure. The banks were grateful; taking a lead from his old rival in love William Forbes they agreed to the creation of a trust for the settling of Scott's debts and The Letters of Malachi Malagrowther as the letters are now known is recognized as a classic in political argument" DNB.
