Balch 1896 which determined the distribution of historical French Spoliation Claims. It documents the resolutions commemorative speeches and tributes delivered by his legal peers including the elected chairman of the meeting Charles Sedgwick Rackemann 1857-1933 who was one of Vergnies' partners at the Boston firm Balch & Rackemann. 1831réf. 42500Boston 1831. Three documents described below all in Very Good or better condition: a. 16pp 8-1/8" x 10." A single stitch holding the pages together. Neatly written in ink manuscript. The author prominent Boston lawyer John C. Park who signs at the end contends "that were the Legislature to attempt to clothe the City of Boston with the authority to tax the citizens to build a railroad or subscribe to the stock of a Railroad it would be unconstitutional and contrary to the genius & spirit of our institutions." A carefully crafted legal argument buttresses his assertion. b. 20pp. Folio 7-3/4" x 12-3/4." Ribbon-tied along the left margin with light spotting around the ribbon. Otherwise a clean and elegantly written manuscript in ink signed at the end with a flourish "Henry Williams" who was probably an original director of the Boston and Worcester Railroad. He argues for a legislative grant of the power to the City "unless there is something express or implied in the constitution to forbid it. We have examined the constitution and can find no such prohibition." An equally sophisticated constitutional argument supports this position. c. 4pp. Single folio leaf folded. Docketed on page 4 "Report of the Committee of the House on the Petition of the City Council application." The House Committee concludes "It is inexpedient to grant the authority prayed for. . ." The 1830s were an era of enthusiastic railroad expansion and speculation. The Panic of 1837 halted this expansion which had been excessively fueled by debt. This offering is the record of one attempt at public funding of a railroad. The legal arguments are noteworthy for their discussion of the constitutional issues which played into the broader issue of governmental funding of "internal improvements" currently a wedge issue between Whigs like Abraham Lincoln and Strict Construction Democrats like Andrew Jackson. unknown books

A mayor of Boston is called "a 'desperate punster'" and a famous Boston historian is described as "'a showy boy at school and college" and "a pushing man with industry and memory enough to be a good scholar but with great talents for making himself ridiculous.'" The anonymous author or authors "'hold it to be the inalienable right of all Yankees to inquire into and to thoroughly sift and examine their neighbor's affairs."'"
